3 1 Summary Is this a Self-Gvernance Mdificatin? The Mdificatin Panel determined that this is nt a self-gvernance mdificatin because it is likely t have a material impact n cmmercial activities cnnected with the transprtatin f gas cnveyed via the Natinal Transmissin System and the peratin f this pipeline system 1. This is due t the changes prpsed t a number f timed Nminatin prcesses between Users and Natinal Grid NTS. Why Change? This mdificatin is ne f a number that seek t implement relevant prvisins f a number f new EU Netwrk Cdes which have been intrduced in rder t enable prgress twards a cmpetitive and efficient [internal r Eurpean?] market in gas. In rder t facilitate cmpliance with the requirements f the EU Netwrk Cde n Gas Balancing f Transmissin Netwrks (the Balancing Cde ), the UNC needs t prvide fr new arrangements regarding Daily Nminatin and Renminatins at Intercnnectin Pints (IPs). Fr the avidance f dubt, n changes are prpsed t the prevailing arrangements fr Daily Nminatins and Renminatins at all ther System Pints. Aspects f the new Nminatins arrangements advcated by this mdificatin will als facilitate cmpliance with specific prvisins f the EU Capacity Allcatin Mechanism (CAM) Cde (the CAM Cde ) and thse prpsed in the EU Interperability Cde (the Interperability Cde ). The Balancing Cde was apprved in Octber 2013 (and entered int frce in April 2014) and GB is required t implement the necessary changes (t systems and dmestic cmmercial arrangements) n later than 01 Octber The CAM Cde was apprved in April 2013 (and entered int frce in Octber 2013) with implementatin required n later than 01 Nvember The Interperability Cde is currently in the final stages f apprval 2 and is expected t mandate implementatin by 01 Octber The prcedures fr Daily Nminatins and Renminatins at IPs described in the Balancing Cde and ther EU Cdes differ frm the prevailing GB arrangements, principally as a result f the need fr interactin between the relevant peratrs f the respective Transmissin Netwrks at the IP t perfrm the Nminatin matching prcess. This change has a cnsequential impact n timescales fr prcessing User Nminatins at IPs by Natinal Grid NTS as the Transprter. Slutin New distinct rules fr the submissin and prcessing f Daily Nminatins and Renminatins at IPs are prpsed. Current and any future IPs wuld be bund by the prpsed rules. Key aspects f the prpsal include establishment f tw separate nminatin types ( single sided and duble sided ); and a new prcess t enable the matching f User nminatins at each side f the IP. 4 cnsequential changes t the UNC will therefre facilitate cmpliance with Eurpean legislative requirements. Implementatin N implementatin timescales are prpsed, hwever implementatin f the prvisins f the EU Gas Balancing Cde is required n later than 1 st Octber 2015 with implementatin f the Interperability Cde expected t be required by the same date. Implementatin f the CAM Cde is required n later than 1 st Nvember Implementatin f the reflective changes t the UNC will therefre have t ccur in time t allw Users t submit nminatins in cmpliance with the three Cdes fr Gas Day 1 st Octber As it is prpsed that such nminatins can be submitted frm 30 Days prir t the Gas Day, implementatin f this Prpsal is required n later than 1 st September Page 4 f 23

5 2 Why Change? Regulatin (EC) N 715/2009 f the Eurpean Parliament and the Cuncil f the Eurpean Unin came int frce in September 2009 and intrduced a Eurpean Netwrk f Transmissin System Operatrs fr Gas (ENTSOG). One f ENTSOG s tasks was t prepare legally binding netwrk cdes in frm f Eurpean secndary legislatin t the Gas Regulatin (N 715/2009). The aim f the cdes is t enable prgress twards a cmpetitive and efficient internal Eurpean market in gas by the creatin f liquid markets, the efficient use f crss-brder transmissin capacity and the integratin between Member States gas markets. The EU gas netwrk cdes t be established under the regulatin include the Balancing Cde, which includes rules n Nminatin prcedures, imbalance charges and peratinal balancing between Transmissin System Operatrs (TSOs) systems. Sectin C f the UNC Transprtatin Principal Dcument includes the current arrangements fr Nminatins and Renminatins. Principally, the UNC needs t additinally reflect thse aspects f the new arrangements fr Nminatins and Renminatins at IPs that relate t transactins between Users and Natinal Grid NTS. EU Cde Prvisins addressed by this mdificatin This mdificatin seeks t align the UNC with the relevant aspects f the fllwing articles f the EU Cdes 3 : EU Cde Articles (Paragraphs) Descriptin Gas Balancing 17 6 CAM 19(7) 12 Applicable units fr gas quantity & applicatin f Nminatins rules. 13 Minimum data requirements fr a User s Nminatin. 14 Prcedure fr Nminatins. 15 Prcedure fr Re-nminatins. 