3 Introduction The Restricted Substances List (RSL) 1 applies to all Levi Strauss & Co. (LS&CO.) products, including apparel, non-apparel, accessories and other products. The RSL also applies to all materials, parts, chemicals and other goods (including sundries) supplied for use in producing LS&CO. apparel, accessories and other products. The RSL is an important part of LS&CO. s product stewardship and environmental sustainability programs, and must be shared with all sources of materials, parts, chemicals and other goods, supplied for use in producing LS&CO. apparel, accessories and other products. Each source is required to agree to and declare whether the materials, parts, chemicals and other goods supplied or otherwise delivered to LS&CO. comply with the prohibitions, limitations and other requirements described or referred to in the RSL. Purpose of the List LS&CO. cares about consumers and the environment, and we recognize our suppliers as critical partners in meeting our commitments in the area of consumer safety and environmental protection. We publish this list in order to provide up-to-date information to our business partners, including direct sources and licensees, on product compliance with international consumer products regulations, to the best of our knowledge. The 2008 updates to the RSL program also include a list of substances which should be phased-out by factories to promote environmental sustainability (Chemical Phase-out List, Section 3). Using the List This list contains four core sections: Restricted Substances requirement (Section 1 & 2), Chemical Phase-out List (Section 3), REACH (Section 4) and Compliance Agreements (Section 5). The appendices provide supplementary guidance to assist our business partners in understanding and complying with the RSL requirements. We strongly recommended that our suppliers and business partners study this document carefully and communicate the information to their internal sourcing and production teams. As a supplier of LS&CO. products or raw materials for LS&CO. products, you are required to understand the RSL product standards and deliver only compliant products. You are also responsible for seeking guidance from LS&CO. in any situation where you may have doubts or uncertainties about your product s compliance with LS&CO. s RSL product standards. Compliance with LS&CO. s RSL product standards is a mandatory condition for each and every order placed by LS&CO. 1 Substances described herein are listed for a variety of regulatory, scientific and/or other reasons. The presence of a substance on this list should not be interpreted as suggesting that human exposure to that substance may or will cause any adverse health effect. 5 Section 1: Substances Which May be Found in Some Apparel, Accessories and Other Products Application The prohibitions and restrictions listed in this section apply to all LS&CO. products, including all materials, parts, chemicals, and other goods, supplied for use in LS&CO. products. Purpose The safety of LS&CO. products is of paramount importance to LS&CO. and we will only place safe and compliant products on the market. This section identifies the substances of primary interest to LS&CO. and presents those substances along with the corresponding prohibitions or limitations. In addition, analytical test methods for use by the LS&CO. approved laboratory are given for each substance. LS&CO. may test materials, parts, chemicals, and other goods, for these substances. LS&CO. suppliers and other contractors have a non-delegable duty to comply with the prohibitions and limitations; and must execute an appropriate Source Compliance Agreement and/or Chemical Source and Supplier Compliance Agreement in the form set forth in Section 5 of this document. The presence of a substance on the Restricted Substances List or on any previous RSL should not be interpreted as suggesting that the substance is or ever was present in any LS&CO. apparel, accessory or other product. Outline of LS&CO. RSL Prohibitions, Limitations and Requirements Details of the LS&CO. s Restricted Substance List are included on the following pages and are separated into sections covering specific chemical groups or product types. 6 Section I: Substances which may be found in some apparel, accessories and other products Sources Management System Approach Supporting RSL Compliance at the Factory Replace unknown chemicals with chemicals that meet LS&CO. s RSL. Do not ship products if you are in doubt about the product s compliance. Verify RSL compliance through laboratory testing and in consultation with LS&CO. Contact LS&CO. s RSL team with any questions or to request training. Communicate with and educate internal staff responsible for product development and chemical management. Communicate LS&CO. s RSL to all of your suppliers. Understand all the chemical inputs to your production by reviewing MSDSs. Communicate with your chemical suppliers, ensuring they are aware of all the chemicals and other goods that they supply have to comply with the prohibitions and restrictions listed on the RSL. Validate only chemicals meeting the RSL requirements are used on LS&CO. products. Regularly check process control variables (curing temperatures, liquor ratios, recipes) to validate proper chemical application. Perform analytical laboratory testing whenever any doubt arises regarding your product s compliance (or the compliance of any raw material) to LS&CO. s RSL, or when otherwise required by LS&CO. Sign and return the Source Compliance Agreement / Chemical Source and Supplier Compliance Agreement. Purchase only materials, parts, chemicals, and other goods, which comply with LS&CO. s RSL requirements. Request Material Safety Data Sheets (MSDS) from your chemical suppliers for every chemical purchased. Obtain a completed Chemical Information Log from your chemical suppliers. Contact all your chemical and raw material suppliers to ensure their understanding of LS&CO. s RSL and their commitment to supplying only RSL-compliant chemicals and materials. Purpose The purpose of this section is to identify substances not commonly found in apparel, non-apparel, accessories or other products, but are nonetheless restricted from LS&CO. products by law. As with Section 1, this section notes whether each listed substance is prohibited or limited, and details the appropriate test method for determining RSL compliance. Suppliers and contractors commit to implementing best business processes to achieve compliance with the restrictions in this section. A. 21 Section 3: Chemical Phase-Out List Application This Chemical Phase-Out List applies to chemicals used in the manufacture of LS&CO. products and raw materials. Suppliers are encouraged to find alternatives to the substances listed below. While LS&CO. prefers the following substances are not used in the manufacture and production of products, we acknowledge certain challenges may prevent an immediate cessation of use. LS&CO. will continue to support efforts to identify alternatives to these phase-out chemicals with the goal of prohibiting their use at a future time. Purpose Since its inception, the RSL has been a critical tool in LS&CO. s ability to achieve the company s consumer-safety and regulatory-compliance objectives. We believe that the RSL can also be a tool for helping the company to meet our goals in the area of environmental sustainability. In an effort to build sustainability deeper into our business, LS&CO. has created a list of substances to be phased out of LS&CO. production on the basis of their recognized or potential impacts to the environment and natural ecosystems. The five substances listed are selected for phase-out due to their environmental footprint: Alkylphenol ethoxylates (APEOs) APEO may be found in detergent, soap or chemical mixtures as surfactant. APEO-free detergents or chemical mixtures are available in most areas of the world. Each product manufacturer should contact their chemical suppliers to understand if APEOs are present in currently used chemicals and to inquire about APEO-free alternatives. Bisphenol-A Bisphenol-A is not likely to be used in the production of textile products, however bisphenol-a may be found in plastics such as polycarbonate plastic and epoxy resins. LS&CO. recommends suppliers of plastic and epoxy resin products to cease use of bisphenol-a by contacting chemical companies and raw material suppliers to inquire of bisphenol-a free products. Octamethylcyclotetrasiloxane (D4 siloxane) Octamethylcyclotetrasiloxane may be found in residual traces in certain silicone softeners. LS&CO. prefers silicone softeners that have been manufactured to minimize the residual amount of octamethylcyclotetrasiloxane. Minimizing octamethylcyclotetrasiloxane in silicone softeners requires accurate process control during softener chemical synthesis. Therefore it is imperative this preference is communicated to your softener suppliers. levi strauss & co. 19

22 Section 3: Chemical Phase-Out List 4. Phthalates Phthalates are used as a plasticizer in Polyvinyl chloride (PVC), imparting soft and flexible properties to the PVC. Phthalate use is prohibited for children products. LS&CO. also encourages suppliers to use phthalate-free chemicals for adult products. Phthalate-free chemicals are readily available in the market. 5. Polyvinyl chloride (PVC) PVC may be found in screen printing and in packaging materials. Typically plastisol screen printing means PVC-based printing. Suppliers of screen printing services should contact the supplier of printing binders and pigments to fully understand the PVC content. 23 Section 3: Chemical Phase-Out List Sources Management System Approach Supporting Chemical Phase-out at the Factory Determine chemical composition of each substance used in production by contacting the chemical manufacturer and reviewing the Material Safety Data Sheet (MSDS). Determine whether any of the substances listed on LS&CO. s Chemical Phase-out List are used in production or present in any purchased chemicals. Make changes in chemical use to eliminate chemicals listed on the Chemical Phase-out List. Communicate to LS&CO. if you have difficulties finding alternatives, or if you have found an alternative chemical that LS&CO. should know about. Communicate to LS&CO. s RSL team on the timeline when the chemicals listed in Chemical Phase-out List will be phased out in production. Ensure the replacement chemical does not violate other provisions of the RSL. Contact chemical suppliers other than your current chemical suppliers to check if they may offer alternative chemicals that do not contain any of the phase-out substances. Consult with supplier or chemical manufacturer to identify replacement chemicals for those listed on the Chemical Phase-out List. 24 