FOR THE PURCHASE OF THE OFFICER SAFETY PLAN PACKAGE OF BODY-WORN CAMERAS AND VEHICLE DASH-MOUNTED CAMERAS WITH ASSOCIATED EQUIPMENT/ STORAGE AND CONDUCTIVE ELECTRONIC WEAPONS FOR ALL OFFICERS AND FLEET VEHICLES FOR A PERIOD OF FIVE AND A HALF YEARS DISCUSSION: The Vacaville Police Department began using Body-Worn Cameras (BWCs) department-wide for all officers in Since that time, staff has implemented 3 different BWC systems with various camera models due to issues with equipment durability, quality and performance. Early models were not reliable due to technical deficiencies in an emerging market. These performance issues resulted in staff having to research, test and procure a new BWC vendor approximately every 2-3 years. In 2017, staff began researching and testing professional grade BWC systems as existing cameras began to fail. Staff recognized the value and importance of video footage captured by police officers, which has shielded the City of Vacaville from costly legal liabilities and complaints of misconduct. While often portrayed as a means of transparency to the public, BWCs are also a vital investigative and prosecutorial tool paramount in today s policing environment. Recent events involving the use of force between law enforcement and citizens, both regionally and across the country, have demonstrated the importance of deploying professional grade cameras and video-recording equipment. The Vacaville Police Department issued Conducted Electrical Weapons (CEW) to all of its officers for the last 15 years as a less lethal tool with great success in reducing injuries to citizens and officers. The current CEW vendor for Vacaville is Axon Enterprise, Inc. (formerly Taser). The device is equipped with a small infrared video camera attached to it that records when an officer activates the CEW, capturing the encounter for future review. Additionally, the Vacaville Police Department has deployed factory-designed dash-mounted in-car cameras in 2 vehicles assigned to the Traffic Section. Seeing the value of these recordings, several officers assigned to the Patrol Division have used after-market mounting devices to enable them to utilize their assigned BWC as a dashboard camera when inside their vehicles. In many instances over the last 8 years, the video footage recorded by these cameras has captured the imminent threat that occurred in officer-citizen encounters. Staff previously evaluated and determined the need for fully outfitting all patrol vehicles with cameras. The proposed Axon in-car dash-mounted camera system will provide officers the ability to record what is in front of their patrol vehicle, while a second camera faces the back-seat prisoner transport area to record the behavior of any person(s) in that space. These additional cameras would significantly improve our ability to capture vital video evidence in the course of police encounters during traffic stops.

2 Axon also created a secure cloud-based storage platform for the video captured by their camera systems called Evidence.com. Currently, in Solano County, the Vallejo Police Department, Fairfield Police Department, and the Solano County District Attorney s Office utilize Evidence.com as a means of providing crucial video evidence in criminal court proceedings. The secure cloudbased platform allows deputy district attorneys, with proper permissions, to view digital video evidence through a portal maintained by Axon through Evidence.com as part of the digital evidence discovery process. Axon has become an industry leader with its BWCs and in-car dash camera systems in addition to its well-known Taser CEW devices. The amount of video coverage provided by Axon s BWC system, the in-car camera system (2 cameras per vehicle), and the infrared camera located on the Axon Taser model X-2, would provide Vacaville far more video evidence than ever before, and the ability to have one vendor for all 4 platforms. This will allow for reliable and consistent service and response to any equipment issues and replacement needs. On October 1, 2017, the Vacaville Police Department began a 1-year free trial of the Axon BWCs with great success. The Axon BWCs have a superior battery life and greater storage capabilities, thus enabling officers to record and store far more video than the previous technology afforded. In addition, the time it takes officers to upload the video they have recorded into Evidence.com is half of what was required to upload video from previous BWC vendors, thereby allowing the officers to spend less time away from their patrol duties while uploading data. Not included in the trial is the in-car camera equipment. Axon has a full-service program called the Officer Safety Plan, which bundles together the BWC system, in-car camera system, CEW system, and Evidence.com, for 5.5 years at a discounted cost (see Attachment 1). In addition, agencies who purchase the Officer