APPROVAL OF THE MINUTES A motion was made to approve the minutes from the August 4, 2016 meeting with the noted correction. SOUTHLAKE BOULEVARD, SOUTHLAKE, TX. Patty Moos, Planner I, presented MSP Applicant Wayne Rhodes, 311 Woodland Lane, Williamson, SC came forward. 2 The Commission discussed the changes presented. Commissioner Springer stated he does not like the attached drive-thru signs on the building. The Commission agreed the small directional signs look more proportional with the proposed 2-inch masonry frame. A motion was made to approve MSP16-004, subject to the staff report dated August 12, 2016; noting that directional sign J be denied (the two attached drive-thru signs); to reduce and scale the rendering for directional sign H ; and approving the 2-inch masonry frame on the small directional signs H and I. The Commission discussed the proposed sign package and how it relates to what was previously permitted for Forest Park Medical Center. A motion was made to approve MSP16-006, subject to the staff report dated August 12, 2016 and as presented. SOUTHLAKE BLVD., SOUTHLAKE, TX. 3 stated the reason for his request. The Commission discussed possible visibility issues. Commissioner Greer requested the applicant provide a better rendering depiction of the proposed sign with detailed description of materials; possibly provide a materials sample board and photos of other locations. A motion was made to approve SV16-011, specifically noting the applicant s agreement to substantially modify and revise the current drawings for the sign to add detail to include the type of stone proposed and provide a true rendering of the proposed sign structure. Motion: Greer Second: Springer Ayes: Springer, Kubiak, Greer and Smietana Nays: None Abstain: None Approved: SV16-012, VARIANCE TO SIGN ORDINANCE NO. 704, AS AMENDED, FOR UTOPIA FOOD & FITNESS LOCATED AT 2777 E. SOUTHLAKE BLVD., SUITE 130, SOUTHLAKE, TX. Patty Moos, Planner I, presented SV Dennis Killough, Deputy Director, stated amendments currently in process with the general Sign Ordinance. Applicant Kirk Wilder, 5395 Golfside Drive, Frisco, Tx came forward to discuss their move to Southlake and the proposed sign. He showed the Commission the current business sign at their Plano location. He also showed a photo depicting the view of their Southlake lease space from FM The Commission discussed the sign options presented. They recommended the applicant drop the variance request for placement of the sign and stated they preferred the 80 square foot sign option. Discussion regarding the Sign Ordinance changes in process continued and it was recommended the applicant work with staff in getting some of the new requirements implemented. A motion was made to approve SV16-012, subject to the staff report dated August 12, 2016; granting the 80 square foot sign option; denying the placement variance; and, noting the applicant s willingness to look at options to meet potential ordinance changes. Milton St., Austin, Tx came forward and discussed his proposed sign and the word mark used. The Commission discussed the proposed sign. They requested the applicant come back with comparison renderings; stated distance from façade in exhibits presented; and, examples of adjacent signage. The applicant agreed to provide the recommended items and requested to table their case. The Pretty Kitty) 1161 East Southlake Boulevard, Suite 270 Southlake, TX July 18, 2016 Planning & Development Committee 1400 Main Street Southlake, TX RE: The Pretty Kitty Sign Variance Dear Committee, In addition to our official application, detailed rendering, and letter of endorsement from our landlord, I would like to present the following information to provide a little more color on our signage and rationale: 1. Our signage contains only two letters that are above the stated regulations of 18 inches, each of which are only 4 ¾ inches above this regulation. 2. Our sign will hang from a height of 20+ feet, in cursive, and if our P and K were 18 inches, the proportionate sizing of the remainder of our letters would be 12 inches, making our sign, in cursive, difficult to read. 85% of our customers find us via walkby/drive-by. 3. The existing signs throughout the center that have received variances for letters above 18 inches height all look proportional and tasteful and ours would be the same. 4. The Juice Bar, our neighbor to our left, has a 24 inch J in their sign, 1 ¼ inches larger than our two letters at 22 ¾ inches, and they have frontage of 14 feet while we have frontage of over 24 ft. 5. Our store is relatively isolated meaning these two letters that are 4 ¾ inches over 18 inches will have no overcrowding impact on our row. We have 18 feet separating us from Mod Market entrance to our right, and to our left we have riser room which is 14 feet of frontage that separates us from Juice Bar. We opened for business on Memorial Day and our sign was fabricated long ago and is in storage waiting to be installed. 