6 FOREWORD This report covers the period from September to December and is the fourth issue of reported crimes prepared by the South Sudan National Police Service (SSNPS) under the Ministry of Interior with support from the United Nations Development Programme (UNDP) and the United Nations Mission in the Republic of South Sudan (UNMISS) Police. It is intended to be a tool for the Ministry to better monitor the professionalism of the SSNPS; facilitate the identification of crime trends; identify new and emerging patterns of criminal behaviour; allow improved support to the management of risk; and improve safety and security for the citizens of South Sudan. The Quarterly Crime Statistics reports also provides the SSNPS with an evidence-base for policy formulation on deployment of police personnel, establishment or reinforcement of police stations, recruitment, transfers, institutionalization of special police measures, patrolling, and addressing community policing issues. The previous quarterly reports provided the beginning of an evidence base; and more importantly, the collection and analysis of crime data improved personnel capacity. With this fourth report, the police are better placed to understand and respond to crime in South Sudan. Further, the Ministry is also better positioned to provide an oversight on the performance of the police, understand the needs of the service and ensure quality service delivery to the citizens of South Sudan. The Ministry of Interior remains committed to this initiative and will continue to work with partners to ensure the reports continue to stimulate and inform public debate on crime and police development in South Sudan. 7 QUARTERLY CRIME STATISTICS 7 PREFACE The South Sudan National Police Service (SSNPS) is pleased to present the fourth Quarterly Crime Statistics report. I would like to thank the Ministry of Interior for its leadership and commitment, the United Nations Development Programme (UNDP) and the United Nations Mission in the Republic of South Sudan (UNMISS) Police for their technical support to this critical initiative. The previous reports have improved the ability of the SSNPS to monitor crime, identify patterns and build a sustainable reporting mechanism, all towards the goal of improving the quality of police services to the citizenry. Like the earlier reports, the fourth edition of the Quarterly Crime Statistics report also provides a comprehensive view of the nature and trend of crimes in the country as defined by the South Sudan Penal Code Act The SSNPS will continue the collection and compilation of monthly crime statistics, its quarterly analysis and its dissemination through its publication to facilitate strategic decision making in the planning, resource allocation and deployment of police personnel in combating crimes at all levels. To increase the capacity of our personnel, specialised training on crime statistics was organised in December by UNDP with funding support from UNWOMEN and in collaboration with UNMISS Police. 53 police investigators from states and CID national headquarters participated and gained critical skills in crime data compilation and analysis. The SSNPS, with support from UNDP and UNMISS Police, will increase the number of trained personnel dedicated to producing the quarterly crime statistics reports. The SSNPS is committed to maintaining law and order, ensuring the safety and security of the public and continuing to professionalize its service with unreserved support from the Ministry of Interior, UNDP, and UNMISS Police. 9 QUARTERLY CRIME STATISTICS 9 INTRODUCTION In December 2011, the South Sudan National Police Service (SNPSS), with support from UNDP and UNMISS Police, began collecting and compiling monthly crime statistics data in a uniform format based on the Penal Code Act The collection of monthly crime statistics begins at the police station level and is compiled and analysed up to the national level. The first two quarters of the crime statistics reports (Q1: December 2011 February ; Q2: March May ) were launched on 9 October. The Directorate of Crime Investigation (CID) has established a standard system for collection and compilation of monthly crime statistics from police stations operating at the county, state and national levels. With support from UNDP and UNMISS Police, police stations collect and organize monthly crime data into a standard template, which is then sent to county headquarters for further aggregation and onward submission to the state police headquarters. In turn, the state police headquarters aggregate the crime data and send it to the national CID headquarters. At the national level, the total aggregated data is analyzed for trends and patterns, rates of crimes and population affected. Based upon this information, the SSNPS is able to respond through personnel deployment, specialized trainings and public outreach. Crime statistics are collected from all ten states of South Sudan and provide a comprehensive view of trends within the reporting period and a comparative analysis. This report includes various comparisons and analysis of crimes by category, by state and region for the past thirteen month period. The report covers the officially reported crimes under various categories and sections of the Penal Code Act 2008 and are grouped as follows: the Body, Public Order, Against Property, Morality, Gender and Marriage Related, Country or Government, by or Relating to Public Servants, Counterfeiting, Animals, Preventive Arrests and Other including Traffic, Drugs and Alcohol related etc. Based on this categorization, and an aggregated modulation of the data, substantiated trends are then developed to reflect the reported crime rate by state and by region.

