1 SAGTEVRUGTEPLANTSERTIFISERINGSKEMA AANHANGSEL In hierdie Aanhangsel beteken die Skema die Sagtevrugteplantsertifiseringskema gepubliseer by Goewermentskennisgewing No. R 1971 van 15 Oktober 1993, soos verbeter deur Goewermentskennisgewing No. R. 453 van 22 Maart 1996 en gewysig deur Goewermentskennisgewing Nos. R. 564 van 18 April 1997, R van 10 Oktober 1997, R. 262 van 5 Maart 1999 en R. 42 van 28 Januarie [Nota: Die syfers in vierkantige hakies by die opskrifte van artikels dui die nommers van die magtigende bepalings daarvan in die Wet aan.] 1. Woordomskrywing [23; 24(1)(q)] In hierdie Skema, tensy uit die samehang anders blyk, beteken - afwykende plant n plant wat nie variëteitseg is nie; ander wingerd lote of plante van n spesie van die genus Vitis wat op n oppervlakte grond wat nie ingevolge hierdie skema as n eenheid geregistreer is nie, voorkom; bronplant, met betrekking tot n bepaalde variëteit of n kloon daarvan, daardie plant wat as primêre bron van alle plante van die betrokke variëteit of kloon dien; deelnemer iemand ten gunste van wie n eenheid ingevolge artikel 6 van hierdie Skema geregistreer is; die gesag die gesag in artikel 3 van hierdie Skema bedoel; die Wet die Plantverbeteringswet, 1976 (Wet No. 53 van 1976), en ook die regulasies daarkragtens uitgevaardig; eenheid n oppervlakte grond wat ingevolge artikel 6 van hierdie Skema geregistreer is; grond ook enige vaste of vloeibare stof wat as medium vir die verbouing van plante aangewend kan word; grondveskwekeryplant plantmateriaal wat aan die vereistes voldoen wat in artikel 12 van hierdie Skema vir grondveskwekeryplante uiteengesit is; DECIDUOUS FRUIT PLANT CERTIFICATION SCHEME ANNEXURE In this Annexure, the Scheme means the Deciduous Fruit Plant Certification Scheme published by Government Notice No. R of 15 October 1993, as corrected by Government Notice No. R. 453 of 22 March 1996 and amended by Government Notice Nos. R. 564 of 18 April 1997, R of 10 October 1997, R. 262 of 5 March 1999 and R. 42 of 28 January [Note: The figures in square brackets at the headings of sections indicate the numbers of the authorising provisions therefor in the Act.] 1. Definitions [23; 24(1)(q)] In this Scheme, unless the context otherwise indicates deviating plant means a plant that is not true to variety; other vineyard means shoots or plants of a species of the genus Vitis that occur on an area of land that is not registered as a unit in terms of this Scheme; source plant, in relation to a particular variety or a clone thereof, means the plant that serves as primary source of all plants of the variety or clone concerned; participant means a person in whose favour a unit is registered in terms of section 6 of this Scheme; the authority means the authority referred to in section 3 of this Scheme; the Act means the Plant Improvement Act, 1976 (Act No. 53 of 1976), and includes the regulations made thereunder; unit means an area of land that is registered in terms of section 6 of this Scheme; soil includes any solid or liquid substance that can be utilised as a medium for the cultivation of plants; foundation nursery plant means plant material that complies with the requirements set out in section 12 of this Scheme for foundation nursery plants; grondvesplant plantmateriaal wat aan die vereistes voldoen wat in artikel 12 van hierdie Skema vir grondvesplante uiteengesit is; foundation plant means plant material that complies with the requirements set out in section 12 of this Scheme for foundation plants; Sagtevrugteskema laaste wysiging deur R. 42 van 28 Januarie

2 kernplant plantmateriaal wat aan die vereistes voldoen wat in artikel 12 van hierdie Skema vir kernplante uiteengesit is; kernvrugte appels, kwepers en pere; kwekeryplant plantmateriaal wat aan die vereistes voldoen wat in artikel 12 van hierdie Skema vir kwekeryplante uiteengesit is; moederplant plantmateriaal wat aan die vereistes voldoen wat in artikel 12 van hierdie Skema vir moederplante uiteengesit is; plantmateriaal plantmateriaal van die tipes vermeld in Bylae 1 in die geval van kern- en steenvrugte en in Bylae 2 vir tafel en droogdruiwe; registrateur die Registrateur van Plantverbetering kragtens artikel 3(1) van die Wet deur die Minister van Landbou aangewys; rougrond grond waarin geen lote of plante van n spesie van die genus Vitis gedurende die voorafgaande 10 jaar voorgekom het nie; sagtevrugte kernvrugte, steenvrugte en tafel- en droogdruiwe; sertifiseer om ingevolge hierdie Skema te sertifiseer en het gesertifiseer en sertifisering ooreenstemmende betekenisse; steenvrugte amandels, appelkose, kersies, nektariens, perskes, pruime en pruimedante, asook interspesiekruisings van genoemde vrugsoorte; tafel- en droogdruiwe vrugte van daardie variëteite van die genus Vitis wat gebruiklikerwys vir vars verbruik en droging aangewend word; variëteitseg met betrekking tot n plant van n bepaalde variëteit, dat sodanige plant ooreenstem met die erkende beskrywing in artikel 17 van die Wet bedoel, van n tipiese plant van daardie variëteit; variëteitslys die variëteitslys in artikel 15 van die Wet bedoel; verbou met betrekking tot plantmateriaal en plante, om sodanige plantmateriaal te versorg of om die groei van sodanige plante te bevorder of te stimuleer met die oog