DISCUSSION This item serves as a report on the implementation of the SGMA efforts underway in six high and medium priority groundwater basins 1. On January 4, 2019, the California Department of Water Resources (DWR) published the final 2018 SGMA Basin Prioritization for the basins not affected by the 2018 Basin Boundary Modification requests. DWR anticipates releasing the draft prioritization for basins with modified boundaries in spring 2019, which may affect priorities and designations for Santa Maria Valley, Paso Robles and Los Osos Valley basins, located in whole or in part in San Luis Obispo 1 As of March 1, 2019, the California Department of Water Resources (DWR) identifies the priorities and designations for the following local basins: San Luis Obispo Valley (high), Santa Maria Valley (high), Paso Robles (high and critical conditions of overdraft), Atascadero (very low), Cuyama Valley (high and critical conditions of overdraft), and Los Osos Valley (high and critical conditions of overdraft. 3 County including: San Luis Obispo Valley, Santa Maria Valley, Paso Robles, Atascadero, Cuyama Valley, and Los Osos Valley Basins (Attachment 1). SGMA s next critical deadline is for each Groundwater Sustainability Agency (GSA) within the priority basins to develop and adopt a GSP by January 31, 2020 or Given that the County is either the GSA or a member of a GSA in all six basins, it is critical to keep the Board informed of the progress within each basin to develop a GSP. Staff anticipates providing SGMA Program updates through: Bimonthly Report Consent Items: Items will provide a programmatic budget status update (Exhibit A ) and a status report of SGMA compliance efforts within each basin (Exhibit B ), and as needed, will request that the Board take specific action(s) in the basins. Periodic Board Business Items: Separate from the bimonthly reports, staff will bring key policy related items to the Board to facilitate expanded discussion and to seek Board direction (see description under Future Board Engagement ). Ongoing Basin Updates Exhibit A summarizes the County s SGMA Program FY budget and costs to date. The County s SGMA Program provides for County involvement in all six basins; however, there is no one size fits all solution for the basins and each GSP development and basin user engagement process largely occurs at the community or basin scale. Exhibit B provides a status report on progress within each basin related to SGMA compliance. Each basin status report includes: 1. Highlights to the Board on key milestones and activities; 2. A summary of how the public can engage in GSP development processes; and 3. A map of the basin s GSAs. The current status report covers SGMA Program activities from January 1, 2019 through March 8, Basin users and interested stakeholders are encouraged to engage in and provide input during the basin processes described in Exhibit B, particularly during basin specific events (i.e. GSA Board meetings, advisory committee meetings, and public workshops), to help shape draft GSP sections as they are developed. For example, the Paso Basin Cooperative Committee (PBCC) and individual GSAs have held several public workshops regarding sustainable management criteria, including where to set ideal and acceptable groundwater levels in the Paso Basin. The GSP Consultant will use input received during these workshops and upcoming meetings to draft related GSP sections. Basin users and stakeholders are also encouraged to provide comments on draft GSP sections along the way. On February 11, 2019 DWR released the final publication of the 2018 Basin Boundary Modifications, which included approving the removal of a minor part along the western external boundary of the Paso Basin. The removed basin area underlies Heritage Ranch Community Services District (HRCSD) and will no longer be subject to the requirements of SGMA. 2 Pursuant to Water Code (a), high or medium priority basins subject to critical conditions of overdraft shall adopt a GSP by January 31, All other high and medium priority basins shall adopt a GSP by January 31, where there is more than one GSA, the GSAs may jointly adopt a single GSP or separate coordinated GSPs. 4 Consequently, HRCSD submitted a corresponding notice dated January 18, 2019 for the withdrawal from the Memorandum of Agreement regarding the preparation of a GSP for the Paso Robles Groundwater Basin (Attachment 4). As a result, a redistribution will be required of HRCSD's former 1% cost obligation with respect to the consultant contract entered into between the City of Paso Robles and Montgomery & Associates (formerly HydroMetrics WRI) for the purpose of developing a GSP for the Paso Robles Subbasin. The redistribution will be shared on a pro rata basis between the remaining GSAs in the Paso Basin. It is anticipated that the County's cost share of HRCSD's remaining GSP Development Budget will be in the amount of $2,158, and already in the approved FY Budget (County's SGMA Program FY ). Recommended Actions It is recommended that the Board receive and file the report on implementation of SGMA efforts in