Opening: Grantner call meeting into order at :0 p.m. II. III. IV. Roll Call: Jeff McLean absent. All others present. Pledge of Allegiance. Approval of Agenda: Wright made motion to approve the agenda. Klein seconded the motion. Voting yes: Pemberton, Wright, Grantner and Klein. Passed -0 V. Approval of Minutes //: Wright made motion to approve minutes. Pemberton seconded motion. Voting yes: Pemberton, Wright, Grantner and Klein. Passed -0 VI. Approval of the Lewis Lawrence Ranch Summary Subdivision: Wright concern of the subdivision was if there were any reasonable expectation of water. Hardin stated the property did indeed have water wells. Another concern Wright questioned was the low price to run electricity to the subdivision and asked that the electric company recalculate the price and advise the property owners that they may have to pay more than the $, as shown in the plans. Pemberton makes motion to approve the Lewis Lawrence Summary Subdivision. Haley seconded the motion. Voting yes: Pemberton, Wright, Klein and Grantner. Passed -0 VII. Approval of the installation of a standard cell tower for New Mexico Gas Buster: The New Mexico Gas Buster is asking for approval of a standard size foot cell tower for Verizon Wireless. This proposed communication tower location would be on the west side of Hwy approximately /0 mile south of White City Rd. Hardin states the tower would provide cell service up to the Texas/New Mexico state line. Wright makes motion to approve the installation of the cell tower. Pemberton seconded the motion. Voting yes: Pemberton, Wright, Klein, and Grantner. Passed -0. VIII. Review and approval of a gas line easement by Higby Hole for Crestwood Midstream before submitting approval request to BOCC: Grant Crisler, a representative for Crestwood New Mexico Pipeline LLC seeking approval from P&D and BOCC for a gas line easement. For safety measures,
3 Wright raised awareness of the pipeline being buried only a minimum of inches below the surface of the ground. Pemberton suggested a inch pipeline burial ( from top of pipeline). Crisler will speak to his management for the reconsideration of the burial depth and will remain in contact with Hardin. Wright makes the motion for the approval of the pipeline easement with the recommendation of a pipeline burial then to be submitted to the BOCC for their approval. Pemberton seconded the motion. Voting yes: Pemberton, Wright, Klein, Grantner. Passed -0 IX. Discussion of the Vegetation Nuisance Ordinance: A second letter from Mr. Jerome Golden was brought upon the P&D Advisory Committee. Focusing on a discussion with Hooper and Tabor regarding the retirement of the new Vegetation Nuisance Ordinance, in which states to keep vegetation below inches high within 00 feet of occupied structures. Hooper will return a letter to Mr. Golden, thanking him for his interest and input regarding the ordinance and let him know that P&D reviewed his concerns but didn t take any action. X. Prioritization of Ordinances: Hooper presented to the P&D Advisory Commission different ordinances to be prioritized and submitted to the BOCC for their approval of the prioritization. Junkyards, Man Camps, Commercial Use In Residential Areas, Abandoned Wells and CEA s. At which the P&D Commission recommended,. Abandoned Water Wells,. Junkyards,. Man Camps. The P&D Commission recommended that the other two (Commercial Use In Residential Areas and CEA s) be taken off the list. This will be taken to the BOCC for approval. XI. XII. XIII. Review of dates and times to hold special meetings: Hooper asked the P&D Advisory Commission what dates were convenient for the Board to hold Special Public Meetings for the MH Ordinance. They discussed and agreed on Wednesday June th, 0 in Artesia and Wednesday July th, 0 in Carlsbad. Both Special Meetings will be Live-Streamed for public comment. Comments and Announcements: None Adjourn: Wright made motion to adjourn. Klein seconded the motion. Voting yes: Pemberton, Klein, Wright and Grantner. 5 Ordinance Prioritization The Eddy County Board of Commissioners, on May, 0 set their prioritization of the open and existing ordinances for revision or new ordinance design. As follows is a list from the Eddy County BOCC:. Junkyards revise or reword existing for further clarification. Man camps to be addressed through a possible new ordinance. Abandoned wells to be addressed through a possible new ordinance. Commercial uses in residential areas to be addressed through a possible new ordinance This listing was passed on a - vote by the BOCC. P&D from this point will move forward with discussion of the prioritization and direction for staff to proceed.
6 Manufactured Home Ordinance The Eddy County Board of Commissioners heard discussion on May, 0 for the setting of dates for the Manufactured Home Ordinance and set the following dates; June, 0 at :0pm in Artesia, NM - location to be determined July, 0 at :00pm in Carlsbad, NM - location to be determined

13 Change Section. Height Restrictions, thusly:. No new communications facility shall exceed feet in height in the Platting and Planning Jurisdictions of the City of Artesia and/or the City of Carlsbad (see attached map). In all other areas of Eddy County no new communications facility shall exceed feet in height. However, in the event topography or other substantial obstacles to signal propagation exists, facilities can be extended to achieve the desired coverage area. Evidence for the need of extended heights must be provided with the application for review and recommendation by the Planning and Development Committee. This is the only change necessary, other than changing all references from the Planning and Zoning Commission to the Planning and Development Committee.
