6 Georgia Appellate Courts Georgia s appellate courts review both civil and criminal cases from the superior courts in 49 judicial circuits. FY 2002 Annual Report Chief Justice Fletcher Presiding Justice Sears Supreme Court The Supreme Court of Georgia is composed of a Chief Justice, a Presiding Justice, and five Justices. The Supreme Court is one of the busiest appellate courts in the nation because of constitutional requirements and its varied appellate jurisdiction. On June 28, 2001, the Honorable Norman S. Fletcher took the oath of office to become Chief Justice of the Supreme Court. The Honorable Leah Ward Sears took the oath of office as Presiding Justice at the same ceremony. Court of Appeals The court is composed of a Chief Judge, four Presiding Judges, and seven Judges. The appellate courts hosted a reception on February 25, 2002, at the State Judicial Building to celebrate the contributions of African Americans to Georgia s judiciary. The gathering was hosted by Presiding Justice Leah Ward Sears and Justice Robert Benham of the Supreme Court and Judge Jack Ruffin, Judge M. Yvette Miller, and Judge Herbert Phipps of the Court of Appeals. 2

7 Georgia Trial Courts Superior Court Georgia s general jurisdiction trial court. In FY 2002, one new judgeship for the superior courts was approved by the Judicial Council. With authorization from the General Assembly, a new seat was created in the Alcovy Judicial Circuit. Additionally, the General Assembly created the Paulding Judicial Circuit, with two judges, bringing the number of Superior Court judgeships to 189. Georgia s other courts include: State Court limited jurisdiction, hears misdemeanor violations such as traffic cases and civil actions not within superior court jurisdiction; authority to review lower court decisions; In FY 2002, the General Assembly created the Turner County State Court and added state court judgeships in DeKalb, Forsyth, and Henry counties. Juvenile Court Probate Court Magistrate Court Municipal Court exclusive, limited jurisdiction over delinquent and unruly children under the age of 17 and deprived children under age of 18; concurrent jurisdiction with superior courts over certain serious offenses and child welfare matters; exclusive, original jurisdiction for probate of wills, administration of estates, appointment of guardians and involuntary hospitalization of incapacitated adults and other dependent individuals; jurisdiction limited to search and arrest warrants, felony and misdemeanor preliminaries, misdemeanor bad check violations, county ordinances, and civil claims of $15,000 or less; serve incorporated municipalities, jurisdiction includes municipal ordinance violations, criminal warrants, and preliminary hearings. The AOC provides a brochure entitled, Your Guide to the Georgia Courts to all courts. This publication describes the functions, jurisdiction, and appellate routes of each class of court. Your Guide to the Georgia Courts is updated annually. 3

8 Judicial Council/Administrative Office of the Courts David Ratley Named AOC Director The Judicial Council of Georgia voted unanimously to accept the recommendation of Mr. David L. Ratley as director of the Administrative Office of the Courts at its June 13, 2001, meeting at Kiawah Island, South Carolina. A search committee had been working to fill the position formerly held by Mr. George Lange, III. Mr. Ratley assumed his duties in Atlanta on August 16, Mr. Ratley served as the District Court Administrator for the Third Judicial Administrative District since December He is a graduate of Mercer University and holds a Masters in Public Administration from the University of Georgia. Mr. Ratley is also a Fellow of the Institute for Court Management of the National Center for State Courts. Mr. David L. Ratley The new on-line Legislative Tracking System (above) serves as a high-tech complement to the Judicial Legislative Log mailed to judges and interested parties each week during the Legislative Session. Legislative Tracking At the August 29, 2001 Judicial Council meeting, Ms. Debra Nesbit, Administrative Office of the Courts, discussed implementation of the Judicial Council s new Legislative Tracking System. On request, the AOC will develop a Judicial Impact Statement, identifying fiscal impact as well as potential effect on the court system, for designated court-related measures. Bills may be studied at the request of a judge, Council member, or legislator. An Internet-based tracking system was introduced for the 2002 Session of the General Assembly which included daily reports of events at the legislature; a subject matter index of bills carried over from the preceding year; First Reader information; and brief analysis of each bill. (see left) Judicial Council Budget Committee Chief Justice Norman S. Fletcher, Chair of the Judicial Council, named a committee to help prepare the annual judicial branch budget. Budget Committee Chair Presiding Judge J.D. Smith, Court of Appeals of Georgia, explained the purpose of the new committee: 1) making the budget process more inclusive for all classes of courts; 2) developing policies, processes, and deadlines for budget preparation; 3) determining which items properly belong in the judicial budget. 4