Safety Plan will have their equipment, all cameras, and all CEWs, replaced with new devices at roughly the 30-month and 60- month intervals, a typical lifecycle as equipment begins to age. This plan through Axon also includes a warranty on all equipment should any device stop working due to normal operational use. Axon is also fully responsible to support and maintain the infrastructure of Evidence.com and the unlimited amount of data storage the department would utilize as part of the plan. Axon is the only known entity that manufactures and distributes these integrated systems of bodyworn cameras, in-car cameras, conducted electronic weapons, and the secure storage provided by Evidence.com. No other vendor offers the same or similar products with the Evidence.com storage platform. The Solano County District Attorney s Office has access to the Evidence.com discovery portal and has no other cloud-based digital evidence capabilities, thereby justifying the sole source nature of these products. In addition, Axon Enterprise, Inc. would incur all costs related to the cloud-based storage maintenance, allowing City of Vacaville IT staff to focus on other city needs. The alternative course of action would be to continue to research, test and purchase each piece of equipment individually, with anticipated replacement of the BWCs and in-car cameras approximately every 2 years, the CEWs every 3 years, and the purchase of network servers to accommodate the additional data captured by the cameras, as needed. Staff estimates the costs of this alternative course of action at $1,242,000 over the next 5.5 years, approximately $54,000 more than the total cost of the Axon contract over that same period. Staff time required for the procurement process for the alternative course of action was not factored into the cost estimate.

3 FISCAL IMPACT: The total cost of the Officer Safety Plan over the 5.5 year term of the services and purchasing agreement is $1,187,432. The first year of the agreement, due to the initial capital investment of hardware and installation, will be $241,316. The funding for the first year of the agreement would be accomplished primarily through a combination of Traffic Impound and Supplemental Law Enforcement Services Fund (SLESF), also known as Citizens Option for Public Safety (COPS), funds. The use of the City s Information Technology Internal Service Fund (ISF) will be used for specific items related to hardware and network devices. The remaining 4.5 years of the contract will be paid through a combination of funding sources to include Traffic Impound and SLESF/ COPS funds. There is the potential of impacting the General Fund in subsequent years if alternative funding sources are not renewed at anticipated levels. In previous years, these alternative fund accounts have provided funding levels that would pay for this contract. However, these discretionary funds have previously been used to purchase equipment or provide training and services, thereby offsetting General Fund expenses. Allocating future alternative funding and/or reduced funding levels could impact the General Fund (see Attachment 3). RECOMMENDATION: By simple motion, adopt the subject resolution. 4 RESOLUTION NO RESOLUTION OF THE CITY COUNCIL OF THE CITY OF VACAVILLE AUTHORIZING THE CHIEF OF POLICE TO ENTER INTO A SOLE SOURCE AGREEMENT WITH AXON ENTERPRISE, INC. FOR THE PURCHASE OF THE OFFICER SAFETY PLAN PACKAGE OF BODY-WORN CAMERAS AND VEHICLE DASH-MOUNTED CAMERAS WITH ASSOCIATED EQUIPMENT/STORAGE AND CONDUCTIVE ELECTRONIC WEAPONS FOR ALL OFFICERS AND FLEET VEHICLES FOR A PERIOD OF FIVE AND A HALF YEARS WHEREAS, the current political and social climate has created an expectation that interactions between law enforcement and members of the public are captured in order to validate or disprove complaints of misconduct; and WHEREAS, Axon s camera products enable officers to record and store greater amounts of video footage than previous camera trials; and WHEREAS, Axon s Officer Safety Plan allows the Department to bundle four camera platforms under a single vendor, which reduces costs across all platforms and staff time required to research, implement and replace devices at the required intervals; and WHEREAS, Axon is the only known entity that manufactures and distributes these integrated systems of body-worn cameras, in-car cameras, conducted electronic weapons and the secure storage provided by Evidence.com; and WHEREAS, the alternative to entering into a sole source agreement is for the department to administer multiple platforms individually at a higher cost that would also require a greater amount of staff time to manage. NOW, THEREFORE, BE IT RESOLVED that the City Council of the City of Vacaville does hereby authorize the Chief of Police to enter into a sole source agreement with Axon Enterprise, Inc. in the amount of $1,187,432 over a period of five years.
