18 < 9 FILED IN THE COURT OF APPEALS SENECA CQt11dTY APR 2A 2014 IN THE COURT OF APPEALS OF OHIO MARY K WARD CLERK THIRD APPELLATE DISTRICT SENECA COUNTY STATE OF OHIO PLAINTIFF-APPELLEE CASE NO V GEOFFREY M BANKS DEFENDANT-APPELLANT JUDGMENT ENTRY This appeal having been placed on the accelerated calendar is being considered pursuant t AppR 111(E) and LocR 12 This decision is therefore rendered by summary judgment entry which is only controlling as between the parties to this action and not subject to publication or citation as legal authority under Rule 3 of the Ohio Supreme Court Rules for the Reporting of Decisions Defendant-appellant Geoffrey M Banks brings this appeal from the judgment of the Court of Common Pleas in Seneca County Ohio denying his Motion for Correction of Sentence Pursuant to RC and Motion for Evidentiary Hearing ("Motion") For the reasons that follow we affirm the trial court's judgment On October the Seneca County Grand Jury indicted Banks on three counts of aggravated trafficking in drugs in violation of RC (A)(1)

19 e E Case No a felony of the second degree each with specifications for the amount of the drugs involved and for the offenses occurring within the vicinity of a school The three counts arose from alleged sales of oxycodone to a confidential informant on three different occasions on April April and May The matter proceeded to jury trial and Banks was found guilty of all three counts and specifications On March Banks was sentenced to three consecutive prison terms of five years for an aggregate of 15 years Banks filed his direct appeal on March 29; 2012 ` He raised eight assignments of error; alleging that the convictions and the finding of aggravated circumstances were against the manifest weight of the evidence that the trial court erred in failing to sustain an obj ecticin that he was denied effective assistance of counsel that the imposition of consecutive sentences was not warranted and that the trial court orally cited an improper section of the Revised Code at sentencing We overruled all assignments of error on February in State v Banks 3d Dist Seneca No Ohio-649 appeal not accepted 136 Ohio St3d Ohio NE2d 1020 ("Banks d") Over six months later on September Banks filed the current Motion (R at 93) He requested that the trial court correct his'sentence imposed on March arguing that the offenses for which he was sentenced were allied offenses and as such they had to be merged He further requested that the -2-

20 (D Case No trial court conduct a hearing to determine whether the three counts of the indictment were allied offenses for the purpose of RC (A) The trial court denied the motion in atvo paragraph Judgment Entry stating that it "has reviewed this matter and this Court is of the opinion that said motion is not well taken" (R at 94) Banks now appeals raising three assignments of error Assignment of Error One: Does the trial court have a mandatory duty under [O]hio law RC (A)(b) [sic] to conduct a hearing before sentencing the defendant to determine whether the defendant['s] sentence imposed on count 1 2 and 3 are allied offenses of similar import and failure to conduct such hearing created a manifest miscarriage of justice that rendered the trial court imposed sentence void CrimR: 52(B) violation of the defendant [U]nited [Sltates constitutional right amendments 5 and 14 Assignment of Error Two: The trial court Judgment 'Entry of SEPT:12th 2013 is that Judgment a final appealable order for the purpose of RC that would give the -appeilate court subject matter jurisdiction over the appellant['s] case Assignment of Error Three: Did the trial court have subject matter jurisdiction to imposed [sic] a 15 year prison term upon the defendant for trafficking in drugs RC without first finding the defendant guilty of possession of drugs RC that the trial court imposed sentence void violation of the defendant [U]nited [S]tates constitutional rights amendment 5 6 and 14-3-

21 Case No First Assignment of ErfAor With regard to his first assignment of error Banks argues that the trial court improperly denied his Motion without conducting a mandatory hearing to determine whether his convictions on the three counts of the indictment were for allied offenses of similar import We disagree There are multiple reasons why the trial court's denial of the Motion was proper 1 The Motion was an untimely petition for postconviction relief By filing the Motion Banks was challenging his sentence 'imposed on March A defendant may challenge a judgment of conviction or sentence through two avenues: (1) a direct appeal pursuant to AppR 4(A) filed within thirty days of the judgment entry of conviction or sentencing; or (2) a petition for postconviction relief pursuant to RC State v Ccaldwell 3d Dist Pauld'ing No Ohio-5375; 7 Since Banks's Motion was obviously not a direct appeal ge treat it as a petition for postconviction relief Regardless of the caption a motion is a petition for postconviction relief when it requests "`the court to vacate or set aside the judgment or sentence or to grant other appropriate relief because there was such a denial 6r infringemnt of the person's rights as to render the judgment void or voidable under the Ohio) Constitution or the Constitution ofthe United States []' " State v Maag 3d Dist Hancock No Chio quoting RC (A)(l)(a); see -4-