9 Justice Issues Facing the Courts Juvenile Justice Child Placement Conference In November 2001, nearly 700 participants attended the second annual Child Placement Conference. The conference was sponsored by Georgia s Child Placement Project, the Department of Family and Children Services, the Department of Juvenile Justice and the Georgia Association of Homes and Services for Children. Guidelines for Deprivation Case Attorneys A set of aspirational guidelines was published in January 2002 based on a workshop sponsored by the Supreme Court of Georgia Child Placement Project and the Georgia Indigent Defense Council (GIDC) Juvenile Advocacy Division in March Chief Justice Norman S. Fletcher noted Attorneys who represent parents of children in deprivation cases have a difficult charge: to defend the civil rights of a parent accused of child abuse or neglect. The authors of this document are to be commended for their efforts to improve the process for child abuse and neglect cases. It is important that their efforts are honored by striving to meet these guidelines. Domestic Violence Domestic Violence Conference The Georgia Commission on Family Violence hosted its ninth annual conference on August 23 & 24 at Callaway Gardens in Pine Mountain: Safety for Women or Children: We Shouldn t Have to Choose. Over 400 participants from various disciplines attended the conference. Mr. David Berns, director of El Paso County Human Services, delivered the keynote speech. Guest speakers included Justice Robert Benham, Supreme Court of Georgia; Judge Duncan Wheale, Augusta Judicial Circuit; and Ms. Cathey Steinberg, Statewide Insurance Advocate. 10 Justice Issues Facing the Courts Technology FY 2002 Annual Report Court Technology Conference CTC7 A strong contingent from Georgia attended the 7th Court Technology Conference on August in Baltimore, MD. The theme of the conference was Witness the Future and provided an opportunity for judges, attorneys, court administrators, and technology specialists from around the world to share information on the latest developments in court-related technology. Attendees from Georgia included judges from the Superior and State Courts as well as the City Court of Atlanta; representatives from the Supreme Court and Court of Appeals; Administrative Office of the Courts; Georgia Courts Automation Commission; judges councils; District Court Administrators; the Institute of Continuing Judicial Education; court clerks; and web design consortium members. Web Design Consortium Valdosta State University and Sandersville Technical College joined the AOC s Web Design Consortium in the Fall of The Web Design Consortium was created in July 2000 to design, enhance, and post websites for the courts and judicial agencies of Georgia. Vince Harris (signing) and other representatives of the AOC join Chief Judge Walter McMillan, Judge Rawlings and others in recognition of the contract awarded to Sandersville Technical Institute. 6

11 Justice Issues Facing the Courts Jury Reform Georgia Jury Summit The Georgia Jury Summit took place in Augusta on May 9-11, The Institute of Continuing Judicial Education and the National Center for State Courts Center for Jury Studies coordinated the program, speakers and panels. The idea for the Georgia Jury Summit was put forward by superior court judges and others who attended the 2001 National Jury Summit in New York. The Georgia meeting was Photo by Jonathan Ernst/Augusta Chronicle funded by the Council of Superior Judge Carlisle Overstreet (standing), Augusta Judicial Circuit, and Judge Lawton Stephens Court Judges. (seated), Western Judicial Circuit, take part in the Jury Summit. An 18-member planning committee was headed by Chief Justice Norman Fletcher, Judge Carlisle Overstreet of Augusta and Mr. Ben Studdard, III, Chair of the State Bar Futures Committee. Many of the reforms discussed by the 146 participants would not require any revisions to court rules or state statutes. Participants voiced solid support for and belief in the jury system; most agreed that initiating minor changes could result in significant improvement of current practices and a better experience for those who serve as jurors. Jury Reform Issues: Balancing the jury box; Elimination of preemptory challenges; Suggested procedures for jury deliberations; Allow discussion of witnesses and testimony among jurors during trial; Allow lawyers to reopen argument to avoid mistrial when the jury is hung. 7

12 Justice Issues Facing the Courts Supreme Court Commissions An examination of Supreme Court Commissions began in September Mr. Robert Tobin, National Center for State Courts, and Dr. Hugh Collins, Louisiana State Court Administrator, consulted with the AOC on the role of existing groups to determine how they might be best organized to benefit the entire court system. Commission on Equality The Supreme Court Commission on Equality created a 39-minute training video entitled, Georgia Bailiffs: Diplomats in a Multicultural Society. The video highlights the role bailiffs play in insuring the perception of justice in our courtrooms. The video is designed for use in training new bailiffs as well in refresher courses for experienced bailiffs. Blue Ribbon Commission Report On May 29, 2001, the Supreme Court of Georgia s Blue Ribbon Commission issued Georgia Courts in the 21st Century. The Commission was created to consider the structure and organization of the courts as they relate to efficiency and effectiveness in the dispensation of justice. While the Blue Ribbon Commission report recommends a variety of ways the judiciary can be improved, the Commission has become convinced that the judicial needs of Georgians are being well served. Although each recommendation of the Commission is submitted in the belief that its implementation will result in the incremental enhancement of our judicial system, the Commission has concluded that there is no need for sweeping revision of the structures and processes of our courts. 8 Georgia Commission on Interpreters in the Courts October 10, 2001, marked the adoption of a set of rules which established a statewide plan for use of foreign language interpreters in the courts of Georgia. The Georgia Commission on Interpreters for Non-English Speakers was created to develop criteria for training and certification of interpreters and to establish standards of conduct, register interpreters, and collect data. The Commission consists of the Chief Justice of the Supreme Court; a judge of the Court of Appeals; judges from the Superior, State, Juvenile, Probate, Magistrate, and Municipal courts; members of the State Bar of Georgia and Georgia General Assembly; and three non-lawyer public members.