daarop om plantmateriaal daarvan te verkry en het verbouing n ooreenstemmende betekenis; en nucleus plant means plant material that complies with the requirements set out in section 12 of this Scheme for nucleus plants; pome fruit means apples, pears and quinces; nursery plant means plant material that complies with the requirements set out in section 12 of this Scheme for nursery plants; mother plant means plant material that complies with the requirements set out in section 12 of this Scheme for mother plants; plant material means plant material of the types specified in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes; registrar means the Registrar of Plant Improvement designated by the Minister of Agriculture under section 3(1) of the Act; virgin soil means soil in which no shoots or plants of a species of the genus Vitis have occurred during the preceding 10 years; and deciduous fruit means pome fruit, stone fruit and table and drying grapes; certify means to certify in terms of this Scheme; and certified and certification shall have corresponding meanings; stone fruit means almonds, apricots, cherries, nectarines, peaches, plums and prunes, as well as interspecies crosses of the said kinds of fruit; table and drying grapes means those varieties of Vitis the fruit of which is customarily utilised for fresh consumption or drying; true to variety, in relation to a plant of a particular variety, means that such plant corresponds with the recognised description referred to in section 17 of the Act, of a typical plant of that variety; varietal list means the varietal list referred to in section 15 of the Act; cultivate, in relation to plant material and plants, means to care for such plant material or to promote or stimulate the growth of such plants with a view to obtain plant material thereof; and cultivation shall have a corresponding meaning; Sagtevrugteskema laaste wysiging deur R. 42 van 28 Januarie

3 visueel vry met betrekking tot die voorkoms van n bepaalde insek of patogeen op plantmateriaal of n plant, dat (a) die gesag nie in staat is om die voorkoms van daardie insek of patogeen op sodanige plantmateriaal of plant visueel waar te neem nie tensy hy van n mikroskoop of vergrootglas gebruik maak; of (b) die gesag, visueel die kenmerkende simptome wat deur daardie insek of patogeen veroorsaak word, op sodanige plantmateriaal of plant waargeneem het sonder om van n mikroskoop of vergrootglas gebruik te maak, maar die toets, ondersoek of ontleding daarvan in n laboratorium nie die voorkoms van die betrokke insek of patogeen daarop bevestig nie. 2. Naam van Skema [23; 24(1)(q)] Hierdie Skema heet die Sagtevrugteplantsertifiseringskema. 3. Aanwysing van gesag [23; 24(1)(a)] 3.1 Die uitvoerende raad van die Sagtevrugteplantverbeteringsvereniging, n vrywillige vereniging wat n regspersoon is uit hoofde van n bepaling te dien effekte in sy grondwet, word hierby aangewys as die gesag vir die doeleindes van die uitoefening van die bevoegdhede, die verrigting van die werksaamhede en die uitvoering van die pligte wat kragtens hierdie Skema aan die gesag verleen, toegewys of opgedra is. 3.2 Die bevoegdhede, werksaamhede en pligte in artikel 3.1 bedoel, word op eie koste en behoudens die voorskrifte van die registrateur deur die betrokke gesag uitgeoefen, verrig en uitgevoer, en die gesag het geen reg van verhaal op die Staat vir enige koste aldus aangegaan nie. 4. Toepassing van Skema [23; 24(1)(f)] 4.1 Hierdie Skema is van toepassing op sagtevrugte van daardie variëteite waarvan die benamings in die variëteitslys aangeteken is. [Subartikel 4.1 gewysig deur R. 453 van 22 Maart 1996] 4.2 Die gesag hou n register van klone van die variëteite bedoel in artikel n Aansoek om die opname van n kloon in sodanige register moet op die wyse soos deur die gesag bepaal, by die gesag ingedien word. visually free, with regard to the occurrence of a particular insect or pathogen on plant material or a plant, means that (a) the authority is unable to visually observe the occurrence of that insect or pathogen on such plant material or plant unless he uses a microscope or magnifying glass; or (b) the authority has visually observed the characteristic symptoms caused by that insect or pathogen on such plant material or plant without the use of a microscope or magnifying glass, but the testing, examination or analysis thereof in a laboratory has not revealed the occurrence of the insect or pathogen concerned thereon. 2. Name of Scheme [23; 24(1)(q)] This Scheme shall be known as the Deciduous Fruit Plant Certification Scheme. 3. Designation of authority [23; 24(1)(a)] 3.1 The executive board of the Deciduous Fruit Plant Improvement Association, a voluntary association that is a juristic person by virtue of a provision to this effect in its statute, is hereby designated as the authority for the purpose of the exercising of the powers, the performance of the functions and the carrying out of the duties that are conferred upon, assigned to or imposed upon the authority under this Scheme. 3.2 The powers, duties and functions referred to in section 3.1 shall be exercised, performed and carried out by the authority at its own cost and subject to the directions of the registrar, and the authority shall not have any right of recourse against the State for any costs so incurred. 