6 Ohio Ohio law allows mayors of municipal corporations populated by more than 100 people that are not the site of a municipal court to conduct mayor s court. These courts, which are not courts of record, hear only cases involving violations of local ordinances and state traffic laws. Those convicted in a mayor s court may appeal their conviction to the municipal or county court having jurisdiction within the municipal corporation. Ohio law does not require mayors who hear cases to be attorneys. Section of the Ohio Revised Code, effective Jan. 1, 2004, requires mayor s courts to register annually and file statistics quarterly with the Supreme of Ohio. At the request of the Ohio General Assembly, the Supreme adopted rules providing court procedures and basic legal education for mayors who hear cases. Furthermore, mayors whose courts hear alcohol- and drug-related traffic offenses have additional educational requirements. In 2009, there were 330 municipal corporations operating mayor s courts that registered and reported activity to the Supreme. 1 The populations of those municipal corporations are broken down in the table below: s Percentage 101 to % 500 to % 1,000 to 4, % 5,000 to 9, % 10,000 to 19, % 20,000 to 29, % 30,000 to 39, % 40,000 or more 2 0.6% 1 Two municipalities, the village of Brice and the village of West Millgrove, previously submitted registration information for 2009 despite having 2000 Census populations each of less than 100 persons. Because neither municipality fulfills the court operational criteria specified in R.C , they do not appear in this report. 1

8 General Notes s with Incomplete, Missing or Unusable Data The following mayor s courts first became active midway through 2009, and therefore, submitted quarterly caseload reports for only part of the year: Grover Hill (first became active in the third quarter) Newtonsville (first became active in the third quarter) Rising Sun (first became active in the third quarter) The following mayor s courts did not submit a full set of quarterly reports and have notified the Supreme that they are no longer active: Amsterdam (last report received was for first quarter) Adena (last report received was for second quarter) Bradford (last report received was for third quarter) The following mayor s court did not submit a full set of quarterly reports even though its most recent quarterly report showed cases pending at the end of that quarter: Rio Grande (last report received was for second quarter) The following mayor s courts registered for 2009, but did not submit quarterly reports amenable for inclusion into this report as a result of invalid data: Gratis Wayne The following mayor s court registered for 2009, but did not submit quarterly reports: Coolville Definition of Clearance Rate A court s clearance rate is a measure of its ability to keep up with its incoming caseload. The clearance rate, expressed as a percentage, is calculated by dividing the total number of terminations by the total number of new filings, transfers and reactivations. The calculation does not include cases pending at the beginning of the year. Data All population figures contained in this report are based on the 2000 U.S. Census. 3