6 Key Features f the New IP Nminatins and Renminatins Regime 4 Nminatin types Cnsistent with existing UNC terms, Nminatins and Renminatins can be submitted in respect f a Gas Day (kwh/d) at each NTS Exit Pint (specifically Cnnected System Exit Pint) and at each System Entry Pint cmprised in an Aggregate System Entry Pint at an Intercnnectin Pint; and Fr bth Nminatins and Renminatins tw new types are intrduced: Duble Sided and Single Sided. A Single Sided Nminatin enables a User with Bundled Capacity t submit ne Nminatin t the Initiating Transprter in rder t request t fftake frm a Transprter s netwrk and t deliver t an adjacent Transprter s netwrk n a Gas Day at an IP. A User may submit mre than ne Nminatin r Renminatin in respect f a Gas Day at an IP as each individual transactin must specify the User s Cunterparty at the Cnnected System Exit Pint r the System Entry Pint and as mentined abve the User has the ability t submit Duble Sided and/r Single Sided Nminatins and Renminatins: Users may submit Nminatins between 05:00 n D-30 and 13:00 n D-1 (the Nminatin deadline). Users may submit Renminatins between 15:00 n D and three hurs prir t the end f the Gas Day. The Transprter will prcess Renminatins frm the cmmencement f each hur, the hur bar (HB). Transprter t User (and vice-versa) cmmunicatins are required t be in the frmat described in Edig@s- XML r an equivalent data frmat develped by ENTSOG. Nminatin and Renminatin prcess timescales The new prcess requires the matching f a User s Nminated and Re-nminated quantities at each side f an IP by the respective Transprters t ensure bth Transprters agree and cnsequently utilise the same quantity t flw the gas acrss the IP. Within the matching prcess, gas quantities are classified as fllws: Nminatin Quantity is the quantity nminated fr delivery r fftake in a User s prevailing Nminatin 5 ; Renminatin Quantity is, in respect f a Renminatin, the amunt by which the Nminatin Quantity under an earlier Nminatin was revised by such Nminatin r, in the case f a New Renminatin, the Nminatin Quantity 6 ; 4 Fr the purpses f this Prpsal, reference t a User means a Shipper User 5 As per existing terms f the UNC TPD C1.1.2(e) 6 As per existing terms f the UNC TPD C4.1.9(b) Page 6 f 23

The timescales quted in Figures 1 and 2 apply t Nminatins and Renminatins as fllws: (by 13:15 / HB+15) means the specific time (13:15 in this example) refers t the deadline n the Preceding Day in respect f Nminatins; and the term HB+15 refers t the deadline in respect f Renminatins relative t the HB hence the deadline in this example is 15 minutes after the HB Rejectin and revisin f Nminatins and Renminatins The Balancing Cde identifies a number f circumstances in which a Transprter may reject a User s nminatin in respect f an IP. Further, in limited circumstances the Balancing Cde als enables the Transprter t revise nminatins as a cnsequence f an Exceptinal Event r an emergency situatin where there is an evident danger t system security and stability. An Exceptinal Event is defined in the Interperability Cde as any unplanned event that may cause, fr a limited perid, capacity reductins, affecting thereby the quantity r quality f gas at a given System Entry Pint r Cnnected System Exit Pint at an IP, with pssible cnsequences n interactins between Transprters as well as between Transprters and Users. This is equivalent t a Transprtatin Cnstraint within the GB regime. Whilst an ver-nminatin (a request fr within day interruptible capacity) is permitted by the CAM Cde (and supprted by the Balancing Cde) and the Balancing Cde prvides the ability fr the Transprter t reject a nminatin abve capacity entitlement 7 (in any circumstance), Natinal Grid NTS seeks t maintain cnsistency with the existing GB regime. Hence it is prpsed that neither steps are intrduced and that allcatin f gas flws t a User in excess f capacity entitlement will cntinue t be subject t Overrun Charges as described in UNC TPD Sectin B. 7 The term capacity entitlement utilised in this Prpsal refers t the User s Fully Adjusted Available NTS Entry Capacity r Fully Adjusted Available NTS Exit Capacity. 9 Trades and Renminatins The shrt term standardised prducts defined in the Balancing Cde are cnsistent with the balancing tls used in the GB regime. Hwever where GB Physical r Lcatinal prducts are traded and the quantity f gas t be delivered and/r fftaken t/frm the transmissin system is at an IP, the way the gas flw is amended (via a Re-nminatin) will need t change. Re-nminatins at IPs differ as fllws; the lead time fr the Renminatin cycle at an IP culd take up t 120 minutes whereas currently they are enacted 60 minutes after ntificatin by the Trading System Operatr; and the User may als have mre than ne Nminatin per System Entry Pint r Cnnected System Exit Pint at the IP, whereas currently nly ne Nminatin is pssible. Renminatins required as part f a trade are als currently prgressed autmatically n behalf f the User within Gemini but given the abve differences and the need t cnduct the Matching prcess with the Adjacent Transprter it is prpsed that a different apprach is needed fr IPs. Within the transitinal perid frm the prpsed implementatin date f 1st September 2015 t 30th September 2015 (inclusive), User Nminatins and Renminatins in respect f: Gas Days cmmencing up t and including 30th September 2015 will be subject t existing UNC prvisins in place prir t implementatin f this prpsal; and Gas Days cmmencing 1st Octber 2015 r later will be subject t the new rules in place as a cnsequence f the implementatin f this prpsal. 