10 A: CRIME STATISTICS ANALYSIS A1: OVERALL CRIME TRENDS Chart 1 below illustrates an increase in the crime rate from September to December. A comparison of the reported crimes indicates an initial decrease from September to October, gradual increase from October to November and a steep increase from November to December. The data represents the total number of reported crimes to the police in all ten states. 14 While Chart 1 illustrates an overall increase in reported crimes, Table 1 presents the number of reported crimes for each Penal Code offence and the percentage contribution to the overall level of crime during the reporting period. In summary, Table 1 shows a significant increase in Property, the Body and Morality, Gender and Marriage Related. Public Order and Country were least reported, being lowest in the entire period. Table 1 specifically shows that: Property contributed 36.41% in September, 38.67% in October, 37.60% in November and 29.25% in December ; and this category of crimes constituted 62.32% in the entire period; the Body contributed 25.21% in September, 25.51% in October, 29.67% in November and 21.30% in December ; and this category of crimes contributed to 43.19% in the entire period; Animals (including Cattle Theft) contributed 8.87% in September, 10.91% in October, 11.02% in November and 30.15% in December ; and this category of crimes contributed to 31.20% in the entire period; and Gender contributed 8.10% in September, 8.73% in October, 9.34% in November and 6.58% in December ; and this category of crimes contributed to 14.36% in the entire period. More specifically, under the category of Property, the major contributing offence was Theft, followed by Cheating and Breach of Trust. Theft contributed 46.65% in September, 38.19% in October, 46.70% in November and 47.10% in December ; and this category of crimes contributed to 44.94% for the entire period; Cheating contributed 14.06% in September, 23.62% in October, 12.67% in November and 10.87% in December ; and this category of crimes contributed 14.86%to the overall reported crime in the entire period; and Breach of Trust contributed 12.35% in September, 13.40% in October, 12.13% in November and 14.41% in December and this category of crimes contributed 13.15% in the entire period. Under the category of the Body, the major contributing offence is Simple Hurt followed by Grievous Hurt, Criminal Intimidation and Murder. Simple Hurt contributed 38.32% in September, 40.07% in October, 43.27% in November and 44.64% in December ; and this category of crimes contributed 41.95% in the entire period; Grievous Hurt contributed 28.89% in September, 29.50% in October, 28.16% in November and 30.58% in December ; and this category of crimes contributed 29.32% in the entire period; Criminal Intimidation contributed 14.70% in September, 15.86% in October, 12.04% in November and 6.41% in December ; and this category of crimes contributed 11.69% in the entire period; and Murder contributed 6.46% in September, 7.79% in October, 10.95% in November and 8.26% in December ; and this category of crimes contributed 8.51% in the entire period. 14 SEPTEMBER DECEMBER

15 QUARTERLY CRIME STATISTICS 15 Under the category of Animals, the major contributing offence was Cattle Theft, which was 100% in September and November; 99.35% in October, 99.96% in December and 99.89% for the entire period. Under the categories of Morality, Gender and Marriage Related, the major contributing offence was Adultery followed by Rape and Sexual Harassment. In this regard: Adultery contributed 47.88% in September, 62.33% in October, 74.08% in November and 70.06% in December ; and this category of crimes contributed 64.58% for the entire period; Rape contributed 16.93% in September, 23.85% in October, 14.47% in November and 18.96% in December ; and this category of crimes contributed 18.35% for the entire period; and Sexual Harassment contributed 24.07% in September, 5.69% in October, 3.02% in November and 4.19% in December ; and this category of crimes contributed 8.59% for the entire period. 16 FIGURE 2: NUMBER OF REPORTED CRIMES AGAINST THE POPULATION OF THE RESPECTIVE STATES The crime density maps, Chart 2, and Table 2 show that Central Equatoria, Western Bahr el Ghazal, Jonglei and Northern Bahr el Ghazal experienced a high density of crime in the reporting period. On the other hand, Eastern Equatoria, Western Equatoria and Upper Nile shows a comparatively less crime density. Jonglei, Western Bahr el Ghazal and Western Equatoria experienced a gradual increase in crime over the four month period while the other states experienced fluctuating crime rates. The majority of the states - Central Equatoria, Jonglei, Western Bahr el Ghazal, Northern Bahr el Ghazal, Unity, Warrap and Western Equatoria registered their highest level of crime in December ; while October had the lowest total reported crimes at 4,226 cases and December the highest with 7,614 cases. 16 SEPTEMBER DECEMBER