4. Application of Scheme [23; 24(1)(f)] 4.1 This Scheme shall apply to deciduous fruit of those varieties the denominations of which are entered in the varietal list. [Subsection 4.1 amended by R. 453 of 22 March 1996] 4.2 The authority shall keep a register of clones of the varieties referred to in section An application for the inclusion of a clone in such register shall be submitted to the authority in the manner determined by that authority. 4 4.4 So n aansoek word slegs goedgekeur indien alle tersaaklike besonderhede met betrekking tot die betrokke kloon aan die gesag voorgelê is; en die gesag oortuig is dat die betrokke kloon variëteitseg is, en dat dit of die produkte daarvan die ander eienskappe of kenmerke wat die gesag bepaal, openbaar. 4.5 Ondanks enige andersluidende bepalings in hierdie artikel kan die gesag bepaal dat al die bepalings van hierdie Skema van toepassing is op die ander variëteite en klone van sagtevrugte soos wat die Gesag bepaal. Voorwaardes vir sertifisering [23; 24(1)] Plantmateriaal kan gesertifiseer word indien aan die volgende vereistes voldoen word: 5.1 Dit moet op n eenheid verbou wees. 5.2 Dit moet deur of ten behoewe van die betrokke deelnemer verbou wees. 5.3 Dit moet van plante verkry wees wat veriëteitseg is en ooreenkomstig die bepalings van artikel 11 van hierdie Skema gevestig en versorg word. 5.4 Dit moet variëteitseg wees en aan die toepaslike vereistes in artikel 12 van hierdie Skema uiteengesit, voldoen. 5.5 Die eenheid waarop dit verbou is, moet ooreenkomstig die bepalings van artikel 13 van hierdie Skema ondersoek wees. 5.6 Dit moet te alle tye ooreenkomstig die bepalings van artikel 14 van hierdie Skema opgeberg word. 5.7 Dit moet ooreenkomstig die bepalings van artikel 16 van hierdie Skema in bondels opgemaak of in houers gevestig wees. 5.8 Die bondels en houers in artikel 5.7 bedoel, moet ooreenkomstig die bepalings van artikel 17 van hierdie Skema geëtiketteer wees. 5.9 Dit moet ooreenkomstig die bepalings van artikel 18 van hierdie Skema vir sertifisering aangebied word. 4.4 Such application shall be approved only if all relevant particulars with regard to the clone concerned have been submitted to the authority; and the authority is satisfied that the clone concerned is true to variety, and that it or the products thereof reveal such other properties or characteristics as that authority may determine. 4.5 Notwithstanding anything to the contrary contained in this section, the authority may determine that all the provisions of this Scheme shall apply to such other varieties and clones of deciduous fruit as the authority may determine. Conditions for certification [23; 24(1)] Plant material may be certified if the following requirements are complied with: 5.1 It shall be cultivated on a unit. 5.2 It shall be cultivated by or on behalf of the participant concerned. 5.3 It shall be obtained from plants that are true to variety and are established in accordance with the provisions of section 11 of this Scheme. 5.4 It shall be true to variety and comply with the applicable requirements set out in section 12 of this Scheme. 5.5 The unit on which it has been cultivated shall be inspected in accordance with the provisions of section 13 of this Scheme. 5.6 It shall at all times be stored in accordance with the provisions of section 14 of this Scheme. 5.7 It shall be made up in bundles in accordance with the provisions of section 16 of this Scheme, or be established in containers. 5.8 The bundles or containers referred to in section 5.7 shall be labelled in accordance with the provisions of section 17 of this Scheme. 5.9 It shall be presented for certification in accordance with the provisions of section 18 of this Scheme. 5 5.10 Al die ander bepalings van hierdie Skema met betrekking tot die betrokke plantmateriaal moet nagekom word. 6. Registrasie van eenhede [23; 24(1)(b), (c), (d), (e)] 6.1 n Aansoek om die registrasie van n oppervlakte grond as n eenheid vir die doeleindes van hierdie Skema moet op n vorm en n wyse deur die gesag bepaal, gedoen word. 6.2 So n aansoek word slegs oorweeg indien in die geval van kernplante, grondvesplante en moederplante, die betrokke aansoeker deur die gesag as n plantverbeteringsorganisasie erken word; en die betrokke aansoeker andersins n lid is van die Sagtevrugteplantverbeteringsvereniging in artikel 3.1 van hierdie Skema bedoel. 6.3 n Vorm in subartikel 6.1 bedoel, moet by die gesag ingedien word; en vergesel gaan van n liggingskaart wat duidelik aantoon waar die betrokke oppervlakte grond geleë is. 6.4 Die bedrag wat die gesag vir die doel bepaal, is ten opsigte van so n aansoek betaalbaar. 6.5 n Oppervlakte grond kan as n eenheid geregistreer word indien aan die volgende vereistes voldoen word: Dit moet aan die toepaslike vereistes in artikel 10 van hierdie Skema uiteengesit, voldoen Plantmateriaal moet ooreenkomstig die bepalings van artikel 11 van hierdie Skema daarop gevestig wees Die betrokke aansoeker moet die gesag voorsien van n opgaaf in die vorm deur die gesag bepaal, betreffende die plantmateriaal van elke kloon wat op die betrokke oppervlakte grond gevestig is; en n plantplan van die vestiging van sodanige plantmateriaal daaop All the other provisions of this Scheme with regard to the plant material concerned shall be complied with. 6. Registration of units [23; 24(1)(b), (c), (d), (e)] 6.1 An application for the registration of an area of lands as a unit for the purposes of this Scheme shall be made on a form and in a manner determined by the authority. 