AMENDMENTS TO URBAN RENEWAL PLANS AND AREAS ~ PUBLIC HEARING a) Consultation report. b) Public hearing on the proposed Amendment No. 6 to the amended and restated Urban Renewal Plan for the Mall and Highway 6 Urban Renewal Area. c) Consider resolution approving Amendment No. 6 to the amended and restated Urban Renewal Plan for the Mall and Highway 6 Urban Renewal Area. ENTRY SIGN WALL PROJECT 1 ST AVENUE AND 9 TH STREET ~ PUBLIC HEARING a) Public hearing on the plans, specifications, estimate of cost and form of contract for the Entry Sign Wall Project 1 st Avenue and 9 th Street. b) Consider resolution approving the plans, specifications, estimate of cost and form of contract; ordering bids; setting a date for the receiving of said bids; and directing published notice of the bid letting; all for the Entry Sign Wall Project 1 st Avenue and 9 th Street. Note: This project will construct a sign wall on the southwest corner of the 1 st Avenue and 9 th Street intersection. 8. LOT 1, DOVETAIL ESTATES, PART EIGHT ~ PUBLIC HEARING a) Building Department Report. b) Planning & Zoning Commission Report. 1

2 c) Public hearing on amending the Land Use of Lot 1, Dovetail Estates, Part Eight from Neighborhood Commercial Use to Low Density Residential Use. d) ORDINANCE NO An ordinance amending the Coralville Community Plan to reflect certain property generally known as Lot 1, Dovetail Estates, Part Eight, Coralville, Iowa to be designated as Low Density Residential Use in place of Neighborhood Commercial Use, for 1 st consideration. Note: This changes the land use to Low Density Residential Use for property located at the corner of East Grant View Drive and East Grant View Lane. 9. LOT 1, MEG S ADDITION a) Ordinance No An ordinance amending the Coralville Zoning Ordinance, the same being Ordinance No. 664, as previously amended, rezoning certain property located within the corporate limits of the City of Coralville, Johnson County, Iowa, and generally known as Lot 1, Meg s Addition from R-1, Single Family Residential District to C-PUD 2, Commercial Planned Unit Development Two District, for 3 rd and final consideration. b) Consider resolution approving the PUD-B Site Plan for Lot 1, Meg s Addition, Coralville, Iowa. Note: This 1.73 acre lot is located within the Oakdale Boulevard Overlay district east of the Agudas Achim Synagogue on Oakdale Boulevard ND STREET/WARDS SECOND COMMERCIAL SUBDIVISION a) Ordinance No An ordinance amending the Coralville Zoning Ordinance, the same being Ordinance No. 664, as previously amended, rezoning certain property located within the corporate limits of the City of Coralville, Johnson County, Iowa, and generally known as nd Street from C-2, Arterial Commercial District to C-PUD 2, Commercial Planned Unit Development Two District, for 3 rd and final consideration. b) Building Department Report. c) Planning & Zoning Commission Report. d) Consider resolution approving the preliminary plat for Wards Second Commercial Subdivision, Coralville, Iowa. e) Consider resolution approving the final plat for Wards Second Commercial Subdivision, Coralville, Iowa. Note: This property is located west of Randy s Carpet on the northwest corner of U.S. Highway 6 and 6 th Avenue. 11. CORAL CROSSING FIRST ADDITION a) Consider resolution accepting those municipal improvements for Coral Crossing First Addition, Coralville, Iowa. Note: This accepts the municipal improvements except sidewalks in Coral Crossing First Addition. 12. INTERMODAL LEASE AGREEMENT a) Consider resolution approving a Lease Agreement with Megabus USA, LLC at the Coralville Intermodal Facility. Note: This is a $ per month, one year lease agreement with an annual option to renew to use the premises and terminal area in the Coralville Transit Intermodal Facility for passenger waiting, pick-up and drop-off for Megabus USA, LLC. 2

