1 Held: April 17, 2018 Page 1 of 6 The Village of McConnelsville convened in regular session from 6:00 P.M. to 7:18 P.M. in the McConnelsville Village Council Chambers. Mayor John W. Finley called the meeting to order with the following members and visitors present: Councilman Tom Bragg Councilwoman Crystal Hughes Councilman Terry Robison Councilman Mark Dille Councilwoman Michele Blackburn Councilman Darrell Newton Absent EMPLOYEES: Fiscal Officer Ellen M Hemry and Village Administrator John Thompson VISITORS: Jay Cordray, Amanda McCoy, Auditor Gary Woodward, Shawn Shannon and Brylee Shannon Invocation Invocation given by Mayor John W. Finley. Pledge of Allegiance Lead by Mayor John W. Finley. Excuse Absent Council Member Councilman Robison is on a Squad Run and will be late getting to the meeting. Councilwoman Blackburn made a Motion to excuse Councilman Robison, seconded by Councilman Dille. Councilman Mark Dille, Aye; Councilwoman Michele Blackburn, Aye; Councilman Darrell Newton, Aye. OLD BUSINESS Minutes of April 3, 2018 Councilwoman Blackburn made a Motion to approve the minutes of the previous meeting, seconded by Councilman Newton. Councilman Mark Dille, Aye; Councilwoman Michele Blackburn, Aye; Councilman Darrell Newton, Aye. NEW BUSINESS Bills of the Village Councilman Newton made a Motion to approve the bills, seconded by Councilman Bragg.

Public Participation Amanda McCoy was present representing the Kiwanis Jaycee Park. Ms. McCoy went over the park s finances; their current balanace is $12, They are going to need to install a new hot water heater, change some locks and add/fix security lighting with dusk to dawn lights. Mayor Finley thanked her for her service to the board and noted that Councilwoman Blackburn is the liason for the Park. If they need anything she will be their go to person. Ms. McCoy stated there currently are no by-laws or anything to go by; they are working on getting everything together. Their next meeting will either be on May 2 nd or 3 rd at 5:30 PM at the Park; she will let everyone know once the date is set. Auditor Woodward was here at Council s request. Auditor Woodward passed out paperwork on figures he worked up that might be helpful to council in making their decision. He went over the figures on what could be brought in based on millages and what the cost would be to the homeowner. Councilwoman Blackburn questioned who has cemetery levies on now. Auditor Woodward stated Malta Village and Malta Township have one on together, the same as Marion Township and Village; Bristol, Manchester, and Deerfield townships. Mayor Finley questioned how it worked when a township and village go together. Village Administrator Thompson stated he thinks it goes on ownership. Auditor Woodward stated they have a board set up with a Treasurer and the money goes straight to the cemetery, not through the Villages. Most of these are five year levies. Mayor Finley stated since this cemetery is inside Morgan Township, maybe we could join forces with the township and put a levy on the entire township and not just the village. This could keep the millage down and spread it out over everyone who is using the cemetery, not just the village residents. 6:15 Councilman Robison entered the meeting. Village Administrator Thompson stated he needs to go and talk to the Prosecutor to see if it needs to be legally owned by trustees and village in order to do this and form a joint board. Mayor Finley turned the matter over to the Cemetery Committee. Mayor Finley asked Mr. Shawn Shannon if he needed to discuss anything. Mr. Shannon stated no; they came to visit as his son has Boy Scout project. Mayor John W. Finley Mayor Finley stated he received a request to proclaim September Prostate Cancer Awareness Month.

Councilman Terry Robison, Aye; Councilman Mark Dille, Aye; Councilwoman Michele Mayor Finley signed the Proclamation. (See attached) Ordinance Mayor Finley introduced Ordinance 18-10, AN ORDINANCE FOR THE VILLAGE OF MCCONNELSVILLE TO ACCEPT OWNERSHIP OF THE MCCONNELSVILLE CEMETERY FROM THE MCCONNELSVILLE CEMETERY COMPANY. Councilman Robison made a Motion to pass Ordinance on the second reading, seconded by Councilman Bragg. Councilman Terry Robison, Aye; Councilman Mark Dille, Aye; Councilwoman Michele Ordinance passed on the second reading. Ordinance Mayor Finley introduced Ordinance 18-11, AN ORDINANCE ESTABLISHING EMPLOYMENT POSITIONS; EMPLOYEE COMPENSATION; EMPLOYEE BENEFITS; AND INCREMENT PAY FOR WATER AND SEWER LICENSES AND ESTABLISHING PUBLIC ADMISSION CHARGES AND ESTABLISHING EMPLOYMENT POSITIONS AND RATES OF COMPENSATION FOR EMPLOYEES WITH REGARD TO THE MCCONNELSVILLE SWIMMING POOL AND DECLARING AN EMERGENCY. Council discussed the changes regarding the employee licenses with regards to removing Section 4 - M, N and O. Councilman Dille made a Motion to remove Section 4 M, N and O; suspend the rules requiring three separate and disctinct readings and place on emergency measure, seconded by Councilman Bragg. Councilman Terry Robison, Nay; Councilman Mark Dille, Aye; Councilwoman Michele Councilman Bragg made a Motion to adopt Ordinance on emergency measure with the removal of Section 4 M, N and O, seconded by Councilwoman Blackburn. Councilman Terry Robison, Nay; Councilman Mark Dille, Aye; Councilwoman Michele Ordinance was duly adopted.

