12 ل Conditions and Effects for the Early Termination of the Commercial Agency By Samer Helmi Saleh Supervisor Dr. Mohannad Abu Mugli Abstract The commercial Agency is represented currently by its form as base to complete and fulfill all the trade transaction, in case concerned parties are not presented at same place. So the concerned party shall seek an agent to work on his behalf and replaces him to complete such transaction with all related consequences. The foregoing was imposed due to the development, continuous and quick trends of the commercial transactions. As a result, the early termination such commercial agency impose group of obligations for and rights for each party which maintain each rights. In case the early termination is attributed to legal cause, the law stipulates the availability of indemnity. This study dealt with conditions and impact of such early termination in five chapters; 1 st chapter discussed the research mechanism, 2 nd chapter discussed commercial agency rules, 3 rd chapter dealt with commercial agency early termination, 4 th chapter dealt with impacts and obligations on contract parties.

13 م The study came to the necessity of dealing with early termination under law texts, as law texts are void of the early termination cases. Also the Jordanian legislator in the civil law contradict to comparative legislation when it holds the agent all the agency consequences in most of the cases, and secure guarantees to protect the agency parties rights and these rights are to be mentioned in case the termination is completed early. In conclusion, this research offers scientific benefit and deals with the miss presentation of the legislator to take into consideration in all the legislations which deal with commercial agencies termination, nothing that agency word is mentioned in some legislations but it is not enough to treat all the early termination issues of the commercial agency. The foregoing was highlighted in this study.
