2 Staff report on Basin Health and Public Outreach Event Prepared by Oz Wichman Discussion: Staff is requesting funding in the amount not to exceed $3,000 to sponsor a public outreach event focusing on Hydrographic Basin Health, to be held in Tonopah. Organization and sponsorship of this event will be in cooperation with the Nevada Water Resources Association (NWRA). The Nye County Water District currently has a budget line item in the amount of $8,000 for public outreach and education. This item is budgeted. Background: For many years the Nevada Water Resources Association has sponsored water rights classes which have become the staple of Nevadans who wish to understand Nevada water law. Class subjects have traditionally been centered on filing for water rights, maintenance of water rights permits, the application and permitting process, water rights issues as they relate to the purchasing and selling of real estate in Nevada, review of regulations established for water resource administration in Nevada, information on court cases, chain of title, deeds and language and other water rights related items. These classes have been taught by Hugh Ricci and Michael Buschelman. What is being proposed: The Basin Health outreach concept will be tailored in a similar format as the water rights classes, but more focused on specific basin health as opposed to overall Nevada water issues. The class will be based on basins within a 100 mile radius of Tonopah, primarily in Nye County, which will generally focus on the total amount of water rights on the books in a particular basin, manners of use, economic development and impact to water rights, Orders and Designations issued for a particular basin, factors that may drive value of water rights, Real Property Transfer Tax for standalone water rights transactions and most important, a question and answer session. It is also assumed that time will have to be allocated for basic water rights processes. The class (at the moment) is anticipated to be 4 hours. All class materials will be vetted through the Division of Water Resources and Nevada Water Resources Association. A report titled Water Resources and Basin Summaries was completed for the NCWD in March 2014 which provides the basis for framing basic basin health. This report is attached to this staff report. Why this is being proposed: The reason staff is proposing this outreach item is twofold. 1.) The Nye County Water District has traditionally supported public education for water related issues in Nye County and 2.) The Nevada Water Resources Association is a not for profit organization which provides education,

3 training, and networking opportunities for understanding, developing, conserving and protecting Nevada's water resources. Oz Wichman proposed the subject cooperative outreach effort to the NWRA Board of Directors and has received authorization to pursue this pilot project. Who will teach the class: At this time it appears the class will be taught by Hugh Ricci, Jay Dixon and Oz Wichman. Below is some information about the instructors. Hugh Ricci, P.E., President, Ricci Engineering, Ltd., Nevada State Engineer, Retired Prior to being appointed as the Nevada State Engineer in 2000, Hugh served as the Deputy State Engineer for approximately 10 years. Mr. Ricci has over 25 years experience in the field of water resources and water rights with the Division of Water Resources and is a Registered Professional Engineer in the State of Nevada. Hugh is a member of NWRA, serves on its Board of Directors and as stated previously in this report, currently teaches the water rights classes for NWRA. Jay Dixon, P.E., W.R.S., former member of the Nye County WDGB is currently the Principal Hydrologist and Permitting Engineer for Kinross Gold Corporation, where he is responsible for the design, management and implementation of various water projects. Jay's professional career spans over 17 years focusing on development, management and protection of water resources. Jay is actively involved in educating the public on topics such as Well Design and Construction and issues related to domestic wells throughout Nevada. In the late 90s, Jay worked for Bechtel Nevada where he was involved in groundwater research and deep well drilling oversight at the Nevada Test Site to help characterize groundwater contamination from Cold War Era underground nuclear weapons testing. Jay also provides consulting services for public and private sector water rights and water projects and is a member of NWRA and serves on its Board of Directors. Oz Wichman, Nye County Water District contract staff, worked for Round Mountain Gold in Technical Services for 15 years, for the Nye County Public Works Department for 11 years in Technical Services where he managed water rights and a variety of water and wastewater projects, has worked under contract to the NCWD for over 3 years and is a member of NWRA and serves on its Board of Directors. Where: This class will focus on Hydrographic Basins in some 100 mile radius of Tonopah and will be held at the Convention Center in Tonopah. The Town of Tonopah traditionally has not charged a fee for the use of the Convention center for public education efforts. This was verified through Town Manager Eason.

