11 Leasing Contract Ending by Ownership: a Comparative Study with the Islamic Principles Prepared by: Muhammad AlRasheedi Associate Supervisor: Dr. Mohanad Abu Magli Dr. Waleed Awajan Abstract This present study aimed to explain what is meant by lease contract ending by ownership, and to illustrate its legal nature, with demonstrating the comparative laws, also mentioning the resulted rule on the lease contracts ending by ownership. The study's problem embedded in that the contract named (financing lease) or (lease ending by ownership) is a new contract, also it is a compound contract of several contracts. Because of the various forms of the financing lease contract this evokes many problems within the Islamic scholars (Foqaha') and law markers, some of the rejected this permission for specific reason, or for several reasons. This study consisted of four chapter: the first chapter was about the lease contract ending by ownership, through the introduction, I tacked the subject's theoretical background. While the second chapter was about the nature of the financing lease through this chapter, I identified the financing contract, its importance specifications and the special legal aspects of the financing lease. In the third chapter I dealt with the legal nature of the financing lease contract, through showing the specialty of the financial lease contract during its formation, and the contract specialty in terms of its effects. In the ك

12 fourth chapter I tacked the lease contract ending by ownership in the (Islamic Sharee'a) through showing the Fiqh position from it, and showing its forms in the local law and the Islamic principles. The researcher concluded with a set of results including: 1 the Jordanian legislator was right to place the term in article (5) from the financing lease law that the contract should be organized in written from between the leaseholder and the leasing party. 2 It is possible for the financing lease contract to be all transferable funds, and the Jordanian legislator did not place the term that these money should be allocate for the professional use or have the production nature, in contract with the Egyptian legislator term in article one of the financing lease contract. 3 The legal relation parties are subject in the financing lease contract to local terms that absent in the legal relation in the ordinary lease contract, the reason for the difference attributes to the different economic role of the two contracts. The main prominent recommendations were: 1 The spread of the financing lease concept between the private firms and establishments and to illustrate its useful for them. 2 Explaining and facilitating the used procedures process for the departments, and the governmental establishments in relation with executing the laws that organize the financing lease. 3 Finding the security umbrella for the leased assets. ل