6.2 Such application shall be considered only if in the case of nucleus plants, foundation plants and mother plants, the applicant concerned is recognised by the authority as a plant improvement organisation; and the applicant concerned is otherwise a member of the Deciduous Fruit Plant Improvement Association referred to in section 3.1 of this Scheme. 6.3 A form referred to in section 6.1 shall be lodged with the authority; and be accompanied by a locality map that clearly indicates where the area of land concerned is situated. 6.4 The amount determined by the authority for this purpose shall be payable in respect of such application. 6.5 An area of land may be registered as a unit if the following requirements are complied with: It shall comply with the applicable requirements set out in section 10 of this Scheme Plant material shall be established thereon in accordance with the provisions of section 11 of this Scheme The applicant concerned shall provide the authority with a return in the form determined by the authority, with regard to the plant material of each clone that is established on the area of land concerned; and a planting plan of the establishment of such plant material thereon. 6 6.6 n Aansoek om die registrasie van n oppervlakte grond kan geweier word indien die gesag oortuig is dat die bepalings van artikel 6.5 nie ten opsigte van daardie oppervlakte grond nagekom is nie; die betrokke aansoeker weens n gebrek aan kennis of fasiliteite tot sy beskikking, waarskynlik nie in staat sal wees om plantmateriaal te verbou wat geskik vir sertifisering sal wees nie; of voorheen versuim het om aan die bepalings van hierdie Skema of n voorwaarde daarkragtens bepaal, te voldoen; die betrokke oppervlakte grond in n gebied geleë is wat hom nie leen tot die verbouing van plantmateriaal wat geskik vir sertifisering sal wees nie; of nie geredelik vir die doeleindes van n ondersoek ingevolge hierdie Skema bereik kan word nie; die lewering van dienste ingevolge hierdie Skema op die betrokke oppervlakte grond of in verband met die plantmateriaal wat daarop verbou sal word, nie geregverdig of doenlik is nie; of die betrokke aansoek n wesenlike wanvoorstelling bevat [Subartikel 6.7 geskrap deur R. 42 van 28 Januarie 2011] 6.8 Vanaf die datum waarop n eenheid ingevolge hierdie artikel geregistreer is, is die bepalings van hierdie Skema bindend vir die betrokke deelnemer. 7. Termyn van registrasie [23; 24(1)(d)] 7.1 Die registrasie van n eenheid wat vir die verbouing van grondveskwekeryplante of kwekeryplante geregistreer is, verval wanneer al die plantmateriaal of plante wat daarop gevestig is, daarvandaan verwyder is. 6.6 An application for the registration of an area of land may be refused if the authority is satisfied that the provisions of section 6.5 have not been complied with in respect of that area of land; the applicant concerned will by reason of a lack of knowledge or facilities at his disposal, probably not be able to cultivate plant material that will be suitable for certification; or previously failed to comply with the provisions of this Scheme or a condition determined thereunder; the area of land concerned is situated in an area that does not lend itself to the cultivation of plant material that will be suitable for certification; or cannot readily be reached for the purposes of an inspection of terms of this Scheme; the rendering of services in terms of this Scheme on the area of land concerned or in connection with the plant material to be cultivated thereon, is not justified or feasible; or the application concerned contains a material misrepresentation [Subsection 6.7 deleted by R. 42 of 28 January 2011] 6.8 As from the date on which a unit is registered in terms of this section, the provisions of this Scheme shall be binding on the participant concerned. 7. Term of registration [23; 24(1)(d)] 7.1 The registration of a unit which is registered for the cultivation of foundation nursery plants or nursery plants shall lapse when all the plant material or plants established thereon are removed thereof. 7 7.2 Die registrasie van enige ander eenheid verval op die datum wat die gesag ten tyde van die registrasie daarvan bepaal. 7.3 n Registrasie wat ingevolge artikels 7.1 of 7.2 verval het, is hernieubaar op die wyse soos in artikel 6 van hierdie Skema uiteengesit. 8. Oordrag van registrasie [23; 24(1)(q)] 8.1 Behoudens die bepalings van artikel 8.3 is die registrasie van n eenheid nie aan iemand anders oordraagbaar nie. 8.2 Indien n deelnemer sy beskikkingsreg van n eenheid of die plante wat daarop gevestig is, aan iemand anders oordra, moet hy die gesag onverwyld skriftelik daarvan in kennis stel. 8.3 Indien iemand aan wie n beskikkingsreg oorgedra is soos in artikel 8.2 beoog, verlang om voort te gaan met deelname aan hierdie Skema ten opsigte van die betrokke eenheid, moet hy onverwyld ooreenkomstig artikel 6 van hierdie Skema n aansoek om die registrasie van daardie eenheid in sy naam indien. 