CLEAR CREEK WATERSHED WATER SHED AUTHORITY 28E AGREEMENT a) Consider resolution approving a 28E Agreement between Coralville, Iowa; Iowa City, Iowa; North Liberty, Iowa; Oxford, Iowa; Tiffin, Iowa; Iowa County, Iowa; Johnson County, Iowa; Iowa County Soil & Water Conservation District; and Johnson County Conservation District to establish the Clear Creek Watershed Management Authority. Note: This 28E Agreement outlines each jurisdiction responsibilities and the goals for forming the Clear Creek Watershed Management Authority. 14. DEVELOPMENT AGREEMENT a) Consider resolution approving a Development Agreement with Jim Glasgow regarding the redevelopment of th Avenue. Note: This developer is required to demolish the building; construct certain sidewalk and street improvements; and reconstruct the stormwater drainage behind th Avenue. 15. OLD TOWN CORALVILLE a) Consider resolution approving an Agreement with DeLong Construction, Inc. regarding the relocation of the Old Town Coralville Stockpile. Johnson Mall and Highway 6 Urban Renewal Amendment On this agenda, there is Amendment No. 6 to the Amended and Restated Urban Renewal Plan for the Mall and Highway 6 Urban Renewal Area. A consultation among the taxing entities was held on Friday, July 17, 2015 and no representatives of any taxing entity did attend. As a reminder, this amendment adds four projects: 1) Briskey demolition; 2)demolition and preparation of site for redevelopment th Avenue; the Entry Wall and Monument project on Kum & Go site and 4) reconstruction of E. 2 nd Avenue located south of E. 9 th Street. WHEREAS, the City Council of the City of Coralville, via Resolution , passed and approved on February 26, 2013, adopted the Amended and Restated Coralville Urban Renewal Plan (also known as Amendment No. 4 to the Mall and Highway 6 Urban Renewal Plan ), said resolution and plan being recorded in Book 5168 at page 265, Records of the Johnson County Recorder; and WHEREAS, proposed Amendment No. 6 has been prepared and is attached hereto as Exhibit A and the required consultation among taxing entities and the public hearing have been held; and WHEREAS, it is now necessary for the City Council to approve the aforementioned amendment. NOW, THEREFORE, BE IT RESOLVED, by the City Council of the City of Coralville, Johnson County, Iowa, that the aforementioned Amendment No. 6 to the Amended and Restated Urban Renewal Plan for the Mall and Highway 6 Urban Renewal Area is hereby approved. 7 EXHIBIT A AMENDMENT NO. 6 TO THE AMENDED AND RESTATED MALL AND HIGHWAY 6 URBAN RENEWAL PLAN WHEREAS, the City Council of the City of Coralville, via Resolution , passed and approved on February 26, 2013, adopted the Amended and Restated Coralville Urban Renewal Plan (also known as Amendment No. 4 to the Mall and Highway 6 Urban Renewal Plan ), said resolution and plan being recorded in Book 5168 at page 265, Records of the Johnson County Recorder; and WHEREAS, pursuant to Chapter 403 of the Code of Iowa, cities need to specifically list the Urban Renewal Projects that will be funded using incremental tax revenues; and WHEREAS, the City Council has deemed it necessary and desirable to add an urban renewal project to the Amended and Restated Plan. NOW, THEREFORE, the Amended and Restated Urban Renewal Plan is hereby amended as follows: 1. 14 City of Coralville MEMORANDUM Date: 7/8/2015 To: From: Title: Mayor and City Council City Administrator Dan Holderness, P.E. City Engineer Re: Entry Sign Wall Project 1 st Ave. and 9 th St This project will construct an entry sign wall on the Kum & Go Convenience property on the southwest corner of the 1 st Ave. and 9 th St. intersection. This sign wall will match the existing sign walls constructed on the other three corners of this intersection. The public hearing for this project will be held on July 28 th, bids received on August 4 th, and anticipated award of the contract on the August 11 th regular council meeting. Construction will begin in September and be completed in November This schedule is coordinated with the reconstruction of the Kum & Go Convenience Store at this location. Page 1 of 1

