1 TERMS AND CONDITIONS FOR SALE Tours are welcome. Office is located 2 miles south of Newland, off NC Hwy 194. Shipments will start as soon as weather permits. Due to inventory, we need your cut tree orders no later than October 1, Place a tentative order early. Orders will be filled as orders are received unless date is specified. We do our best to meet shipping date but cannot guarantee shipments because weather conditions, etc. A $2.00 per plant charge will be assessed for loads requiring specialized treatments. Customer is responsible for all unloading. Shipments are delivered by common carriers. Prices are F.O.B. our nursery. Customer is responsible for all shipping charges. When back-haul trucks are used and C & G must provide nursery tarp, the customer is responsible for returning the tarp, at C&G s cost, in a reasonable amount of time, or a $ fee will be assessed to cover replacement cost of the tarp. All orders for cut trees must be accompanied with a 25% deposit to confirm order,with balance C.O.D. Our terms for live plant material are Net 30 days, to customers with established credit. A 1 ½% service charge after 30 days will be applied to account. Customer agrees to pay all late charges. We reserve the right to cancel shipment of plant material to customers who consistently disregard our terms or conditions of sale. We are unable to confirm or dig orders for customers with overdue accounts. We book all orders with the understanding that same shall be void should injury befall the stock from flood, drought, fire, winter damage, error in count or other causes beyond our control. Any replacements can only be made at ½ of original cost. Partial credit will be given on broken tops and limbs incurred during shipping of Christmas trees. TRANSPORTATION RISKS While we use the greatest of care in packing our stock, we are not liable for delays in transit; our responsibility ends when transportation company leaves our docks. All stock travels at purchaser s risk and any claim must be made against transportation company. NO WARRANTY, expressed or implied, can be offered unless a claim has been made at time of delivery on the shipping receipt or in writing within seven days of receipt of nursery stock. No claims will be considered on past due account. i
