( CBL, by and through counsel, and as managing agent for the owners of the properties identified herein, hereby files this cure claim objection (the Objection regarding the Debtors cure proposed in its Notice of Filing of Assumed Executory Contract and Unexpired Lease Schedule [Docket No. 836] and its Notice of Filing of Third Amended Assumed Unexpired Lease Schedule [Docket No. 996] (collectively, the Cure Notice, and respectfully represents as follows: 1 The Debtors in these chapter 11 cases, along with the last four digits of each Debtor s federal tax identification number, include: rue21, inc. (1645; Rhodes Holdco, Inc. (6922; r services llc (9425; and rue services corporation (0396. The location of the Debtors service address is: 800 Commonwealth Drive, Warrendale, Pennsylvania CHD

On May 15, 2017 (the Petition Date, the above-captioned debtors (the Debtors filed voluntary petitions for relief under chapter 11 of the Bankruptcy Code. 2. The Debtors have continued to operate their business and manage their properties as debtors-in-possession pursuant to 11 U.S.C. 1107(a and On August 7, 2017, Debtors filed their Notice of Filing of Assumed Executory Contract and Unexpired Lease Schedule [Docket No. 836] (the First Notice. 4. On August 28, 2017, Debtors finally filed their Notice of Filing of Third Amended Assumed Executory Contract and Unexpired Lease Schedule [Docket No. 996] (collectively with the First Notice, together, the Cure Notice. 5. CBL is the managing agent for the owner of thirty-four (34 properties listed the Debtors Cure Notice (collectively, the CBL Leases. 6. On August 21, 2017, CBL filed its Cure Claim Objection [Docket No. 909] (the Cure Objection. 7. CBL herein amends its Cure Objection to the cure amounts proposed for the CBL Leases in the Debtors Cure Notice. 8. The proposed cure amounts are understated as of August 11, 2017 as to the below nine (9 locations as indicated in the below table: 2 Unless otherwise specified, all statutory references to Section are to 11 U.S.C. 101 et seq. True and correct Lease Summaries supporting the actual CBL Lease Cure Amounts contained in the chart above are attached hereto and incorporated herein collectively as Exhibit A. 10. CBL objects to the assumption of the CBL Leases absent payment of all cure amounts owed thereunder through the effective date of assumption, including any amounts that will become due or be invoiced on or after August 11, 2017 (including but not limited to additional amounts, not yet known, with regard to calendar year 2016, such as year-end adjustments to various items including, but not limited to, real estate taxes, common area maintenance, percentage rent and insurance, as well as attorney fees and costs. 3 The cure amounts specified in this chart do not reflect any amounts that will become due or be invoiced on or after August 11, 2017 or attorneys fees and costs, and CBL reserves all of its rights with respect thereto. CBL further avers that additional amounts, not yet known, may be due with regard to calendar year 2016, such as year-end adjustments to various items including, but not limited to, real estate taxes, common area maintenance, percentage rent and insurance. CBL further reserves all rights with respect thereto. CHD

(b(1 If there has been a default in an executory contract or unexpired lease of the debtor, the trustee may not assume such contract or lease unless, at the time of assumption of such contract or lease, the trustee (A cures, or provides adequate assurance that the trustee will promptly cure, such default ; (B compensates, or provides adequate assurance that the trustee will promptly compensate, a party other than the debtor to such contract or lease, for any actual pecuniary loss to such party resulting from such default; and (C provides adequate assurance of future performance under such contract or lease. 12. Section 365(b(1 includes compensation to landlords for sums incurred for attorneys fees and expenses. The CBL Leases provide for recovery of attorneys fees and expenses. JOINDER 13. In addition to the foregoing, CBL further joins in the objections filed by Debtors other landlords to the extent that such objections are not inconsistent with the relief requested in this Objection. RESERVATION OF RIGHTS 14. CBL hereby reserves its rights to make such other and further objections as may be appropriate, including, but not limited to, objections regarding adequate assurance of future performance under Section 365. WAIVER OF LOCAL RULE (A To the extent Local Rule (a of the Local Rules for this district requires a proposed order with this Objection, CBL respectfully requests a waiver of such requirement given the alternative forms of relief required herein.