18 A2: CRIME STATISTICS FOR MAJOR CRIMES TYPES FOR SEPTEMBER TO DECEMBER a) MAJOR CRIMES STATISTICS Chart 3 and Table 3 & 4 illustrate a decrease in Grievous Hurt and Theft from September to October and an increase in November that then peaked in December. There were rate fluctuations in Murder and Rape, but Housebreaking increased consistently throughout the period. Grievous Hurt with 496 incidences, Theft with 1,049 incidences, Housebreaking with 207 incidences, and Rape with 95 incidences; peaked in December. 20 Reported Murder cases revealed an increase in December as compared to September for all the states except Central Equatoria, Upper Nile, and Western Bahr el Ghazal. The number of Murder cases in Jonglei increased from 0 in September to 27 in December. In Unity, Lakes, and Warrap, Murder increased from 2 to 16, from 11 to 18, and from 10 to 15 incidences, respectively. Lakes reported 46 Murder cases, the highest number of reported Murder cases in November. The number of reported Murder cases in Central Equatoria and Upper Nile decreased slightly from 22 in September to 20 in December and from 11 in September to 9 in December, respectively. Murder cases in Eastern Equatoria and Jonglei accounted for 30%, and 27%, respectively of the total. Reported cases of Theft increased in December as compared to September from 689 to 1,049 incidences. Theft accounted for 50% of the total major reported cases in Central Equatoria while it accounted for 70%, 69%, and 66% of the total reported crimes in Western Equatoria, Warrap, and Unity, respectively. Considering the overall reported crimes for major crime types in South Sudan, Theft contributed 53% of the total crimes, and Grievous Hurt and Murder accounted for 26% and 7% of the total reported Major, respectively. Reported cases of Grievous Hurt revealed an increase in December as compared to September from 340 to 496 incidences. The number of Grievous Hurt cases in Jonglei increased from 1 in September to 31 in December, and in Northern Bahr el Ghazal and Warrap increased from 40 to 118 and from 18 to 58 incidences, respectively. Central Equatoria reported the highest number of Grievous Hurt cases with 170 incidences in December while the number of reported cases in Unity decreased from 54 in September to 31 in December. Grievous Hurt cases in Northern Bahr el Ghazal, Jonglei, Western Bahr el Ghazal and Central Equatoria accounted for 38%, 35%, 32% and 27%, respectively. Reported cases of Housebreaking increased from 62 in September to 207 in December. The number of Housebreaking cases in Northern Bahr el Ghazal increased from 0 to 70 during the four-month period. It also increased in Western Bahr el Ghazal and Western Equatoria from 14 to 20 and from 0 to 16, respectively. Central Equatoria reported 90 Housebreaking incidences in December, the highest in the reporting period. Housebreaking cases accounted for 8% of the total reported crimes in South Sudan and 15% for Jonglei, 8% for Eastern Equatoria and 7% for Upper Nile in the entire period. Reported cases of Rape increased from 64 to 95 in December as compared to September. The number of Rape cases in Warrap increased from 3 in September to 23 in December ; and in Eastern Equatoria it increased from 1 to 6. Central Equatoria reported the highest incidents of Rape with 47 incidences in December. Rape cases accounted for 5% of the total reported crimes in South Sudan with 12% in Western Bahr el Ghazal and 8% from Upper Nile. b) CRIME STATISTICS PER TIME PERIOD An analysis of September data in Table 3 shows that the highest incidences of Major occurred in Central Equatoria with 520 cases followed by Western Bahr el Ghazal with 152 incidences. Western Equatoria with 41 and Warrap with 44 cases were among the states with the lowest number of Major reported. Central Equatoria accounted for 42.24% of the total Major reported in September. Theft had the highest number of incidents accounting for 55.97% of the total reports with Grievous Hurt and Murder accounting for 27.62% and 6.17%, respectively. In October, Table 3 shows that Theft still contributed to the bulk of Major at 60.82% of the overall crimes. The highest number of Thefts were reported in Central Equatoria with 270 incidences followed by Unity with 100 incidences. Overall, there was a slight decrease in the total number of Thefts in October as 20 SEPTEMBER DECEMBER

21 QUARTERLY CRIME STATISTICS 21 compared to September from 689 to 624 incidences; while Murder and Rape incidences increased from 76 to 84, and 64 to 88, respectively. Table 3 also indicates that the highest number of cases occurred in Central Equatoria with 540 incidences, whereas Warrap had the least number of reported cases at 7. Central Equatoria accounted for 44.89% of the Major for October. The November data in Table 3 shows that Central Equatoria reported the highest number of major crimes totalling 522 cases followed by Warrap state with 269 cases, as compared to the remaining states. Generally, the other states reported lower crime rates. The December data Table 3 shows that Central Equatoria again had the highest number of Major for Murder, Grievous Hurt and Theft totalling 560 followed by Warrap with 348 and Northern Bahr el Ghazal with 333 incidences. Generally, Jonglei, Eastern Equatoria, Upper Nile and Lakes reported low crime incidences. Theft and Grievous Hurt contributed the highest percentages of crimes at 52.95% and 25.04% respectively. The highest number of Theft - 1,049 cases; Grievous Hurt cases; and Murder with 134 cases for the period were reported in December. In Western Equatoria, the reported crime level has shown a slight increase from September to December With the exception of Upper Nile, Lakes, and Eastern Equatoria, all other states experienced their highest reported crimes in December. In the reporting period, the data for Lakes revealed a decrease from 109 to 79 incidences in Major in December as compared to September. Less than 50 crimes were reported in: Western Equatoria, Eastern Equatoria, Warrap, Upper Nile and Jonglei in September; Western Equatoria, Northern Bahr el Ghazal and Warrap in October; and Upper Nile and Jonglei in November.

