Public Hearing: T cnsider the Planning Cmmissin s recmmendatin in regard t amending the ning text, specifically the B-2 Central Business District, Sectin (L) Permitted Cnditinal Uses. The applicant, Dylan llis, seeks t allw vehicle twing in the B-2 Central Business District as a permitted cnditinal use (Advertised Time: 5:30 p.m.) Backgrund: Dylan llis made a request t amend the ning text t allw vehicle twing as a permitted cnditinal use in a B-2 District. The Planning Cmmissin met n Nvember 5 th and have frwarded a recmmendatin f apprval with the fllwing cnditins: Vehicle Twing Service a. Prvided that, vehicles shall nly be stred n-site, pending settlement r legal dispsitin f vehicles by insurance carrier and/r wner; b. All twed and stred vehicles shall be stred inside a building; c. N demlitin f twed r stred vehicles shall be allwed; and d. All stred vehicles shall be wned by persns ther than the twing service wner/peratr and/r land wner. 6. 2 Backgrund: The Nebraska Department f Rads sends the same agreement each year t every Nebraska city, twn and village that has a NDOR right-f-way thrugh it. Attachment A (1 st Class Cities) clarifies the duties f the NDOR and the duties f the City fr care and maintenance f the highway inside the city limits. n this agreement, we agree t pay NDOR $2, per lane mile r $4, in 2019 fr the surface maintenance n 2.35 lane miles f highway thrugh Wayne. Last year, it was $1,575 per lane mile, ttaling $3, Actin t select an alternate date fr the first Cuncil meeting in January (which falls n New Year s Day) January 3 rd r 4 th Backgrund: Since the first Cuncil meeting in January falls n New Year s Day, an alternate date needs t be selected. Pursuant t City Cde, the chices are either the preceding Mnday r subsequent Wednesday r Thursday. The assumptin abve is that yu wuld nt want t meet n New Year s ve. 10.