9. Intrekking van registrasie [23; 24(1)(q)] Die gesag kan te eniger tyd die registrasie van n eenheid intrek indien hy oortuig is dat 9.1 die toepaslike bepalings van hierdie Skema met betrekking tot die betrokke eenheid, die plantmateriaal of plante daarop gevestig of die plantmateriaal daarop verbou, nie nagekom is nie; 9.2 omstandighede heers of inligting aan die lig gekom het wat, indien dit vroeër geheers of aan die lig sou gekom het, die weiering om die betrokke eenheid te registreer, tot gevolg sou gehad het; 9.3 afwykende plante op die betrokke eenheid voorgekom; 9.4 n voedingsgebrek, uitdroging of fisiologiese, chemiese, hael-, koue-, insekof patogeenbeskadiging van die plante op die betrokke eenheid dit onmoontlik maak om die variëteitseienskappe van daardie plante of die voorkoms van insekte of patogene daarop behoorlik waar te neem; 7.2 The registration of any other unit shall lapse on the date determined by the authority at the time of registration thereof. 7.3 A registration which has lapsed in terms of section 7.1 or 7.2 shall be renewable in the manner set out in section 6 of this Scheme. 8. Transfer of registration [23; 24(1)(q)] 8.1 Subject to the provisions of section 8.3, the registration of a unit shall not be transferable to any other person. 8.2 If a participant transfers his right of disposal in a unit or the plants established thereon to another person, he shall forthwith notify the authority in writing thereof. 8.3 If a person to whom a right of disposal has been transferred as contemplated in section 8.2, desires to continue with participation in this Scheme in respect of the unit concerned, he shall forthwith lodge an application in accordance with section 6 of this Scheme for the registration of that unit in his name. 9. Withdrawal of registration [23; 24(1)(q)] The authority may at any time withdraw the registration of a unit if it is satisfied that 9.1 the applicable provisions of this Scheme with regard to the unit concerned, the plant material or plants established thereon or the plant material cultivated thereon have not been complied with; 9.2 circumstances prevail or information has come to light which, if it had prevailed or came to light earlier, would have resulted in a refusal to register the unit concerned; 9.3 deviating plants occur on the unit concerned; 9.4 a nutritional deficiency, drying-out or physiological, chemical, hail, cold, insect or pathogen damage of the plants on the unit concerned makes it impossible to properly observe the varietal properties of those plants or the occurrence of insects or pathogens thereon; Sagtevrugteskema laaste wysiging deur R. 42 van 28 Januarie

8 9.5 die betrokke deelnemer weier of versuim om die plantmateriaal wat op die betrokke eenheid verbou is, vir sertifisering aan te bied; 9.6 in die geval van n eenheid waarop plantmateriaal uit hoofde van n goedkeuring in artikel 11.2 van hierdie Skema bedoel, gevestig is, sodanige goedkeuring ingetrek is; of 9.7 die sertifisering van die plantmateriaal wat op die betrokke eenheid gevestig is, ingevolge artikel 20 van hierdie Skema ingetrek is. Vereistes vir eenhede [23; 24(1)(d)] n Eenheid moet ten tyde van die registrasie daarvan en te alle tye gedurende die termyn van registrasie daarvan, aan die toepaslike eenheidsvereistes voldoen wat in Bylae 1 in die geval van kern- en steenvrugte, en in Bylae 2 in die geval van tafel- en droogdruiwe, uiteengesit is. 11. Requirements for units [23; 24(1)(d)] A unit shall at the time of the registration thereof and at all times during the term of registration thereof, comply with the applicable unit requirements set out in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes. 11. Establishment requirements [23; 24(1)(g)] 11.1 Subject to the provisions of section 11.2 and 11.3, only certified plant material shall be used to establish plants on a unit with a view to the cultivation of plant material The authority may on application grant written approval that plant material obtained from plants that are included in a recognised evaluation programme, be utilised with a view to a cultivation of mother plants An approval referred to in section 11.2 shall be granted only if the authority is satisfied that the plant material concerned is true to variety and complies with the applicable phytosanitary requirements set out in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes [Subsection 11.4 deleted by R. 42 of 28 January 2011] 11.5 The plant material used to establish plants on a unit, and the plants thus established shall duidelik volgens kloon en variëteit be clearly identified according to clone geïdentifiseer word; and variety; Sagtevrugteskema laaste wysiging deur R. 42 van 28 Januarie

