3 BACKGROUND OF THE STUDY Compulsory land acquisition is defined as the process by which governments acquire private land rights without the willing consent of the owner or occupant in order to benefit society. It provides the first and early step in provision of socioeconomic development as it makes land available for establishment of the essential infrastructure and public utilities. In Kenya, the land acquisition process is guided by the Land Act, 2012 Part viii (Compulsory acquisition of interest in land) that gives guidelines and the procedures. And NLC is the agency mandated to conduct the exercise on behalf county and national government.

4 SGR will cut through Kenya,Uganda,Rwanda and South Sudan. Standard Gauge consists of 60 % of worlds rail. Common gauge globally. 1435mm(4 f t ) gauge track compared with existing Meter gauge of 1000mm(3 f t ). A photo of the trial section of the SGR taken by Nation Media group at Mtito Andei (Makueni County) on 23 rd January Acquisition will be 70m for the whole alignment apart from( railway stations, Public land) which will acquire 130m of reserve width.

5 PROBLEM STATEMENT The construction of the SGR will involve the compulsory acquisition of land to provide the physical space for its installation and construction. In Kenya the process is time consuming,expensive and complicated owing to the increased stalled government projects due to pending court cases of challenging the process and compensations awarded. Motivated to undertake this project due the high number of major public invested projects the government is undertaking which will require the compulsory acquisition of land.(lappset,nairobi City road Expansions) However the use of GIS in a such a process would improve on its efficiency by providing timely, practical,cost effective information to land acquisition agencies for prior planning of these projects. This will ultimately lead to a fair, just and prompt acquisition process.

6 OBJECTIVES The main objective is to demonstrate how GIS can be applied in the compulsory land acquisition process to provide both spatial and non-spatial information on (SGR) affected land parcels. The specific Objectives : Evaluate the current Compulsory Land Acquisition situation in Kenya. Identify and map the SGR alignment and the affected land parcels of the study section. Create a comprehensive database of the affected land parcels by the standard gauge railway. Demonstrate the use of Standard Query Language on a geographical database and formulate an error analysis of the GIS results.

7 METHODOLOGY AREA OF STUDY The project study area lies in UTM zone 37S between the extends. Eastings m. Nothings m It is 35Km stretch that runs through Kaputiei Central and Kaputiei North land registration sections. This region is an Arid and Semi Arid region (ASAL) whose mainstay economic activity is pastoralism with scattered settlements. Study section borders Machakos and Makueni counties.

15 DATABASE QUERY RESULTS Total of 36 out of 170 land parcels affected in the Kaputiei Registration sections. Five land parcels acquired were acquired by SGR reserve leaving less than 1/8 of an ha. Need for NLC to acquire the remaining unviable portions.

17 ANALYSIS OF THE RESULTS Statistical analysis performed at 5% significant at 95% confidence levels. The α has to be very small to make the test useful Computed t=1.684 Calculated t=1.701 Difference=0.017 The two sets of results was found to be significantly same Deviation of GIS results and Kenya Gazette results attributed to the use of RIMs and errors resulting from processing.

18 CONCLUSION The stated objectives were achieved as reflected in the results. Land acquisition maps were produced that provided visual information both the spatial and non -spatial information of the affected parcels. GIS therefore has been demonstrated as a valuable resource in providing reliable and timely information, as well as in analyzing various aspects of compulsory land acquisition process to allow effective prior planning of major public investments. An integral decision making tool.

19 Recommendation The results obtained can be used by : the land registrar to register government interest on the affected parcels relevant Railway Authority(KRA) to mark and protect the acquired land Incorporation of all data related to land which this study did not manage to incorporate such as land use activities, utilities information and values of acquired land.