the six basins. This includes receiving status updates on each basin s draft GSP sections available for public review as they become available. It is also recommended that the Board authorize the Department to pay invoices that reflect an additional cost allocation resulting from the redistribution of HRCSD's former 1% cost obligation provided that all of the other remaining parties similarly agree. Future Board Engagement Individual Board members represent the County on SGMA basin management boards or committees (e.g. PBCC). However, staff anticipates various topics relating to establishing sustainable management criteria and basin thresholds, as well as subsequent management actions that would be needed to achieve those, may benefit from full Board consideration and policy direction. Once a GSP is fully developed, it will be brought to the Board, acting as the GSA for the basin or a portion of the basin for final consideration and adoption. In the basins where the County is not a GSA (i.e., separate agencies were formed under SGMA), formal adoption of the GSP by the Board is not required. However, staff may return to the Board to provide an opportunity for the Board to provide guidance to the Board member that has been appointed as the County representative on the GSA s governing body. In addition, it is possible that the County will be asked to utilize its land use or well construction permitting authorities in coordination with any of the GSPs, which may necessitate further coordinated actions between the GSAs and the County. To prepare for this possibility, staff anticipates returning to the Board in mid-2019 to discuss the potential points of coordination and recommended policies. Exhibit B delineates each basin s anticipated GSP adoption schedule. OTHER AGENCY INVOLVEMENT/IMPACT Implementation of SGMA involves GSAs, local public agencies and water companies, and basin users/landowners concerned with the management of groundwater. Although SGMA specifies that local public agencies, mutual water companies and water corporations regulated by the Public Utilities Commission are the eligible GSA participants; stakeholder outreach requirements, coordination requirements, and the practical realities of preparing a GSP require the involvement of the entire community. Exhibit B includes the governance structure and public engagement processes in each basin. Page 4 of 5

5 In addition to local efforts, the DWR acts as the agency in charge of developing regulations, reviewing GSAs and GSPs, and providing technical assistance to GSAs. The State Water Resources Control Board acts as the agency in charge of enforcement, in situations of non-compliance specified in SGMA. FINANCIAL CONSIDERATIONS The costs associated with GSP development, GSA/committee processes, and engagement with groundwater users/stakeholders are included in the County s FY Budget. Staff time associated with these efforts is largely included in the Flood Control District FY Budget. Exhibit A presents a budget status update for the County s SGMA Program. The County s proportionate share (approx. $2,158) of the additional costs related to the redistribution of costs for HRCSD s remaining portion of the contract between the City of Paso Robles and Montgomery & Associates, is included in the FY FC budget. In Section 9 of the MOA, it directs the reapportioning of costs between each remaining Party, when one member of the MOA withdraws. RESULTS This SGMA progress update provides information and transparency related to SGMA compliance efforts to both the Board and the public, and thereby contributes to a well-governed community. Martin Governance Background: On June 6, 2017, the Santa Barbara County Water Agency, County of San Luis Obispo (County), County of Kern, County of Ventura, Cuyama Community Services District and Cuyama Basin Water District executed a Joint Exercise of Powers Agreement (Agreement) to form a single GSA over the entire Cuyama Basin. The Agreement creates the Cuyama Basin GSA as a Joint Powers Agency (JPA), which is a public entity that is legally separate from the parties to the Agreement. The JPA s purpose is comply with SGMA regulations by serving as the GSA, developing, adopting and implementing a GSP, and sustainably managing the Cuyama Basin. The Agreement provides that the JPA shall be governed by a Board of Directors (GSA Board) comprised of representatives from each of the six members and serving as the decision-making body for the Cuyama Basin. Each Draft Chapter is publicly vetted at the SAC and GSA Board meetings. Upon GSA Board approval of the Draft Final Chapter, its content is compiled into a draft GSP. 15 SALINAS VALLEY GROUNDWATER BASIN - PASO ROBLES AREA SUBBASIN (Basin No ) GSP Deadline: 1/31/2020 BACKGROUND & HOW TO ENGAGE IN GSP DEVELOPMENT County's Board Representation County's Basin Contact Basin Website(s) Supervisor Peschong (Member); Supervisor Arnold (Alternate Member) Angela Ruberto (aruberto@co.slo.ca.us) Governance Background: On May 16, 2017, the County Board of Supervisors formed the Paso Basin County of San Luis Obispo GSA joining four