22 Case No also State v Reynolds 79 Ohio St3d NE2d 1131 (1997); State v In Holcornb the Ninth District Court of Appeals applied the Boswell holding to deterrnine that a motion for resentencing "should not be reclassified as a petition for postconviction relief' if it is based on the trial court's failure to include postrelease control notification 2009-Ohio-3187 at Since Banks's Motion was not based on the trial court's failure to include postrelease control notification the holdings of Boswell Razo and Holcomb would not apply here Fulk 172 Ohio App3d hio NE2d (3d Dist); Caldwell2005-Ohio-5375 at 9 Banks attempts to argue that because his sentence is void his Motion cannot be construed as a petition for postconviction relief He cites State v Boswell 121 Ohio St3d Ohio NE2d 422 superseded by statute as stated in State v Singleton 124 Ohio St3d Ohio NE2d ; State v Razo 9th Dist Lorain No 08CA Ohio- 3405; and State v Holcomb 184 Ohio App3d Ohio NE2d (9th Dist) Boswell stands for the proposition that when the trial court imposes a sentence without informing the defendant about a mandatory postrelease control the sentence is void and the postsentence motion to withdraw guilty plea must be treated as a presentence motion to withdraw 2009-Ohio-1577 at 13; see also Razo 2009-Ohio-3405 (citing Boswell for the same proposition) -5-

23 Case No days "after the date on which the trial transcript is filed in the court of appeals in the direct appeal of the judgment of conviction" State v Andrews 3d Dist Allen No Ohio citing RC 2953:21(A)(2) and State v Everette 129 Ohio St3d Ohio NE2d Here the transcripts were filed on June Thus the time for requesting postconvictioti relief has expired and the Motion filed on September was untimely The trial court should have dismissed the Motion as an untimelv request for postconviction relief See Magg 2009-Ohio-90 at 17 The trial court's Additionally Banks's Motion if successful would have rendered the sentence voidable not void See State v Payne 114 Ohio St3d Ohio NE2d ("A void sentence is one that a court imposes despite lacking subject-matter jurisdiction or the authority to act Conversely a voidable sen:tence is one that a court has jurisdiction to impose but was imposed irregularly or erroneously"); State v Singleton 2d 13ist Montgomery No Ohio fn 1(explaining that the defendant's motion to resentence on the basis that the trial court failed to merge allied offenses of similar import seeks to render a judgment voidable rather than void) Therefore the current Motion can properly be construed as a petition for postconviction relief The procedure for requesting postconviction relief is set out in RC and provides that a petition for such a relief must be filed within

24 Case No denial of an untimely postconviction petition instead of dismissal is not a reversible error and we will izphold it See State v Carter 3d Dist Allen No Ohio The Motion is barred by res judicata We also note that Banks has previously filed a direct appeal in this case and he has not raised the issue of allied offenses then "It is the practice of this Court to hold that the issue of allied offenses raised in post-conviction relief motions [is] barred by the doctrine of res judicata as the proper time to raise it is on the direct appeal *Other districts follow the same practice" State v Lester 3d Dist Auglaize No Ohio citing State v Payton 5th Dist Stark No2010CA Ohio State v Poole 8th Dist Cuyahoga No 0069; 2011-Ohio-2457 and State v Carter 12th Dist Clinton Nos CA ' 012 CA Ohio Here Banks could have raised the issue of merger on direct appeal of his sentence but he failed to do so As a result this claim is barred by res judicata and thus the trial court properly denied the Motion 3 The Motion would fail on the merits We additionally note that the arguments raised in Banks's Motion have no merits because his convictions were for three separate offenses committed on three Ohio State v Freeman l lth Dist Trumbull No2010-T- -7-

25 41 Case No separate dates April April and May Banks attempts to argue that the offenses were allied because each involved the same conduct: selling oxycodone to a confidential informant Nevertheless Where the defendant's conduct constitutes two or more offenses of dissimilar import or where his conduct results in two or more offenses of the same or similar kind committed separately or with a separate animus as to each the indictment or information may contain counts for all such offenses and the defendant may be convicted of all of them (Emphasis added) RC (B) Because the three offenses were c nunitted separately Banks was properly convicted of all of them The trial court was not required to conduct a separate hearing because the facts establishing the three separate transactions were already in the record The three separate offenses were proved beyond a reasonable doubt by the State in Banks's jury trial and affirmed by us in Banks I 2013-Ohio-649 For all of the above reasons the first assignment of error is overruled Second Assignment of Error In his second assignment of error Banks asserts that the trial court's Judgment Entry denying his Motion is not a final appealable order because it does not specifically address the issues raised in his Motion If Banks were correct we would not be able to review the trial court's denial of his Motion and his appeal would be dismissed See RC' However the Judgment Entry denying the Motion is a final appealable order As we stated in our discussion of the first -8-

26 'D Case No assignment of error an untimely petition for postconviction relief should be dismissed and no discussion of the merits is required The trial court did not err by denying the Motion the Judgment Entry is a final appealable order and the second assignment of error is overruled Third Assignment of Error In his third assignment of error Banks raises a new argument not asserted in the Motion filed with the trial court and not raised on his direct appeal: he argues that the trial court lacked subject matter jurisdiction to impose a prison term for trafficking without first finding him guilty of possession We need not address this issue "A court of appeals cannot consider the issue for the first time without the trial court having had an opportunity to address the issue" State v d'eagder 76 Ohio St3d NE2d 489 (1996) We do n te however that this claim is barred by res judicata has no merits and would fail as an attempt to file an untimely petition for postconviction relief (See our discussion above analyzing the first assigaurent of error) Consequently the third assignmer_t of error is overruled Conclusion Accordingly for the aforementioned reasons it is the order of this Court that the Judgment Entry of the Court of Common Pleas in Seneca County Ohio be and hereby is affirmed Costs are assessed to Appellant for which judgment is -9-