4 Held: April 17, 2018 Page 4 of 6 Village Administrator John Thompson Village Administrator Thompson reported the new Waste Water Plant Operator started on April 9 th. Craig VanNess will work with him for a couple or three more weeks until he gets familiar with everything. Councilman Bragg requested he attend the next council meeting so they could meet him. Village Administrator Thompson reported we have begun flushing hydrants and draining the pool. Village Administrator Thompson reported he has discussed the creek bank at the pool with Lise Sibicky from Burgess & Niple. Councilman Newton stated he feels we will have to do something. Village Administrator Thompson reported the Opera House Project is starting; the engineering plans are almost complete and they have come in and taken asbestos samples. We should receive the results in the next few weeks. Village Administrator Thompson reported he met with EPA last Tuesday. He received two letters back from the NPDES Permit inspector; we had violations in a few things; in which, he has addressed. Village Administrator Thompson reported he has to write a long-term control plan extension request, stating why a certain phase was not done, why the project was not completed in the time frame required; and, provide a new schedule as to when the rest of it will be done. Village Administrator Thompson stated he feels it will be another three years, he mentioned five and EPA said no. He will begin applying for grants this fall and if we are not awarded any, we will have to cover the expenses 100% ourselves. Councilman Bragg stated he was told today that when we done the first separation on Fourth Street, we began prior to the EPA requirement; thus making us exempt from being on a timetable. Village Administrator Thompson stated he feels that was a misunderstanding and does not think one had any effect on the other; plus, they allowed us to incorporate it in part of the project. Village Administrator Thompson reported the EPA is requesting us to monitor the outfalls. We cannot physically look at them when the river is up. He has met with Burgess & Niple and we will need to purchase flow meters for the pump station so we can meter the volume if anything goes out. Village Administrator Thompson reported he met with Burgess & Niple about the fixed generators; they have estimated the cost to be around $700,000 to install them. He is checking on portable ones now, which cut the costs in half. Village Administrator Thompson reported he is meeting with the State Highway Department. He just received the call today that there is a slip on Kennebec at the Nursing Home and they want to meet with him as they want to seek some federal funding and it will have to go through a local agency, so he assumes they will need us to apply for it. Village Administrator Thompson reported with the sewer inspections, EPA wants an Operation and Maintenance Collection Program put in place. They sent him a guide to assist in writing it up; the guide they sent is 120 pages, and the program is 520 pages long that tells your employees how to operate and maintain the system. Village Administrator Thompson

5 Held: April 17, 2018 Page 5 of 6 stated he is waiting for a mandate before he does this; he just wants to make Council aware of what is coming in the near future. Village Administrator Thompson reported he is going to be ordering computers; the Sewer Plant computer crashed today, the office computers were purchased back in 2011 and Missy is having problems with hers. He will possibly order them all at the same time and it will be a large expense. Streets & Alley Committee Councilman Dille stated he has already discussed this matter with the Village Administrator; however, he has been receiving questions on Kennebec and how long it is going to be a mess. Councilman Dille reported there is a storm sewer washing out on Beechwood. Economic Development Committee Councilwoman Hughes reported the committee met Saturday and the work on the festival is progressing. Public Utilities Committee Councilwoman Blackburn reported they have been working on the water and sewer ordinance. Some of the proposed changes are the vacant/unoccupied fee for water and sewer, each $12.00 per month with no three percent increase; Section 5-3, $12.00 on that also with no three percent increase; Section 6, the yearly three percent increase is already in effect this year, they are thinking to alternate this increase every other year or so. When speaking with the Solicitor, he said they would have to change the ordinance if they did not want the increase that year. In Section 8, they are looking at changing the sewer and water tap fees to a $1,200 deposit; and if they want to install them or take them out, it would be at a charge of $50 per man hour and $75 per equipment hour plus supplies. Councilman Bragg stated the Village Administrator came to him today and regarding the removal of taps, if someone buys property and tears the building down and does not want the taps removed, they will still be charged the vacant rate; if they remove the taps, they will not be charged a vacant rate; but, they will have to pay to remove the tap and then again to put it back if they ever choose to do so. Councilwoman Blackburn stated they have also discussed due dates, late fees and other penalties. You are given a 45 day notice and they thought we should just have notice by the letter and not do the blue and red tags. Village Administrator Thompson stated you must give a personal notice and the blue tags do this; and, the red tags are only given out when the water is shut off. Mayor Finley stated he would like to see an additional fee charged for the tags. Village Administrator Thompson stated we have had a few issues where the customer comes to the door and states they are going down to pay when we go to shut them off, so the guys do not shut it off. Missy has already added the turn on fee when the tag goes out, so when they come in to pay it is not correct. Village Administrator Thompson stated once the tag is prepared and it goes out, whether or not it is actually shut off they are going to have to pay the turn on fee. Village Administrator Thompson stated he is willing to work with the customers, but they must get with him when they receive the blue tag, not the day they are being shut off.

6 Held: April 17, 2018 Page 6 of 6 Councilwoman Blackburn stated the committee would meet on Tuesday, April 24 th at 6:00 P.M. to go over these additional changes. Finance Committee Mayor Finley stated he has received requests in Court regarding our accepting debit and credit cards. Mayor Finley asked the committee to look into it again. Technology and Website Committee Councilman Robison stated we had some issues with and the website; the problem is corrected and everything is up and running again. Other Business Councilman Bragg stated he would check when the next township meeting is and the committee will go and bring our request to them. Auditor Woodward stated there is a schedule in his office as to when they meet. Councilman Robison stated he is concerned the levy may not pass when you go with two entities jointly. Auditor Woodward stated cemetery levies have always passed. Auditor Woodward questioned if we expand the cemetery, where would it be; just within the Village or more in the township? It was noted that all of McConnelsville is in Morgan Township. Adjournment of Meeting Councilman Robison made a Motion to adjourn, seconded by Councilwoman Hughes.