3.3 Nminatins and Renminatins - General It is prpsed that the UNC will be mdified t reflect: tw new distinct input and utput Nminatin and Renminatin types relevant t the IP Nminatins and Renminatins prcess: Single sided; and Duble sided. that the Transprter t User (and vice-versa) ntices fr Nminatins and Renminatins at IPs are required t be in the frmat described in Edig@s-XML r an equivalent data frmat develped by ENTSOG. that Natinal Grid NTS will acknwledge receipt f a User s Nminatin r Renminatin; tw additinal quantity types relevant t the IP Nminatins and Renminatins prcess: Prcessed Quantity; and Cnfirmed Quantity. that a User may submit mre than ne Nminatin r Renminatin in respect f a Gas Day at an IP. 12 that Natinal Grid NTS will publish the rle undertaken by Natinal Grid NTS at each relevant System Entry Pint r Cnnected System Exit Pint at the Intercnnectin Pint, specifically, whether Natinal Grid NTS is the Initiating Transprter r the Matching Transprter. that Natinal Grid NTS will publish the rule applied at each System Entry Pint r Cnnected System Exit Pint at the Intercnnectin Pint in the event that the Prcessed Quantity determined by each Transprter (in respect f a Nminatin r Renminatin) d nt match. 3.4 Prcessing f Nminatins It is prpsed that the UNC will be mdified t reflect: that a User may submit a Nminatin between the start f the thirtieth (30 th ) Gas Day prir t the Gas Day and 13:00 n the Preceding Day (the Nminatin Deadline). Only the Users last accepted related Nminatin received prir t the Nminatin Deadline will be prcessed by Natinal Grid NTS; that where the a User des nt submit any accepted Nminatins by 13:00 n the Preceding Day the User shall be deemed t have made a Nminatin with a Nminatin Quantity f zer at the Nminatin deadline; that the infrmatin required t be specified in a User s Nminatin shall include: the identity f the IP; the Nminatin type (i.e. Single Sided Nminatin r Duble Sided Nminatin); the directin f gas flw; the identity f the User; the identity f the User s Cunterparty (including Balancing Prtfli Identificatin if applicable); the start and end time f gas flw; the date f cmmencement f the relevant Gas Day; and the Nminatin Quantity (in kwh/d). that, in respect f an accepted Nminatin, Natinal Grid NTS will determine a Prcessed Quantity which will be matched with the Adjacent Transprter and therefre the Cnfirmed Quantity may be different t the Nminated Quantity and Natinal Grid NTS Prcessed Quantity; that in respnse t an accepted Nminatin, Natinal Grid NTS will issue the Cnfirmed Quantity t the User by 15:00 n the Preceding Day. 3.5 Prcessing f Renminatins It is prpsed that the UNC will be mdified t reflect: that a User may submit a Renminatin between 15:00 n the day prir t the Gas Day and three hurs prir t the end f the Gas Day. Natinal Grid NTS will prcess a Renminatin (the Renminatin Cycle ) frm the cmmencement f the hur fllwing receipt (the Hur Bar r HB ) and will Page 12 f 23

The gas quantity t be specified in the nminatin and re-nminatin shall be expressed either in kwh/d fr daily nminatins and re-nminatins r in kwh/h fr hurly nminatins and renminatins. 2. The transmissin system peratr may require netwrk users t prvide further infrmatin n nminatins and re-nminatins in additin t the requirements set ut in this Regulatin, including, inter alia, an accurate, updated and sufficiently detailed frecast f the expected inputs and ff-takes, this in accrdance with the specific need(s) f the transmissin system peratr. 3. Articles 13 t 16 regarding nminatins and re-nminatins fr unbundled capacity prducts shall apply mutatis mutandis t single nminatins and re-nminatins fr bundled capacity prducts. Transmissin system peratrs shall cperate fr the purpse f implementing nminatin and renminatin rules fr bundled capacity prducts at intercnnectin pints. 