After a visual observation the MPH Python III radar uni t was act i vat ed. A hi gh f r equency audi o doppl er r et ur n was hear d, whi ch cor r esponded t o t he vi sual est i mat i on and r adar speed r eadi ng of 47 mi l es per hour. The r adar pat r ol speed r eadi ng of 37 mi l es per hour agr eed wi t h t he speed of cr ui ser 6 at t he t i me of t he cl ock. The r adar was i n t he movi ng mode, and t he cr ui ser was movi ng. The def endant di d see t he r eadi ng on t he MPH Pyt hon I I I r adar devi ce. The cal i br at i on of t he MPH Pyt hon I I I r adar devi ce was checked i nt er nal l y and ext er nal l y by t uni ng f or ks at 2338 hour s. Contact was made wi t h t he dr i ver, Mr. Maxwel l Dahs and passenger s, Mr. Tyl er Dahs and Mr. Opf er, who wer e advi sed t he r eason of t he st op. Maxwel l st at ed he di d not bel i eve he was goi ng 50 m. p. h. Whi l e speaki ng wi t h Maxwel l, hi s eyes wer e obser ved t o be bl oodshot and gl assy and t her e was an odor of an al cohol i c bever age emanat i ng f r om t he vehi cl e. Maxwel l was advi sed t o exi t and wal k back t o t he r ear of t he vehi cl e. Maxwel l was asked i f he had al cohol t o dr i nk wi t h hi m st at i ng he had not hi ng. He f ur t her st at ed t he passenger s had been dr i nki ng. Whi l e speaki ng wi t h Maxwel l, t her e was an odor of an al cohol i c bever age emanat i ng f r om hi s per son. Maxwel l was asked once agai n i f he had been consumi ng al cohol wi t h hi m st at i ng he had a f ew beer s. Af t er gr ant i ng consent, Maxwel l was sear ched wi t h not hi ng i l l egal f ound and pl aced i n t he r ear of cr ui ser #6. Contact was made again with the passengers, who stated they were coming from Mr. Dahs' r esi dence and on t hei r way t o St eak N Shake. I r esponded back t o t he cr ui ser and asked Maxwell to submit to field sobriety tests with him stating he would submit. Maxwel l was advi sed t he f i r st t est was t he hor i zont al gaze nyst agmus. He was advi sed t o wat ch t he t i p of my pen wi t h hi s eyes onl y and not t o move hi s head wi t h hi m st at i ng he under st ood. The t est was admi ni st er ed wi t h t he r esul t s as f ol l ows; Af t er checki ng f or equal t r acki ng, Maxwel l had a l ack of smoot h pur sui t i n bot h eyes. He had di st i nct nyst agmus at maxi mum devi at i on i n bot h eyes. Maxwel l had an onset of nyst agmus pr i or t o f or t y- f i ve degr ees i n hi s r i ght eye. Maxwel l was advi sed t he second t est was t he wal k and t ur n. He was advi sed t o stand with his right foot in front of his left, heel to toe. Maxwell put his left foot in front of his right, heel to toe. He was advised again to stand with his r i ght f oot i n f r ont of hi s l ef t, heel t o t oe. Once he was st andi ng i n t he r i ght posi t i on, Maxwel l was advi sed not t o begi n t he t est unt i l i nst r uct ed wi t h hi m st at i ng he under st ood. Maxwel l was advi sed when t ol d t o begi n, he was t o t ake ni ne heel t o t oe st eps i n a st r ai ght l i ne. Maxwel l was advi sed on hi s ni nt h st ep, he was t o t ake a ser i es of smal l st eps and t ur n appr oxi mat el y 180 degr ees. Maxwel l was advi sed after he turned, he was to place his right foot in front of his left, heel to toe. Maxwel l was advi sed t o t ake ni ne heel t o t oe st eps back i n a st r ai ght l i ne. Maxwel l was advised to watch his steps, count the number of steps out loud and keep his arms at hi s si de t hr oughout t he t est. The t est was demonst r at ed f or Maxwel l wi t h hi m st at i ng he under st ood. Maxwel l was advi sed t o begi n wi t h t he r esul t s as f ol l ows; Maxwell counted nine steps, but took ten total steps on the first set of nine steps. After turning, Maxwell did not place his right foot in front of his left, heel to toe before starting the second set of nine steps. Maxwel l was advi sed t he next t est was t he one l eg st and. Maxwel l was advi sed t o keep hi s ar ms at hi s si de t hr oughout t he t est. The t est was demonst r at ed f or Maxwel l wi t h hi m st at i ng he under st ood. Maxwel l was advi sed t o begi n t he t est wi t h t he r esul t s as f ol l ows; Maxwel l pi cked up hi s r i ght f oot, put i t back on t he gr ound, pi cked i t up agai n and began t o count. Maxwell was placed in the rear of the cruiser where he was given a PBT with the r esul t s bei ng Maxwel l was advi sed t o exi t t he cr ui ser wher e he was pl aced i n handcuf f s, whi ch wer e gapped and doubl e l ocked. Maxwel l was pl aced i n t he cr ui ser and advi sed he was bei ng char ged wi t h OVI. A shor t t i me l at er, Ms. Koch r esponded t o t he ar ea and t ook cont r ol of Tyl er Dahs, Mr. Opf er, and t he vehi cl e. Maxwel l was t r anspor t ed t o st at i on wher e he was r ead and shown t he BMV f or m, whi ch he si gned. I t shoul d be not ed, due t o no ot her of f i cer s avai l abl e, I r ead t he f or m t o Maxwel l whi l e Di spat cher St ookey l i st ened over t he phone. Di spat cher St ookey was al so abl e t o wi t ness me r eadi ng t he f or m f r om t he camer a i n t he Di spat ch Cent er. Maxwel l was expl ai ned t he BAC t est and asked t o submi t a br eat h sample with Maxwell stating he would submit to the test. The test was administered wi t h t he r esul t s bei ng Maxwel l was advi sed of t he r esul t s and f ur t her advi sed hi s l i cense was bei ng pl aced under an admi ni st r at i ve l i cense suspensi on. Maxwel l was gi ven a copy of t he pr oper paper wor k, advi sed of hi s cour t dat e, and r el eased t o Mr. Koch.
