2 Tennessee District Public Defenders Conference The District Public Defenders Conference was created by Chapter 588, 11, Public Acts of The Conference is a statewide system of elected public defenders from each Judicial District, and the central administrative office of the Executive Director. The public defenders of Shelby and Davidson Counties were added to the Conference by Chapter 751, 6, Public Acts of It is the duty of the Conference to give consideration to the enactment of such laws and rules of procedure as in its judgment may be necessary to the more effective administration of justice and thus promote peace and good order in the State. Public Defenders and their staffs fulfill the State s obligation under the United States Constitution to provide an attorney to a person charged with the commission of a crime who cannot afford a private attorney. District Public Defenders have the statutory duty to represent indigent persons for whom they have been appointed as counsel by the court: (1) In any criminal prosecution or juvenile delinquency proceeding involving a possible deprivation of liberty; or (2) in any habeas corpus or other post-conviction proceeding. [T.C.A ]. District Public Defenders counsel with the accused and represent such accused in the trial court. If the accused is aggrieved by the judgment of the trial court imposing a sentence of imprisonment, or dismissing a habeas corpus or post-conviction petition, the District Public Defenders must advise the accused fully concerning rights of appellate review. If the accused desires to appeal to an appellate court, the district public defender must seasonably take all steps necessary to perfect the appeal, including a new trial motion when required and the filing of all essential transcripts and records with the clerk of the appellate court. The District Public Defenders then have a duty and responsibility of handling all appeals filed by the indigent person whom they represented in the trial court. There are twenty-nine district public defenders in Tennessee and two local public defenders in Shelby and Davidson Counties. District public defenders are elected by the citizens of their judicial districts and serve eight-year terms. Public defenders and their assistants are licensed attorneys, duly admitted to practice law before the courts of Tennessee. The Public Defenders Conference includes 31 district public defenders. The Conference employs 160 assistant public defenders, 41 criminal investigators, and 80 administrative personnel. The Executive Director coordinates activities of public defender offices across the State and acts as liaison for the Conference among the other branches and divisions of state government.

3 Public defenders are among the most experienced lawyers in Tennessee. Many of our attorneys have been practicing law for more than 30 years, with an overall average experience of about 20 years. The Executive Director of the Public Defenders Conference develops policy, provides administrative services, training, and coordinates multi-district cases. The Executive Director must submit reports reflecting the number, kind, status, and disposition of all cases and proceedings at such times and in such form and manner as directed by the secretary of the judicial council. The Executive Director and his staff assist the District Public Defenders throughout the state in coordinating the efforts of such district public defenders to perform their duties. Such assistance includes, but is not limited to, the obtaining, preparing and supplementing of indexes to the unreported decisions of the criminal court of appeals and the supreme court of Tennessee relating to criminal matters, preparing of basic defenders manual and educational materials, and preparing and distributing uniform appropriate forms. The Executive Director serves in a liaison capacity among the various branches of state government and the divisions thereof, including, but not limited to, the courts, the general assembly, the executive department, and the office of attorney general and reporter. The Executive Director administers the accounts of the judicial branch of government which relate to the offices of the district public defenders, and prepares, approves, and submits budget estimates and appropriations necessary for the maintenance and operation of the offices of district public defenders, and makes recommendations with respect thereto. The Executive Director draws and approves all requisitions for the payment of public monies appropriated for the maintenance and operation of the judicial branch of government which relate to the offices of the district public defenders, and audits claims and prepares vouchers for presentation to the department of finance and administration, including payroll warrants, expense warrants, and warrants covering the necessary costs of supplies, materials and other obligations by the various offices with respect to which fiscal responsibility is exercised. Membership in the District Pubic Defenders Conference consists of all twenty-nine elected district public defenders in Tennessee and the Shelby and Davidson County public defenders. The attorney general and reporter is an ex officio member of the Conference and acts as its legal advisor. The Conference is required by statute to meet once a year. Typically, though, the Conference joins together more often than that. Conference members have joined in a cohesive effort to improve the criminal justice system. By pooling individual talents, the Conference has become an important participant in the legislative and judicial processes. Conference members meet regularly to consider Conference issues, pending legislation, and judicial actions. The Conference also gets together three times a year for intensive training sessions in such areas as management, law updates, and new technology.

4 The Executive Committee provides primary leadership to the Conference. This committee consists of a president, vice president, secretary/treasurer, past president, and three grand division representatives. The bylaws of the Conference empower the Executive Committee to act on behalf of the full Conference in its day-today operations. A statutorily created legislative committee considers enactment of laws and rules of criminal procedures which are necessary to the more effective administration of justice. The committee drafts legislation, and together with the full Conference, submits its recommendations to the General Assembly. Other committees are created as needed to consider such issues as internal training and case counting.
