2 File ID: Consent Item 18 Description/Analysis Issue Detail: Voting must be done in person for the November 7, 2017 election for Reclamation District No.1000's Board of Trustees. Staff recommends authorizing Bill Busath, Director or Jim Peifer, Principal Engineer, to cast the City votes equally among the four incumbents: Thomas Gilbert, Nick Avdis, David Christophel & Debra Jones. Policy Considerations: City Council authorization is required for a City representative to cast ballots for the City-owned parcels located within the Reclamation District s boundaries. Economic Impacts: Not applicable. Environmental Considerations: The Community Development Department, Environmental Services Manager has determined that the proposed activity is not a project pursuant to the California Environmental Quality Act (CEQA). CEQA Guidelines Section 15378(b). The activity is a continuing administrative activity and is not subject to CEQA. CEQA Guidelines Section 15060(c)(3). Sustainability: Not applicable. Commission/Committee Action: Not applicable. Rationale for Recommendation: Only property owners or legal representatives of a property owner may vote in the November 7, 2017 election. Voting must be done in person. Financial Considerations: Not applicable. Local Business Enterprise (LBE): Not applicable. Background: Reclamation District 1000 conducts elections for its Board of Trustees in oddnumbered years in accordance with the California Water Code ( WC ) sections applicable to Reclamation Districts. In prior years, since 1995, there were an equal number of candidates to the number of Trustee positions available and therefore an election was not required - those who filed for the available positions were appointed by the County Board of Supervisors, pursuant to WC In 2013, five candidates filed to fill four Trustee positions thus requiring an election; however, one withdrew during the election process and the Council opted to split the City s votes evenly among the remaining four candidates. During this 2017 cycle there are five City of Sacramento October 31, 2017 powered by Legistar Page 2 of 25
3 File ID: Consent Item 18 candidates competing for four Trustee positions, requiring an election, which will be held on November 7, The four seats are land assessment seats as defined in Water Code , meaning each landowner has a specific number of votes equal to the assessment valuation shown in the Reclamation District s previous year s Operation and Maintenance Assessment Roll, multiplied by four as there are four seats currently up for election (cumulative voting under WC 50753). The City has a total of 33,054,558 votes for the City of Sacramento-owned parcels listed in Exhibit B, out of a total of approximately 1.1 billion votes that may be cast in the election. The City s 33,054,558 votes may be cast for up to four candidates divided in any proportion. However, an owner cannot vote for more than four candidates and cannot exceed its total number of votes or vote fractions otherwise the ballot will be considered invalidated. 4 RESOLUTION NO Adopted by the Sacramento City Council October 31, 2017 CITY DESIGNEE FOR THE NOVEMBER 7, 2017 ELECTION OF RECLAMATION DISTRICT NO TRUSTEES A. Reclamation District 1000 conducts elections for its Board of Trustees in oddnumbered years in accordance with the California Water Code sections applicable to Reclamation Districts. B. Five candidates, shown in the sample ballot (Exhibit A), are running for four land assessment seats. The City has a total of 33,054,558 votes for the City of Sacramento-owned parcels listed in Exhibit B. Votes may be cast for up to four candidates in any proportion. C. The election is on November 7, 2017 and voting must be done in person at the polling location (Stanford Settlement Neighborhood Center) between 7:00 am and 7:00 pm. D. City Council authorization is required to designate a City representative to cast ballots for the City-owned parcels located within the Reclamation District s boundaries. BASED ON THE FACTS SET FORTH IN THE BACKGROUND, THE CITY COUNCIL RESOLVES AS FOLLOWS: Section 1. Section 2.
