16 ع The court authority in assessing the abusive termination of the labor contract "Comparative Study" Prepared by Abdullah Hamadnah Supervised by Muaed Obeidat Abstract The irrational end of the labor contract from the view of the employer is considered one of the most significant, punitive punishments that the employee might face Due to the increasing figures of labor cases in the courts, a study was designed to shine a light on the manner in which courts rule, their control and evaluation on the employer s abuse, in terminating the employees services, and whether this act of termination was justifiable or not As mentioned in Article 28 of the Jordanian Laborers Law, the employer may maintain the right to end employment But is the early termination of one s employment morally validated? This study concentrates on the contemplation of texts related to ending one s employment by analyzing Article 28, from the Jordanian Laborers Law and Article 69 from the Egyptian Law Illustration on the Jordanian and Egyptian trends and reverence to judicial perseverance was as well incorporated The duty of this study was to point out the observation extent of the court, on the punitive measures facing the employee, in order to evaluate this procedure, on the matter of accuracy In addition, this study was released into the courts control, on the status of the employee leaving employment and ending their labor because of

17 ف economic circumstances The conditions are mentioned in Articles 29 and 31 from the Jordanian labor law, and the Egyptian Legislation This study did not ignore the inspection extent on the conditions stated by the lawmaker, on the right of employer in discharging an employee, as is publicized in Article 29 from the Jordanian Labor Law, and Egyptian Legislation It was necessary to evaluate the legal translation of the labor contract and where the courts power stands towards the appreciation of compensation and sending an employee back to work; as shown in Articles 25 and 26 of the Jordanian Labor Law This study reached a conclusion, that the harshness of these cases is a reality, not a legal one The court rule is to evaluate but this power is not restricted to evaluation The court should be able to integrate into the compensation, whether the matter is financially or morally right This research has proved to be eye-opening, on the topic of how a court system should operate concerning labor contract cases Our hope is that the Jordanian Legislation considers our study carefully, and eventually adopts it