22 A3: CRIMES BY CATEGORY Chart 4 and Table 5 show the frequency of reported crimes by category. From September to December, the most reported crimes were Property and the Body, contributing 34.59% and 24.91%, respectively. The high number of Related to Animals at 17.32% is connected to Jonglei with the Cattle Theft as the major crime. There was a nationwide steady increase in Cattle Thefts from September to December with figures rising from 414 to 458 to 546 and 2,295, respectively for the four-month period. 26 A5: A COMPARATIVE ANALYSIS OF THE THIRTEEN MONTH PERIOD (DECEMBER 2011 TO DECEMBER ) Chart 8 and Table 9 show a fluctuation in the number of cases reported in South Sudan for each Major Crime from December 2011 to December. An overall decline can be seen between the first and the second quarter with a subsequent increase between the third and the fourth quarter. The rate of reported cases for each crime varied from month to month without consistency. The first quarter reported the highest number of crimes at 7,209 while the second quarter reported the lowest with 4,032 cases. However, the effect of the seasons seems to have impacted reported crime rates as observed during the dry season (October to May), which had the highest reported incidents of crime. The table shows a significant increase in Property followed by the Body, Animals, and Morality, Gender and Marriage Related. However, there is a month-onmonth variation in the number of reported crimes. Specifically: 23,301 cases were reported under Property in the 13 month period, where December 2011 reported the highest number of cases, with 3,745, and January the lowest, with 1,055 cases; 15,630 cases were reported under the Body, peaking in December, with 1,622 cases and reporting its lowest in July, with 864 cases; 8,677 cases were reported under Animals in the 13 month period, where, in December reported 2,295 cases as compared to 7 cases in December 2011; and 5,136 cases were reported under Gender in the 13 month period, where December 2011 reported 557 cases and May, 302 cases. Under the category of Property, the major contributing offence was Theft, followed by Breach of Trust and Cheating. Specifically: 12,258 Theft cases were reported between December 2011 and December, where December 2011 reported 2,229 cases, and 624 cases each were reported in April and October; and 2,566 Breach of Trust cases were reported in the 13 month period, where December 2011 reported the highest, with 700 cases, and June the lowest, with 64 cases. Under the category of the Body, the major contributing offence was Simple Hurt followed by Grievous Hurt and Murder. It also includes trend analysis for the overall reported crimes by state. The overall reported crime level has decreased by 43% in Western Equatoria and by 64% in Upper Nile. In contrast, the level of reported crimes has increased significantly in Warrap 83%, Lakes 52%, and Central Equatoria 43%. The trend test shows that there is a general increasing trend for Central Equatoria and decreasing trend for Upper Nile in the number of reported crimes over the 13 month period - December 2011 to December. GENERAL ANALYSIS OF CRIME FACTORS Central Equatoria with 6,799, Jonglei with 4,384, Warrap with 1,795 and Unity with 1,849 crimes had the highest number of reported crimes from September to December. Eastern Equatoria with 538 cases, Western Equatoria with 694 and Upper Nile with 920 cases showed lower numbers of reported crimes in the same period. It is possible to attribute these trends to the following factors: B1: CRIME AND CONFLICT FACTORS The communal and collectivist nature of societies in South Sudan: Every offence, regardless of magnitude, is normally resolved collectively through traditional conflict resolution mechanisms. The importance of customary law and practice is reflected in the Transitional Constitution of South Sudan which honours customary law as a source of both law and legislation. Anecdotal evidence suggests that the majority of citizens rely on customary law to resolve disputes and conflict. However, this means that there is limited reliance on the formal justice system, even where the matters are not within the jurisdiction of the traditional authorities. The idea of strict liability for an offence is not observed in South Sudan due to cultural/traditional reasons. Relatives are always held responsible for an offence committed by a member of a family. Also, conflicts are not individualized because a fight between two people can easily escalate into a family, clan and even a tribal fight. As conflicts escalate, their resolution becomes more complex and time consuming, and in the interim, further crimes related to these conflicts may be committed. Community