1 CITY OF DETROIT LAKES VARIANCE The Planning Commission, after conducting a hearing in the matter of granting a Variance Request under the provisions of the Zoning Ordinance of the City of Detroit Lakes, has recommended that the City Council issue to Larry Sawaya, a Variance to allow construction of a 20 x 30 foot garage with a 2 foot side yard setback at 1578 West Lake Drive on the following described property: That part of Government Lot 2, Section 9, Twp. 138 N Range 41 W. of the 5th P.M. in Becker Co., Minn., described as follows: Commencing at a found iron monument, which designates the East Quarter corner of said Section 9; thence N. 01 degree 08 minutes 16 seconds W ft. on an assumed bearing along the East line of said Section 9 to a found iron monument; thence n. 74 degrees 40 minutes 29 seconds W ft. to a found iron monument, said point is the point of beginning; thence S. 11 degrees 07 minutes 09 seconds W ft. to an iron monument on the NE'ly line of CSAH No. 22; thence N. 48 degrees 02 minutes 57 seconds W ft. along the northeasterly line of said CSAH No. 22 to an iron monument; thence N. 16 degrees 18 minutes 47 seconds E ft.; thence N. 22 degrees 40 minutes 27 seconds E ft. to an iron monument; thence continuing N. 22 degrees 40 minutes 27 seconds E.14 ft., more or less, to the water's edge of Detroit Lake; thence Easterly along the water's edge of Detroit Lake to the intersection with a line which bears n. 11 degrees 07 minutes 09 seconds E. from the point of beginning; thence S. 11 degrees 07 minutes 09 seconds W. 8 ft., more or less, to an iron monument; thence continuing S. 11 degrees 07 minutes 09 seconds W ft. to the point of beginning. Dear Mr. Sawaya: I met with your contractor today to discuss a stormwater management plan for the site. However, upon reviewing the site and further discussing your plans with the contractor, I would like to bring to your attention the following items for your consideration. First of all, when meeting with landowners or their designated representatives (contractors), I like to find out what the desired use of the property is and possible future plans (i.e., permanent residence, seasonal residence). By having a master plan, future surprises can be avoided. Please be aware under the City of DL ordinance, a riparian lot is allowed up to 25% impervious surface lot coverage. While I believe at this point, lot coverage is not a concern with your plans to replace the garage, I urge you to calculate what your lot coverage will be if you decide to place concrete or asphalt on the driveway. As I understand it, the placement of the new garage will be built in approximately the same area as the existing garage, however the doors on the new structure will be placed on the south side. The driveway will enter in from the southwest corner of the lot and curve across the lot to the north and into the garage. This proposed configuration will create a considerable driveway area. If you would like to blacktop or place concrete on the driveway, you may be significantly over the allowable lot coverage. In that case, another variance would have to be applied for. If you intend on paving the driveway, but calculate you would be over the allowable impervious surface lot coverage, you may want to re-consider your current plans and place the new structure on the south side of the lot, therefore reducing the amount of driveway surface area. Another consideration would be to build in the same location, but face the doors to the west and have the driveway enter in from the northwest corner, however, traffic patterns may make that option less desirable. Of course, you may leave the driveway as it is with no asphalt or concrete. Other options include using surfacing products that are considered pervious (uni-stone, eco-stone, etc.) If you are not planning to add-on to your current home in the future or asphalting the driveway, then the above options may be of no consequence to you. Your contractor is planning discussing these items with you. Should you decide to build the garage and redesign driveway as planned, we will promptly devise an approved stormwater management plan.