Section 4: REACH The European Communities Regulation Concerning the Registration, Evaluation, Authorisation and Restriction of Chemicals Application This section applies to all suppliers manufacturing or supplying materials, parts, chemicals and other goods supplied for use in LS&CO. apparel, accessories and other products, which are intended for sale in any European Union member state. Purpose The information provided below is intended to assist our suppliers with respect to compliance with REACH (Regulation (EC) Number 1907/2006 of the European Parliament and of the Council). Every LS&CO. supplier has a non-delegable duty to comply with REACH. In supplying this information, LS&CO. does not intend to assume all or any part of our suppliers duty to comply with the regulation. What Suppliers Should Do: All LS&CO. suppliers shall visit the European Chemicals Agency (ECHA) website ( regularly and comply with the published obligations and guidance regarding consumer articles. Suppliers should map each step in their supply chains, including the sourcing and processing of raw materials, parts, chemicals and other product ingredients to be informed about the presence of any Substance of Very High Concern 36 (SVHC) and able to immediately demonstrate to LS&CO. or a designated party that no SVHCs are present over 0.1%, calculated by weight on the entire product. Suppliers shall maintain comprehensive data regarding such information in their respective supply chains. The Information Duty Article (Article 33) of REACH mandates full transparency and efficient communication regarding chemicals within the complete supply chain. It is therefore imperative that LS&CO. suppliers of products intended for Europe have a thorough understanding of the chemicals used during the manufacturing of the raw materials used and can validate that no SVHCs are present over the 0.1% threshold. Suppliers should immediately discuss REACH with their chemical suppliers and discuss their intent to only purchase chemicals that do not contain any SVHCs. All suppliers to LS&CO. shall immediately notify LS&CO. (by contacting your regional RSL representative or rsl@levi.com) if any SVHC in a quantity higher than 0.1% may be present in a product supplied to LS&CO. 36 Substances of Very High Concern (SVHC) are defined as CMR 1, CMR 2, PBT or vpvb substances. Ask for immediate assistance from external legal counsel or REACH expert in case of any question. If any restricted substances or SVHC are found on the product, check process controls and check for contamination. Substitute raw materials, parts, chemicals and other components as necessary for compliance. Allocate resources for REACH compliance. Set up process control and management system for REACH / RSL compliance. Determine whether any material or production process would preclude production or the final LS&CO. product from meeting REACH/RSL requirements. Check if any chemical substances used in production need to be immediately registered. Check chemical inventory with original supplier to determine whether all substances are free from SVHC and meet other REACH/RSL requirements. Send samples to approved laboratories for testing to confirm the products are free of SVHC and meet other applicable REACH and RSL requirements. Check regularly the ECHA web site and follow the published obligations and guidances. Map out sourcing network. Purchase raw materials / chemicals which do not contain SVHC. Communicate REACH requirements throughout the supply chain. Communicate REACH/RSL requirements to chemical suppliers. Conduct internal staff training in order to raise the awareness of REACH. ( Sources ) All contractors and direct suppliers to LS&CO., including agents and licensees (hereinafter Sources ) shall agree to, and declare their compliance with, the LS&CO. RSL by signing and returning the Source Compliance Agreement. Additionally, Sources shall require their chemical suppliers to execute the Chemical Source and Supplier Compliance Agreement and accompanying the Chemical Information Log (CIL). The executed agreements and the CIL shall be sent to LS&CO. by (rsl@levi.com) or by facsimile ( ). 2. Chemical Suppliers LS&CO. requires chemical suppliers to execute the LS&CO. Chemical Source and Supplier Compliance Agreement by signing and returning it to LS&CO. by (rsl@levi.com) or by facsimile ( ). The chemical supplier shall also send a copy of the signed agreement to the Source (factory) that uses their chemicals. Chemical suppliers shall review LS&CO. s RSL to determine which substances in their preparation (chemical mixtures), if any, may violate LS&CO. s RSL policy. The Chemical Information Log (CIL) that accompanies the Chemical Source and Supplier Compliance Agreement shall be completed for each preparation used in the manufacture of any LS&CO. product. The CIL includes 6 columns. The first column should be completed with the chemical trade name, as indicated on product packaging documents, MSDS and label. For each preparation, the chemical supplier shall indicate whether such chemical: (1) contains an RSL substance, or (2) may form an RSL substance during normal processing conditions. When a preparation contains, or may form, an RSL substance in a concentration that could cause an LS&CO. product to exceed corresponding RSL restrictions, the chemical supplier should indicate this by identifying the RSL substance and