Vereistes vir plantmateriaal [23; 24(1)(i)] 12.1 Plantmateriaal wat op n eenheid verbou word, moet variëteitseg wees; aan die toepaslike fitosanitêre vereistes voldoen wat in Bylae 1 in die geval van kern- en steenvrugte en in Bylae 2 in die geval van tafel- en droogdruiwe, uiteengesit is; behalwe indien die gesag in n bepaalde geval anders bepaal, aan die toepaslike fisiese vereistes in Bylae 1 in die geval van kern- en steenvrugte, en in Bylae 2 in die geval van tafel- en droogdruiwe, uiteengesit is; en indien beoog vir sertifisering as synde van n kategorie in kolom 1 van die tabel hieronder vermeld, te wees, verkry wees van plante gevestig van plantmateriaal van n kategorie in kolom 2 van genoemde tabel daarteenoor vermeld: be cared for in a manner which is conducive to obtain plant material of a high quality; be established in such a manner that shoots of plants of different clones will not intertwine; in the case of grafted plants, be kept free of shoots that have developed from the rootstock portion thereof; not be overgrown by weeds; be true to variety; and comply with the applicable phytosanitary requirements set out in Schedule 1 in the case of pome and stone fruit, or in Schedule 2 in the case of table and drying grapes A participant shall remove all deviating plants and suspected deviating plants from a unit on a continuous basis, or mark such plants appropriately. 12. Requirements for plant material [23; 24(1)(i)] 12.1 Plant material cultivated in a unit shall be true to variety; comply with the applicable phytosanitary requirements set out in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes; except if the authority determines otherwise in a particular case, comply with the applicable physical requirements set out in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes; and if intended for certification as being of a category specified in column 1 of the table hereunder, be obtained from plants established from plant material of a category specified in column 2 of the table opposite thereto: Sagtevrugteskema laaste wysiging deur R. 42 van 28 Januarie

Nursery plants Nucleus plants Foundation plants Mother plants 12.2 Notwithstanding the provisions of section plants cultivated from plant material in respect of which an approval was granted in terms of section 11.2 of this Scheme shall be deemed to be mother plants; and the authority may on application grant written approval that plant material obtained from mother plants may be utilised for the cultivation of mother plants. 13. Inspection of units [23; 24(1)(h)] 13.1 The plants established on a unit with a view to the cultivation of nucleus plants or foundation plants shall be inspected annually by the authority during the early active growth stage thereof; the early leaf fall stage thereof; and the dormant stage thereof The plants established on a unit with a view to the cultivation of mother plants shall be inspected by the authority at least once per year; and such inspections shall be made annually on an alternate basis at the stages referred to in subsection (1). Opberging van plantmateriaal [23; 24(1)(k)] Plantmateriaal wat vir sertifisering beoog word of gesertifiseer is, moet te alle tye op so n wyse opgeberg word dat 14.1 dit teen fisiologiese en fisiese beskadiging beskerm word; 14.2 die plantmateriaal wat op verskillende eenhede verbou is, duidelik en opvallend geïdentifiseer kan word; 14.3 die plantmateriaal van verskillende klone en variëteite duidelik en opvallend geïdentifiseer kan word; en 14.4 dit afsonderlik van plantmateriaal gehou word wat nie vir sertifisering beoog word nie. 15. Verwydering van plante of lote [23; 24(1)(g), (q)] 15.1 Kwekeryplante mag nie voor die sertifisering daarvan, sonder die skriftelike goedkeuring van die gesag, van die eenheid waar dit verbou is of uit die bewaring van die betrokke deelnemer verwyder word nie n Goedkeuring in artikel 15.1 bedoel, word slegs verleen indien die betrokke kweker beoog om die betrokke kwekeryplante vir sertifisering aan te bied by die perseel waarheen dit verwyder sal word The plants established on a unit with a view to the cultivation of nursery plants or foundation nursery plants shall be inspected annually by the authority during the early active growth stage thereof; the early leaf fall stage thereof; and the dormant stage thereof The authority may carry out as many additional inspections of a unit as it may deem necessary If the authority fails to carry out any inspection referred to in section 13.1, 13.2 and 13.3, the certification of the plant material cultivated on the unit concerned shall not be refused solely on account thereof. Storage of plant material [23; 24(1)(k)] Plant material intended for certification or having been certified shall at all times be stored in such a manner that 14.1 it is protected against physiological and physical damage; 14.2 the plant material cultivated on different units can be identified clearly and conspicuously; 14.3 the plant material of different clones and varieties can be identified clearly and conspicuously; and 14.4 it is kept separately from plant material not intended for certification. 