4 When: To be determined, but generally before next spring when the agriculture community starts getting busy with springtime farming/ranching work. How Much: Staff is requesting an amount not to exceed $3,000 from the NCWD to pay for the expenses. Instructors will volunteer their time for the day of the class. A portion of the expenses will be allocated for travel and hotel rooms, for Tina Triplett, Executive Director of NWRA to provide basic organizational services such as copying class materials, marketing, event registration, event setup and other like items (to be determined). It is anticipated a registration fee of less than $50 per person will be charged with the proceeds going to NWRA. It is unknown at this time how many people may attend. Summary: This event provides something of a pilot outreach project for the NCWD and NWRA. Outreach events are unpredictable. For example; in 2012 the NCWD and NWRA hosted a 3 day event in Pahrump. The event centered on domestic well maintenance, well construction, Pahrump basin health, water rights classes and like water related items. Some of the sessions were well attended and some did not seem to generate much interest. Likewise; NWRA is continuously adjusting class material based upon feedback from attendees at the annual conference. Staff acknowledges that there is never a guarantee how a given outreach event will be received in a community and moreover, by the individual. Simply stated, this outreach material is an important subject, useful to those interested in local water related issues and has the potential to shine some light into the black box we call water rights to the benefit of the public and local government. In addition, Staff acknowledges that we have not provided accounting for expenditures. Given the relatively modest amount requested, Staff feels that before we invest time in the project, some sense of the WDGB desire to support -or- reject the project may be the most useful, with a simple not to exceed amount requested. It is anticipated that time will be invested by NCWD staff in preparing class material, advertisement, copying and other like activities which will be an expense to the District as normal budgeted staff time. How this will be coordinated with NWRA will be organized as we get further into preparing for the event. Staff will provide updates to the WDGB should you approve the expenditure. 6 INTRODUCTION This report is intended to assist with determining whether there are sufficient available water resources to support existing business, industry, existing population and growth trends; where (and if) ground water monitoring should be established or increased; and to provide some sense of basin health for the 44 hydrographic basins that lie in whole or in part within Nye County. When reviewing this material it must be acknowledged that speculation in the arena of water rights plays a large role in attempting to determine whether water resources are in fact available. In order to establish some sense of basin health it is necessary to examine and understand several basic factors in the individual basins such as: 1.) Available water resources. 2.) Orders the State Engineer has issued. 3.) Rulings the State Engineer has issued. 4.) The published Perennial Yield. 5.) Total existing appropriations. 6.) Total pending applications that if approved would contribute to increased ground water withdrawal. 7.) Other factors, such as the filings by the Southern Nevada Water Authority, the Las Vegas Valley Water District, the Lincoln County Water District, Vidler Water Company and others, which place the available water resources into legal gridlock for the foreseeable future. A companion spreadsheet was developed together with the following basic summaries for each of the 44 basins that lie in whole, or in part, within Nye County. To simplify a fairly complex issue, the basin summaries are short and to the point. RESOURCES The information resources used to compile this report consisted of interviews with the Water Resource Specialists at the DWR, information contained within the DWR website, recorded documents at the DWR and the Nye County Recorders Office. There are also several basins with no designation status at this time but review of the rulings reveals that new applications for significant quantities of water are being denied. Review of the basin Orders, the basin Rulings and the basin summaries is necessary to determine if there are available water resources for new appropriations. For your reference the link to the DWR Orders Search is Rulings in the basin also must be considered. Simply enter the basin number (such as number 122) and all the orders list out for printing or download. As a side note: Basins and portions of Basins that fall within the NNSS (the Nevada National Security Site, DOE) and the NTTR (the Nevada Test and Training Range, USAF) are restricted areas. The DWR generally denies the applications for lack of access to place the water to beneficial use. I include these basins for reference in the spirit of providing a complete list of the basins within Nye County. Portions of any Basin(s) outside the NNSS or NTTR boundaries are handled by the DWR as valid, accessible water. See ruling 5644 for review of DWR language denying applications for lack of access to NNSS and NTTR lands.
