6 GMP Summary Revision Number A brief general summary of the scope of work, alternates, etc., is as follows: Provide temporary air cooled chiller Demolition Drain chilled and condenser water loops Remove the existing chiller Remove existing pump, pipe and fittings Remove existing pipe, valves, sensor and fittting serving chiller Remove existing cooling tower Remove all associated pipe, fittings and valves associated with the chiller Remove existing structural supports Remove existing cooling tower fence as necessary to install new cooling tower Remove existing ceiling and insulation New Installation Pressure wash the existing mechanical room floor. 11 Description of Work (Exclusions) Revision Number The following is a listing of all Exclusions included in the specification listing, plus all exclusions not related to the specifications: Abatement of any hazardous materials such as asbestos, lead, mold, PCB, fluorescent bulbs, etc. Temporary cooling of any kind. 12 Description of Work (Qualifications and Assumptions) Revision Number The following is a summary of all Qualifications and Assumptions including the Qualifications and Assumptions listed in the specification listing: Power and water necessary for the performance of the work will be provided by the SBBC. We plan to reuse existing fence materials. Hazardous material abatement is by the SBBC. Work to be performed between the hours of 7:00 AM and 3:30 PM. Any work not shown on the drawings. We acknowledge the following regarding liquidated damages: Time is of the essence in the performance of the Work under the Contract Documents. The Owner and Construction Manager agree that the losses suffered by Owner, if Substantial Completion of the Work is not achieved, are not ascertainable at this time. Construction Manager acknowledges and agrees that, since time is of the essence, the Owner will suffer financial and other losses if Substantial Completion of the Work is not achieved within the Contract Time, as said Contract Time may be adjusted pursuant to the terms of the Contract Documents. Should the Construction Manager fail to achieve Certificate of Substantial Completion of the Work within the Contract Time, Owner shall be entitled to assess, as liquidated damages, but not as a penalty, the sum of $00.00 for each calendar day thereafter until substantial completion is achieved. Should the Construction Manager achieve Certificate of Substantial Completion of the Work within the Contract Time but fail to achieve Certificate of Final Inspection of the Work within its Contract Time, Owner shall be entitled to assess, as liquidated damages, but not as a penalty, the sum of $ for each calendar day thereafter until Certificate of Final Inspection of the Work is achieved. Construction Manager hereby expressly waives and relinquishes any right which it may have to seek to characterize the above noted liquidated damages as a penalty, which the parties agree represents a fair and reasonable estimate of the Owner s actual damages at the time of contracting if Construction Manager fails to achieve Substantial Completion or Final Inspection of the Work within the Contract Time. Further, the parties acknowledge that it would be extremely difficult, if not impossible, to ascertain Owner s actual damages with any degree of certainty in the event Construction Manager fails to achieve either Substantial Completion or Final Inspection of the Work within the Contract Time.