other local public agencies that formed GSAs, collectively covering the entire Paso Basin. On August 22, 2017 the Board, acting as the Paso Basin County of San Luis Obispo GSA, executed a Memorandum of Agreement (MOA) regarding preparation of a GSP for the Paso Robles Groundwater Basin and forming the Paso Basin Cooperative Committee (Committee). The MOA was entered into by the five local agencies in San Luis Obispo County that formed GSAs (i.e., City of Paso Robles, San Miguel Community Services District, Heritage Ranch Community Services District, County of San Luis Obispo and Shandon-San Juan Water District) for the purpose of developing a single GSP over the portion of the Paso Basin within the San Luis Obispo County. On February 11, 2019 DWR released the Final 2018 Basin Boundary Modifications approving two revisions to the Basin Boundary. One revision makes the northern Boundary of the Paso Basin coincident with the Monterey and San Luis Obispo County line, placing the Paso Basin entirely within San Luis Obispo County and making formal coordination with Monterey County optional. The other revision removes the basin area underlying Heritage Ranch Community Services District GSA, making them no longer subject to SGMA or required to develop a GSP. Heritage Ranch Community Services District notified the (four) remaining GSAs of their withdrawal from the MOA and, at their March 6, 2019 meeting, the Paso Basin Cooperative Committee directed staff to come back with an item addressing the impact to the remaining GSAs. It is anticipated that at their next regular meeting (April 24, 2019) the Paso Basin Cooperative Committee will determine that it is necessary to allocate Heritage Ranch Community Services District s former 1% cost obligation with respect to the consultant contract entered into between the City of Paso Robles and Montgomery & Associates (Formerly HydroMetrics WRI) for the purpose of developing a Groundwater Sustainability Plan for the Paso Robles Subbasin to the remaining parties on a pro rata basis. Provided that all of the other remaining parties similarly agree to fund Heritage Ranch Community Services District s former 1% cost obligation, the County cost resulting from this re-distribution is anticipated to be $2, and within the approved budget. As noted in prior BOS updates, the Los Osos Area subbasin that underlies the adjudicated plan area is not subjected to SGMA so long as certain actions are taken. February 11, 2019 DWR released Final 2018 Basin Boundary Modifications (BBM). Below are DWR s final decisions related to the BBM for the Santa Maria Basin: o DWR approved: Designation of Arroyo Grande Creek Valley Subbasin (Arroyo Grande Subbasin) Removal of Pismo Creek Valley, Nipomo Valley, and Southern Bluffs Fringe Areas o DWR denied: Removal of Ziegler Canyon Fringe Area Spring 2019 Pending DWR s final basin re-prioritization processes in Spring 2019, the newly established Arroyo Grande Subbasin and remaining Ziegler Canyon Fringe Area may or may not be subject to SGMA requirements. Pending these final results, the State will designate what areas are subject to SGMA requirements including the Arroyo Grande Subbasin. The County accepted State grant funding, which regardless of the outcome of re-prioritization processes (i.e. even if priority is low or very low and does not mandate SGMA compliance) requires that the County and partners develop a GSP. Consequently, County will be able to leverage the GSP studies to better understand the hydrology including interactions between surface water and groundwater and environmental needs in the Arroyo Grande Creek watershed, which is the primary source of water in Lopez Lake. The GSP work will also help to develop a Habitat Conservation Plan (HCP) and promote sustainable management of both surface water and groundwater including flood control, which are all so vital to the farmers and municipalities in this watershed. Therefore, the following highlights are placeholders for future updates to the County Board, once areas subject to SGMA requirements are known and once the GSP Development processes have begun. On May 16, 2017, the County Board formed the Santa Maria Basin Fringe Areas County of San Luis Obispo Groundwater Sustainability Agency (County GSA) to serve as the GSA for the fringe areas located within San Luis Obispo County, with the exception of those fringe areas located within the City of Arroyo Grande. Due to recent release of DWR s Final 2018 BBMs that established the Arroyo Grande Subbasin and removed several fringe areas from the Santa Maria Basin and pending on final basin re-prioritization, staff will return to the Board at a later time to recommend changes to the areas covered by the County GSA. The Santa Barbara County Water Agency is the GSA for the fringe areas located within the County of Santa Barbara. Thus, the County GSA, the City of Arroyo Grande and the Santa Barbara County Water Agency collectively cover the Santa Maria Basin fringe areas for SGMA compliance. Please consider this as notice that the HRCSD is hereby withdrawing from the MOA pursuant to Section 9.