22 Department of Planning & Development Services S T A F F R E P O R T September 2, 2016 CASE NO: PROJECT: EXECUTIVE SUMMARY: REQUEST DETAILS: SV Sign Variance for The Pretty Kitty The Pretty Kitty is requesting approval of a variance to the Master Sign Plan for Park Village and Sign Ordinance No. 704, as amended, for The Pretty Kitty to allow an attached building sign that exceeds maximum letter and logo height. The sign/building is located at 1161 E. Southlake Blvd., Suite 270, Southlake, Texas. The subject lease space is located in Park Village next door to the Modmarket. The lease space is located in the Village and has frontage to the internal driveway which allows for a maximum letter height of 18 inches. The maximum logo height is calculated as 125% of the maximum allowed letter height which results in 22 ½ inches. The P, K and y (with an accentuated tail) all exceed maximum letter height and the logo exceeds maximum logo height. Below is a summary of the discussion at the Sign Board meeting August 18, 2016 and the applicant s response. The application was tabled to the September 8, 2016 Sign Board meeting. Sign Board Recommendation The Sign Board requested the applicant come back with comparison renderings; stated distance from façade in exhibits presented; and, examples of adjacent signage. Applicant s Response The applicant has provided photos of adjacent signs at multiple distances. An exhibit of a compliant sized sign outline has been submitted. The applicant has stated they are not proposing an alternate size. Southlake Blvd., Suite 270 LEGAL DESCRIPTION: CURRENT ZONING: HISTORY: Lot 1, Block 1, Park Village S-P-1 Detailed Site Plan District The following sign variances have been approved in Park Village: August 19, 2014; City Council approved the Master Sign Plan for Park Village. (MSP14-002) April 21, 2015; City Council approved a request for an amendment to the Master Sign Plan for Park Village to reduce the size of the Park Village Tower Feature. (MSP15-001) June 16, 2015; City Council approved a sign variance request for Modmarket to allow for attached fascia signs to exceed maximum sign area, letter and logo height; to include a cabinet tagline sign; and, to allow the logo to be duel lit (halo and internally illuminated). (SV15-004) November 3, 2015; City Council approved sign variance requests for Gloria s Latin Cuisine to allow signage with unique illumination and tag line. (SV15-007) January 19, 2016; City Council approved sign variance request for The Juice Bar noting a 24 J and all other letters not to exceed 18. (SV15-010) SIGN BOARD: August 18, 2016; Approved to Table (4-0) to September 8, STAFF COMMENTS: The sign application exhibits are linked to this report. Variance Criteria: a. Variance Authorized. The City Council may authorize variances to any restriction set forth in this ordinance, including but not limited to the number, type, area, height, or setback of signs, or any other aspect involved in the sign permitting process. b. Approval Standards. In granting any variance, City Council shall consider the following criteria: (i) (ii) Special conditions exist which are peculiar to the land, structure or building involved and are not applicable to other lands, buildings or structures in the same zone. The City may attach such conditions to granting all or a portion of any variance necessary to achieve the purpose of this ordinance, and; The strict interpretation of the provisions of the ordinance would deprive the applicant of rights commonly enjoyed by other properties in the same zone under the terms of the ordinance, and; Case No. Attachment A SV Page 1

25 (iii) (iv) (v) (vi) (vii) The special conditions and circumstances do not result from the actions of the applicant and such conditions and circumstances do not merely constitute pecuniary hardship or inconveniences, and; Granting the variance will meet the objectives of the ordinance and not be injurious to the adjoining property owners or otherwise detrimental to the public welfare, and; The request will be the minimum variance necessary to alleviate the special hardship or practical difficulties faced by the applicant in meeting the requirements of this ordinance; and; Granting of the variance will be in harmony with the spirit and purpose of this sign ordinance. Granting of a variance shall be specific to the subject sign(s). Any modification of the signage approved by the variance or the installation of new or replacement signage that does not meet the specific requirements of the City Council variance approval is prohibited and will be deemed non-compliant. c. Application Process. Any request for a variance shall be made to the Administrative Official and be accompanied by a completed application and a non-refundable filing fee in the amount specified in the current fee schedule adopted by City Council. The sign variance will be considered by the City Council following a recommendation by the Sign Board. The Sign Board s recommendation will be forwarded to the City Council for their consideration. 