4. A netwrk user shall be entitled t submit t the transmissin system peratr a nminatin fr gas day D n later than the nminatin deadline n gas day D-1. The nminatin deadline shall be 13:00 UTC (winter time) r 12:00 UTC (daylight saving) n gas day D The last nminatin received by the transmissin system peratr frm a netwrk user befre the nminatin deadline shall be taken int accunt by the transmissin system peratr. The cnfirmatin deadline shall be 15:00 UTC (winter time) r 14:00 UTC (daylight saving) n gas day D The transmissin system peratrs at either side f the intercnnectin pint may agree t ffer a pre-nminatin cycle within which: (a) netwrk users are nt bliged t submit nminatins; (b) netwrk users may submit t transmissin system peratrs the nminatins fr gas day D n later than 12:00 UTC (winter time) r 11:00 UTC (daylight saving) n gas day D-1; (c) the transmissin system peratr shall send the message regarding the prcessed quantities t the respective netwrk users n later than 12:30 UTC (winter time) r 11:30 UTC (daylight saving) n gas day D In the absence f a valid nminatin sent by the netwrk user befre the nminatin deadline, the respective transmissin system peratrs shall apply the default nminatin rule agreed between these transmissin system peratrs. The default nminatin rule in frce at an intercnnectin pint shall be made available t the netwrk users f the transmissin system peratrs. Article 15 Re-nminatin prcedure at intercnnectin pints 1. A netwrk user shall be entitled t submit re-nminatins within the re-nminatin perid which starts immediately after the cnfirmatin deadline and ends n earlier than three hurs befre the end f gas day D. The transmissin system peratr shall start a re-nminatin cycle at the start f every hur within the re-nminatin perid. 2. The last re-nminatin received by the transmissin system peratr frm a netwrk user befre the re-nminatin cycle starts shall be taken int accunt by the transmissin system peratr in the re-nminatin cycle. 3. The transmissin system peratr shall send the message regarding the cnfirmed quantities t the respective netwrk users within tw hurs frm the start f each re-nminatin cycle. The start time f the effective gas flw change shall be tw hurs frm the start f the re-nminatin cycle, unless: (a) a later time is requested by the netwrk user; r (b)an earlier time is allwed by the transmissin system peratr. 4. It shall be assumed that any change t the gas flw ccurs at the start f each hur. Article 17 Rejectin f nminatins and re-nminatins r amendment f the requested gas quantity at intercnnectin pints 1. The transmissin system peratr may reject: (a) a nminatin r re-nminatin n later than tw hurs after the nminatin deadline r the beginning f the re-nminatin cycle in the fllwing cases: (i) it des nt cmply with the requirements as t its cntent; Page 19 f 23

20 (ii) (iii) (iv) it is submitted by an entity ther than a netwrk user; the acceptance f the daily nminatin r re-nminatin wuld result in a negative implied nminatin flw rate; it exceeds the netwrk user s allcated capacity; (b) a re-nminatin n later than tw hurs after the beginning f the re-nminatin cycle in the fllwing additinal cases: (i) (ii) it exceeds the netwrk user s allcated capacity fr the remaining hurs, unless this re-nminatin is submitted in rder t request interruptible capacity, where ffered by the transmissin system peratr; the acceptance f the hurly re-nminatin wuld result in an expected gas flw change befre the end f the re-nminatin cycle. 2. The transmissin system peratr shall nt reject a netwrk user s nminatin and re-nminatin n the sle grund that this netwrk user s intended inputs are nt equal t its intended ff-takes. 3. In case a re-nminatin is rejected, the transmissin system peratr shall use the netwrk user s last cnfirmed quantity, if any. 4. Withut prejudice t the specific terms and cnditins applicable t interruptible capacity and capacity subject t cngestin management rules, the transmissin system peratr may in principle nly amend the gas quantity requested under a nminatin and re-nminatin in exceptinal events, and emergency situatins when there is an evident danger t system security and stability. Transmissin system peratrs shall ntify t the natinal regulatry authrity any such actin taken. Chapter III Operatinal balancing Article 7 Shrt term standardised prducts 1. The shrt term standardised prducts shall be traded fr delivery n a within day r day ahead basis seven days a week in accrdance with the applicable rules f the trading platfrm as defined between the trading platfrm peratr and the transmissin system peratr. 2. The riginating trading participant is the trading participant that psts a bid r an ffer t trade n the trading platfrm and the accepting trading participant is the trading participant that accepts it. 3. Where a title prduct is traded, the fllwing cnditins shall be met by the trading participants: (a) ne trading participant makes an acquiring trade ntificatin and the ther makes a dispsing trade ntificatin; (b) (c) bth trade ntificatins shall specify the gas quantity transferred frm the trading participant wh makes a dispsing trade ntificatin t the trading participant wh makes an acquiring trade ntificatin; where an hurly ntificatin quantity is used, it shall be applied flat t all the remaining hurs f the Gas Day frm a specified start time and shall be equal t zer fr all the hurs befre this start time. 4.