15. Removal of nursery plants [23; 24(1)(g), (q)] 15.1 Nursery plants shall not, prior to the certification thereof, without the written approval of the authority be removed from the unit on which it was cultivated or from the custody of the participant concerned An approval referred to in section 15.1 shall be granted only if the person concerned intends to present the nursery plants concerned for certification at the premises to which it is to be removed. Bondels en houers [23; 24(1)(k), (l)] Plantmateriaal moet ten tye van die sertifisering daarvan 16.1 ooreenkomstig die toepaslike bondelvereistes uiteengesit in Bylae 1 in die geval van kern- en steenvrugte, en in Bylae 2 in die geval van tafel- en droogdruiwe, in bondels opgemaak wees; of 16.2 in houers gevestig wees. 17. Merk en etikettering van plantmateriaal [23; 24(1)(k)] 17.1 Grondveskwekeryplante en kwekeryplante van kern- en steenvrugte moet ooreenkomstig die merkvereistes in Deel 6 van Bylae 1 uiteengesit, gemerk word voordat dit uit die grond van die eenheid waarin dit gekweek is, uitgehaal word. [Subartikel 17.1 gewysig deur R. 42 of 28 Januarie 2011] 17.2 Elke bondel of houer plantmateriaal moet van n etiket voorsien wees wat op aanvraag van die gesag verkrygbaar is Die bedrag vir die doel deur die gesag bepaal, is betaalbaar ten opsigte van etikette wat aldus uitgereik is Nadat die betrokke kweker die toepaslike besonderhede op sodanige etikette aangeteken het, moet hy dit aan die betrokke bondels of houers heg op die wyse deur die gesag bepaal Nursery plants removed in terms of such approval shall be suitably identified at the time of the removal thereof A participant to whom such approval was granted shall forthwith notify the authority in writing of the date on which the nursery plants concerned were removed; the quantity of nursery plants thus removed; the address of the premises to which those nursery plants were thus removed, and the name of the owner of the premises concerned; and the particulars used to identify those nursery plants. 16. Bundles and containers [23; 24(1)(k), (l)] Plant material shall at the time of the certification thereof be made up in bundles in accordance with the applicable bundle requirements set out in Schedule 1 in the case of pome and stone fruit, and in Schedule 2 in the case of table and drying grapes; or 16.2 be contained in containers. 17. Marking and labelling of plant material [23; 24(1)(k)] 17.1 Foundation nursery plants and nursery plants of pome and stone fruit shall be marked in accordance with the marking requirements specified in Part 6 of Schedule 1 before it is lifted from the soil of the unit on which it is grown. [Subsection 17.1 amended by R. 42 of 28 January 2011] 17.2 Each bundle or container of plant material shall be provided with a label that is obtainable on request from the authority The amount determined by the authority for this purpose shall be payable in respect of labels thus issues After the grower concerned has entered the applicable particulars on such labels, he shall affix it to the bundles or containers concerned in the manner determined by the authority. 13 17.5 Die letters en syfers wat gebruik word om die betrokke besonderhede op sodanige etikette aan te dui, moet van n lettertipe wees wat maklik leesbaar is; van n kleur wees wat duidelik kontrasterend is met die kleur van die etikette waarop dit verskyn; en onuitwisbaar aangebring word Geen ander besonderhede as die wat vereis word om op n etiket in artikel 17.2 bedoel, aangedui te word, mag op so n etiket verskyn nie. 18. Sertifisering van plantmateriaal [23; 24(1)(j)] 18.1 n Kweker moet die gesag minstens twee dae vooraf in kennis stel van die datum waarop kwekeryplante gereed sal wees om vir sertifisering aangebied te word Die gesag moet op of so spoedig moontlik na die datum waarvan hy in kennis gestel is, die betrokke kwekeryplante ondersoek ten einde te bepaal of dit gesertifiseer kan word Die sertifisering van plantmateriaal word bevestig deur middel van n sertifikaat in die vorm deur die gesag bepaal n Etiket wat ingevolge artikel 17 van hierdie Skema aan plantmateriaal geheg is, dien as bewys van die sertifisering van daardie plantmateriaal Behoudens die bepalings van artikel 22 van hierdie Skema, kan die gesag, indien hy weier om plantmateriaal te sertifiseer, die etikette wat aan die betrokke plantmateriaal geheg is, vernietig, of die betrokke deelnemer gelas om dit te vernietig. 19. Aantekeninge en opgawes [23; 24(1)(m)] 19.1 Elke kweker moet die volgende besonderhede betreffende plantmateriaal wat deur hom aan iemand anders uitgereik is, aanteken: Die naam en adres van elke persoon aan wie n hoeveelheid van daardie plantmateriaal uitgereik is Die benaming van die variëteit en kloon wat uitgereik is The letters and figures used to indicate the particulars concerned on labels shall be of a letter type that can easily be read; be of a colour that is in clear contrast with the colour of the labels on which they appear; and be entered indelibly No particulars other than those required to be indicated on a label referred to in section 17.2 shall appear on such label. 