clashes and cattle raids are frequent in the states with the highest crime trends. Jonglei is the worst affected state owing to political turmoil and group clashes. The frequent on-going clashes have generated a high sense of insecurity among the citizens and as a result people resort to illegal activities including, Cattle Theft, raids, and property related crimes to secure their economic status as well as commit acts that will incur loss to rival groups. This inter-communal fighting has led to several deaths and it is imperative to address this problem to prevent recurrence of such violence. FACT: Jonglei has witnessed 4,384 crimes (20.43%) out of the total 21,464 cases reported between September and December, including 3,617 Cattle Thefts amounting to 16.85% of total cases, which illustrates the dependency of communities on cattle. B2: CUSTOMS, TRADITIONS, AND SOCIAL CHANGES With approximately 85% of the total population still referring to traditional authorities for dispute resolution, the potential risk for increasing victimization continues to be tied to conditions at the community level. The influence of customary law and norms in the dispensation of justice provides for the proliferation of undocumented and informal ways of resolving conflict amongst communities. For instance, the high number of gender related crimes like Adultery, Rape, Domestic Violence, and Sexual Assault and Harassment reflect the current conditions and position of women in South Sudanese society, where they are greatly affected by Sexual and Gender-Based Violence as an instrument of conflict, within the domestic

38 sphere and the public sector. In cases of Rape and Sexual Harassment, the female victims continue to be treated as wrongdoers, whereas the accused males have limited responsibility and suffer lesser penalties. FACT: The Gender related crimes increased from 1,045 in the third quarter to 1,711 in the fourth quarter. B3: ECONOMIC FACTORS The data shows that Murder in the fourth quarter is highest in Lakes with 85 incidents, followed by Central Equatoria 70, Eastern Equatoria 66 and Jonglei with 62 incidents. Murders in Jonglei and Lakes are closely linked to Cattle Thefts/raids. Revenge attacks are also common. Cattle raids are closely linked to economics, because cattle are a source of pride, dowry, and income, and are used for compensation to settle disputes. In the more urbanized Central and Eastern Equatoria, many Murders are linked to robberies that are related to unemployment. As more people return to South Sudan, there is more pressure on limited resources contributing to an escalation in crimes related to property. Murder rates are also higher in communities that are poor and have large populations of young men. There is a rapidly growing income gap, with only a small number of citizens seeing a significant rise in their income. The situation in post-independence South Sudan presents socioeconomic challenges. Economic inequality and the lack of a vibrant private sector to generate employment and create opportunities for wealth creation have increased the level of insecurity. FACT: Property rose from 4,834 in the third quarter to 7,424 in the fourth quarter, an increase of 53.58%. In the same period, Related to Animals rose from 72 to 3,717, an increase of 5,062%. For instance, in Central Equatoria, the reported crime rate can be attributed to economic factors relating to issues of metropolitan crime trends that affect the capital city of Juba. The decision of local authorities to vacate and take possession of the encroached land through large scale demolitions resulted in demobilization of vast habitats and business settlements, thereby inciting resentment among a large section of the population. Furthermore, the constant influx of returnees and foreigners to the cities around the country has raised the demand for real estate and other basic services and increased the level of competition among the native settlers and new entrants for acquiring land. During the war, large portions of land were allocated to the community; while as after the independence, local chiefs have appropriated authority for land allocation to individuals on payment. With no structured system in place for land allocation or registration, the discretionary power of local authorities has resulted in multiple ownership of the same piece of land, thus serving as a breeding ground for the corresponding rise in land disputes, personal rivalries and crime rates. FACT: Under the category of the Body: 1,177 cases were reported in September; 1,078 in October; 1,470 in November; and 1,622 in December. The crimes soared from 3,193 cases in the third quarter to 5,347 cases in the fourth quarter, an increase of 67.46%.
