11 Presumption and its Role of Proof in criminal matters (A comparative study in Jordanian and Iraqi laws) Prepared by the student Raed sabbar Abbas Supervision of Prof. Dr. Mohammed Jabour Abstract This study aimed to illustrate the presumptions effectiveness on the lawsuit in the Jordanian and the Iraqi Laws, also to show the presumption and their types, in addition to show the extent of the legal and the juridical presumptions, effectiveness, and their detailed judgments, and addressing the freedom of the criminal judge in taking the indirect evidence, and to show what is the position of the Jordanian and the Iraqi legislation from the criminal proof by the juridical of presumption. The importance of this study stems from that the juridical presumption are the results that the judge derives and rules in their verification from incidents or from known signs presenting to him to proof the incident that is intending to proof. The study concluded with important results, among them tat deriving the unknown incident that needs to be verified from the known incident should be consistent with the other lawsuit's condition and circumstances, because inferencing the presumption requires from the judge to derive the presumption from a fixed and proved incident, then demonstrates the logical causal relation between the known event and the other event that is intending to proof.
12 Also, the study reached recommendations; the most important is that we wish that the Iraqi court of cassation takes the individual juridical presumption as a sufficient evidence to rule as it is taken in the Jordanian judiciary as long as it is in consistent with the mind and the logic and within the context of the lawsuit. Also, the study recommending not to consider the judicial presumption the least evidence rank in the proofing, rather that it should be left to the of the issue who has the authority to evaluate and assess the evidences according to the circumstances of each case.