18. Certification of plant material [23; 24(1)(j)] 18.1 A grower shall notify the authority at least two days in advance of the date on which nursery plants will be ready to be presented for certification The authority shall on or as soon as possible after the date of which it has thus been notified, inspect the nursery plants concerned in order to determine whether it may be certified The certification of plant material shall be confirmed by means of a certificate in the form determined by the authority A label attached to plant material in terms of section 17 of this Scheme shall be proof of the certification of that plant material Subject to the provisions of section 22.4 of this Scheme, the authority may, if it refuses to certify plant material, destroy the labels attached to the plant material concerned, or direct the participant concerned to destroy it. 19. Records and returns [23; 24(1)(m)] 19.1 Each participant shall record the following particulars relating to plant material issued by him to another person: The name and address of each person to whom a quantity of that plant material has been issued The denomination of the variety and clone that has been issued. Intrekking van sertifisering [23; 24(1)(j)] 20.1 Die gesag kan te eniger tyd die sertifisering van plantmateriaal intrek indien hy oortuig is dat The quantity of plant material from each variety and clone issued to each person The category referred to in section 12.1 of this Scheme, of each quantity of that plant material issued Each participant shall record the following particulars relating to each lot of certified plant material received by him: The name and address of the person from whom such lot was received The denomination of the variety and clone of that plant material The quantity of each type of plant material thus received Each participant shall record the following particulars relating to labels issued to him in terms of section 17.2 of this Scheme: The number of unused labels carried over from the previous year The number of labels received by him during the year concerned The number of labels affixed to plant material during that year The number of labels damaged or destroyed during that year The number of unused labels in stock at the end of that year Each participant shall submit to the authority annually, on the dates determined by the authority, a return on a form and in a manner determined by the authority, of the particulars recorded in terms of this section. 15 die betrokke plantmateriaal nie variëteitseg is nie, of nie aan die toepaslike vereistes in artikel 12 van hierdie Skema uiteengesit, voldoen nie; of enige ander bepaling van hierdie Skema met betrekking tot die betrokke plantmateriaal nie nagekom is nie n Deelnemer wat van die intrekking van die sertifisering van plantmateriaal in kennis gestel is, moet onverwyld die etikette in artikel 17.2 van hierdie Skema bedoel, van die betrokke plantmateriaal wat nog in sy bewaring is, verwyder en en in sy bewaring hou; [Subparagraaf gewysig deur R. 42 van 28 Januarie 2011] elke persoon aan wie n hoeveelheid van die betrokke plantmateriaal gelewer is, skriftelik van die intrekking van die sertifisering daarvan in kennis stel, en elke sodanige persoon skriftelik versoek om sodanige etikette van daardie betrokke plantmateriaal te verwyder; en [Engelse teks gewysig vir korreksie deur R. 42 van 28 Januarie 2011] die gesag van n afskrif van elke sodanige kennisgewing deur hom uitgereik, voorsien Die gesag kan die tersaaklike besonderhede van die intrekking van die sertifisering van plantmateriaal en die naam en adres van die kweker wat daardeur geraak word, by kennisgewing in die Staatskoerant bekend maak. 21. Ondersoeke [23; 24(1)(o)] 21.1 Die ondersoekbevoegdhede in artikel 25(1) van die Wet bedoel, word hierby vir die doeleindes van die toepassing van hierdie Skema aan die gesag en aan iemand wat skriftelik deur die gesag gemagtig is om enige voorskrif van hierdie Skema af te dwing, verleen Iemand wat kragtens artikel 21.1 optree, kan van die eienaar of persoon in beheer van die betrokke plek, perseel of voertuig alle redelike bystand eis wat so iemand nodig ag om hom in staat te stel om die betrokke ondersoek uit te voer of n ander handeling in verband met die toepassing van hierdie Skema te verrig the plant material concerned is not true to variety, or does not comply with the applicable requirements set out in section 12 of this Scheme; or any other provision of this Scheme with regard to the plant material concerned has not been complied with A participant who has been notified of the withdrawal of the certification of plant material shall forthwith remove and retain the labels referred to in section 17.2 of this Scheme, from the plant material concerned that is still in his custody; [Subparagraph amended by R. 42 of 28 January 2011] notify each person to whom a quantity of the plant material concerned has been delivered, in writing of the withdrawal of the certification thereof, and request each such person in writing to remove such labels from that plant material; and [Subparagraph amended by R. 42 of 28 January 2011] provide the authority with a copy of each such notice issued by him The authority may by notice in the Government Gazette make known the relevant particulars of the withdrawal of the certification of plant material and the name and address of the grower effected thereby. 21. Inspections [23; 24(1)(o)] 21.1 The powers of inspection referred to in section 25(1) of the Act are hereby for the purpose of the application of this Scheme granted to the authority and to any person authorised in writing by the authority to enforce any provision of this Scheme A person acting under section 21.1, may demand from the owner or custodian of the place, premises or vehicle concerned all reasonable assistance that such person may deem necessary to enable him to carry out the inspection concerned or to perform any other act in connection with the application of this Scheme.
