PUBLIC HEARINGS: (Please read and complete a speakers form at the podium prior to the start of the meeting. The Chairperson will call on you to speak when your item is called.) 1. Consideration of the Final Environmental Impact Report SCH# , as submitted for the Wistaria Ranch Solar Energy project, proposing a solar development on privately owned undeveloped agricultural land. The proposed project is located approximately six miles southwest of the City of El Centro, California and four miles directly west of Calexico. A Notice of Preparation was noticed in the local and regional newspaper and sent to the State Clearinghouse for a 30 day review and comment period starting on September 26, 2013; a scoping meeting was held at the County Administration Center on October 10, A Notice of Availability for this Draft EIR was noticed to the public and to the State Clearinghouse for agency distribution and review for a 50 day review period beginning on August 22, 2014 through October 10, Consideration of the Mitigation Monitoring and Reporting Program for the Wistaria Ranch Solar Energy project; A Mitigation Monitoring and Reporting Program (MMRP) will need to be adopted as required by CEQA Guidelines Section to ensure that mitigation measures identified in the EIR SCH # are implemented as appropriate. 3. Consideration of a Development Agreement: The Developer of the Wistaria Ranch Solar Energy project agrees to enter into a Development Agreement with Imperial County in connection with development of the Project. The Development Agreement, among other terms, would extend the time allowed for initiating construction for this Wistaria Ranch Solar Center project under each of the sixteen solar conditional use permits (CUPs), beyond the typical three year period. In consideration for the extended construction initiation terms, the Developer would also agree to compensate Imperial County for certain non physical effects of the projects to Imperial County and its citizens. The Development Agreement would be formed pursuant to and consistent with the requirements of Division 23 (Development Ordinance for Non Residential and Residential Projects) of Title 9 of the Imperial County Code (Land Use Ordinance).

Consideration of the Williamson Act Cancellation, The purpose of this Williamson Act Contract Cancellation Preserve #22, Contract is to cancel the current Williamson Act contract to allow for the proposed development of a solar facility on parcel which is being entitled through the proposed Conditional Use Permits CUP & CUP This parcel is currently under Williamson Act contract and is approximately 426 acres in size. 5. Consideration of the Conditional Use Permit # & Variance , as submitted for Wistaria Ranch Solar Energy project, is proposing the construction, operation and reclamation of a solar facility with a variance for a gen-tie and transmission line up to a 140 feet maximum height limit above ground, on four parcels totaling acres for solar development. The CUP area is bounded by the Woodbine Canal and SR 98 on the north; the Greeson Drain on the south; and the Woodbine Canal and Mandrapa Road on the east.. The project site is 4 miles west of the City of Calexico, Assessor s Parcel Number(s) , 026, 029 & (Supervisorial District #2), [David Black, Planner IV at (760) , extension 6. Consideration of the Conditional Use Permit # & Variance , as submitted by for the Wistaria Ranch Solar Energy project is proposing the construction, operation and reclamation of a solar facility and a variance for a gentie and transmission line with a height limit up to 140 feet maximum in height above the ground on two parcels totaling acres for solar development. The CUP area is bounded by the Wistaria Drain on the south and Greeson Drain Number 2 on the west. The project site is 4 miles west of the City of Calexico, Assessor s Parcel Number(s) # , (Supervisorial District #2), [David Black, Planner IV at (760) , extension 7. Consideration of the Conditional Use Permit # & Variance , as submitted for the Wistaria Ranch Solar Energy project, proposing the construction, ground on two parcels totaling acres on one parcel totaling acres for solar development. The CUP area is bounded by Wistaria Lateral 5 on the North; Wistaria Lateral 4 and Kubler Road on the South The project site is 4 miles west of the City of Calexico, Assessor s Parcel Number(s) # acres.