concentration on the CIL. Accessories can include both apparel and non-apparel products such as belts, caps, shoes, handbags, gloves, socks, scarves, eyewear, watches, home textile products, and wallets. The examples covered here are neither exhaustive nor all inclusive, they simply provide examples of products defined as accessories. All accessories are covered by LS&CO. s RSL. Allowable Trace (TR) The allowable trace is identified by the TR designation in the Limit Value column. The trace amount represents the permitted unavoidable trace presence of a substance that is allowed to be found on the garment when the substance has been prohibited from use. Article Means an object which during production is given a special shape, surface or design which determines its function to a greater degree than does its chemical composition. Chemical Abstract Service (CAS) Number The CAS number is a unique number that identifies a particular chemical structure. While there may be various synonyms for a chemical and different naming conventions, there is only one CAS number. Mixtures of chemicals do not have CAS numbers, only individual chemical components have CAS numbers. When there is doubt about the chemical name used in the RSL, always check the CAS number. Children s Products A children s product is that which is made for, marketed for use by, or marketed to, children age 12 and under. All Girls size 0-16 and Boys size 8-20 are included with the definition of children s products. Concentration Limit The concentration limit is set for each substance as measured on the final product and represents the maximum allowable amount of the respective substance which can be found in a RSL compliant product. The concentration limit is shown in the Limit Value column. The limit is specified as the amount of the substance on the amount of substrate, by weight (e.g., milligrams substance per kilogram of product [mg/kg]). Concentration limits are applicable to any single part of a garment or accessory, not an average over the whole product. Detection Limit The detection limit specifies the test method detection sensitivity that a laboratory must be able to achieve when measuring the substance in the product. LS&CO. 35 Appendix 2: Definitions Non-Apparel Products Non-apparel products are those that are made from materials other than fabric or leather. Some products included in non-apparel products are mobile phones, home furnishings, ties, hats, watches, jewelry, eyewear, and electronics. All non-apparel products are covered by LS&CO. s RSL. Plastisol Ink Plastisol ink may be used during screen printing. Plastisol inks are sold by the chemical supplier pre-mixed, meaning the color and the binder are purchased as one preparation. The vast majority of plastisol inks available on the market are based on polyvinyl chloride (PVC). Plastisol inks are also sometimes called solvent printing inks. Polyvinyl Chloride (PVC) Polyvinyl chloride, or PVC for short, is a hard plastic that may be found in packaging materials, flashers and screen printing. PVC is prohibited for use in packaging for all LS&CO. products. Alternatives to PVC packaging include polyurethane (PU), polyethylene (PE) and polyethylene terephthalate (PET). In addition, PVC screen printing utilizing phthalates is prohibited for children s products. Preparation Means a mixture or solution composed of two or more substances. Reporting Limit (RL) The reporting limit is the lowest concentration the laboratory is allowed to report. If the laboratory detects an amount of the substance below the RL, the laboratory report must state Not Detected. Sundries Sundries are attachments which are affixed to the garment. Sundries may include zippers, rivets, buttons, care labels, name labels, and tags. Usage Ban A usage ban is defined as a prohibition of intentional use of the substance during any and all stages of product manufacturing. However, the RSL identifies an allowable trace amount of the substance due to unavoidable contaminant. Water-based Printing Water-based inks and binders are used during screen printing. The ink and binder are sold separately and must be mixed at the printing factory to obtain the required color. 36 Appendix 3: Product Testing LS&CO. currently maintains various product testing programs to validate RSL compliance. Notwithstanding LS&CO. s testing programs, the supplier shall be fully responsible for obtaining all necessary knowledge and information required to understand and execute business processes that ensure RSL compliance. The supplier is also responsible for performing analytical testing on products to verify the product s compliance to all RSL requirements. The supplier should test products only at LS&CO. approved laboratories (Appendix 10), following the prescribed process for sending samples to the laboratories (Appendix 9). Products shall be tested as prescribed in the following tables. Table A provides testing guidance based on material type. Table B provides testing guidance based on finish type; and Table C provides testing guidance for screen prints. 44 Appendix 7: Guidance Regarding Phthalates in Screen Printing To phase out PVC and phthalates in screen printing chemicals, the printer must first understand if PVC or phthalates are used. To make such determination, the printer should consult with screenprint chemical suppliers and test the product for PVC and phthalates.