44 Demonstration 1. With the back side of our space parallel to Carrol Avenue, we feel we are missing a critical opportunity to advertise our location to this busy road. We feel signage facing Carroll Ave. would greatly increase our visibility and the public s awareness of our presence in this location. Being a new concept to Texas, and choosing Southlake as our first location, the success of this location is critical to further growth throughout the state. This signage will be a great benefit to help this particular location succeed. 2. As we are happy with our signage exposure on the front and side elevations, these elevations do not directly face and are not adequately exposed to the major right of ways this building has at its disposal. With signage directly facing a major thoroughfare such as Carrol Avenue, we feel this would give this location its best opportunity at success. 3. This proposed signage is consistent with the intent of the sign criteria in place for this property and surrounding properties. 4. The proposed signage for the rear elevation is calculated at the same formula used for the front and side elevation signage. We are asking for no more square footage allotment than what would normally be allowed on these existing sign locations. It is our goal to simply brand the rear elevation creating awareness on Carrol Avenue, not to exceed or go over and beyond what the current sign regulations would typically be for this elevation. Carroll Avenue, for a total of three attached signs. The sign/building is located at 1201 E. SH114, Suite 100, Southlake, Texas. REQUEST DETAILS: The applicant is requesting a variance to the Sign Ordinance No. 704-H requirements to exceed the total number of allowable signs for the lease space. The sign ordinance allows two signs per lease space and the applicant is requesting an additional sign on the west elevation of the lease space facing N. Carroll Avenue. Lo-Lo s Chicken and Waffles has frontage along an internal driveway on the east, SH114 on the north, and N. Carroll Avenue on the west. Lo-Lo s Chicken and Waffles currently has two attached signs, one on the north façade facing SH114, and one on the east facing the internal driveway. With the additional west façade sign, Lo-Lo s Chicken and Waffles will have a total of three attached signs. SH114, Suite 100, Southlake, Texas Lot 1R, Greenway-Carroll Addition C-3 General Commercial October 7, 2014; City Council approved a Master Sign Plan for Carroll Pointe for the property noting approval of the variances as proposed with respect to Chuy s restaurant: 1. One attached building sign and one building blade sign on the east elevation; 2. Three signs with two attached building signs (east and west elevations) and one building blade sign (east elevation); 3. An attached sign on the west elevation that shows 26 inches for the C ; and, 4. A building blade sign that is 52 square feet total / 26 square feet per sign face. Also, noting approval of the Carroll Pointe development monument sign locations and presentation. October 28, 2015; Two façade sign applications were approved for the Bicycle World lease space under the Master Sign Plan for Carroll Pointe. The east façade sign was 31.3 square feet (23.9 ft. by 16½ inches) with 16 ½-inch and 12-inch letters. The allowable signage is 52.8 square feet for the west façade. The east façade sign was 55.6 square feet (34.1 ft. by 24-inches) with 24-inch and 15-inch letters. The allowable signage is 66.5 square feet for the façade. April 5, 2016; City Council approved three total signs for Bicycle World tenant space which includes one attached sign on the west façade facing Carroll Avenue, two signs on the east façade facing the parking lot, and further noting that the second sign on the east façade will meet the specifications as presented at the meeting in terms of letter height, area, and location. May 3, 2016; City Council approved a sign variance for the Harvest Bread Company to allow two (2) permanent attached business signs to be placed on suspended aluminum poles instead of directly on the façades of the building; and also noting the variance shall only apply to the sign presented.