WHEREAS, the City Council of the City of Coralville, Iowa, has heretofore deemed it necessary and desirable to build an entry sign on the southwest corner of the 1 st Avenue and 9 th Street intersection, which will match the other entry sign walls, the project having been referred to as the Entry Sign Wall Project 1 st Avenue and 9 th Street, hereinafter the Project ; and WHEREAS, the aforementioned plans, specifications, estimate of cost and form of contract for the proposed project were filed with the City Clerk for Council review and public inspection; and WHEREAS, public hearing on the above-described plans, specifications, estimate of cost and form of contract for the proposed Project has now been held, said public hearing having been preceded by proper published notice thereof as required by law. NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Coralville, Iowa, that the plans, specifications, estimate of cost and form of contract for the aforementioned Project is hereby approved. Be it further resolved that the City Staff and Administration be and the same are hereby authorized and directed to solicit bids for the project as follows: Bids for the aforementioned project shall be received by the City Clerk until 2 p.m., on Tuesday, August 4, Further, bid security for the aforementioned sealed bids is set at 5% of the bid price. 16 City of Coralville MEMORANDUM Date: July 21, 2015 To: From: Title: CC: Mayor City Council Kelly Hayworth Jim Kessler Building and Zoning Official City Attorney Re: Council Meeting July 28, 2015 Item # 8: Request by Request by Hodge Construction Co. for approval of a land Use Amendment for a part of Dovetail Estates Part Eight Lot One. Hodge is requesting to amend the land use for the northern.89 acres of Lot 1 for development as Low Density Residential as defined in the Oakdale boulevard Overlay Plan as 8 dwelling units or less per acre. This would compute to 7 dwelling units on this acreage. According to the overlay all units must have grade entrances. This would limit the building construction to a design consistent with the existing duplexes and townhouses. The remainder of the lot would remain as Low Intensity Commercial land use for development as Neighborhood Commercial in accordance with the Overlay Plan. The Planning and Zoning Commission recommended this for approval by a 7 0 vote. Page 1 of 1

18 ORDINANCE NO AN ORDINANCE AMENDING THE CORALVILLE COMMUNITY PLAN TO REFLECT CERTAIN PROPERTY GENERALLY KNOWN AS LOT 1, DOVETAIL ESTATES, PART EIGHT, CORALVILLE, IOWA TO BE DESIGNATED LOW DENSITY RESIDENTIAL USE IN PLACE OF NEIGHBORHOOD COMMERCIAL USE. BE IT ORDAINED AND ENACTED BY THE CITY COUNCIL OF THE CITY OF CORALVILLE, JOHNSON COUNTY, IOWA, AS FOLLOWS: Section 1. The Coralville, Iowa, Community Plan, which is hereby referenced in the City of Coralville Code of Ordinances (2011), as amended, is hereby amended by showing that certain.89 acre parcel described on Exhibit A attached hereto, to be designated as Low Density Residential Use in place of Neighborhood Commercial Use. Section 2. Conflicts. All ordinances or parts of ordinances not specifically provided for and in conflict with the provisions of this ordinance are hereby repealed. Section 3. Adjudication. If any section, provision, or part of this ordinance shall be adjudged to be invalid or unconstitutional, such adjudication shall not affect the validity of the ordinance as a whole or any section, provision or part thereof not adjudged invalid or unconstitutional. Section 4. Effective Date. City Engineer Clear Creek Watershed Coalition 28E Agreement I recommend approval of a 28E agreement creating and approving the City of Coralville s membership in the Clear Creek Watershed Coalition (CCWC). The Clear Creek Watershed Coalition is a Watershed Management Authority (WMA) as authorized in the State Code of Iowa. Watershed Management Authorities are an emerging approach to addressing flood and water quality issues in Iowa. Several WMAs have been formed over the past year and are currently engaging in planning efforts at the watershed scale. WMAs are intergovernmental cooperative agreements among cities, counties, and Soil & Water Conservation Districts, and typically involve other community stakeholders as well. I whole heartedly support the formation of Clear Creek Watershed Coalition to holistically approach flooding and water quality improvements in the entire Clear Creek watershed. The 28E agreement was created by representatives of the eligible public jurisdictions which include the cities of Coralville, Iowa City, North Liberty, Oxford and Tiffin; the counties of Iowa and Johnson; the Iowa County Soil & Water Conservation District; and the Johnson County Soil & Water Conservation District with the guidance of Jennifer Fencl with ECICOG. Creation of the CCWC allows member public entities opportunities to apply for planning and implementation grant funding. After the CCWC is formed, the intent is to apply for grant funds to create a watershed management plan which will then be used as a basis for implementation grant applications. Page 1 of 1

53 CLEAR CREEK WATERSHED COALITION ARTICLES OF AGREEMENT THIS AGREEMENT is made and entered into pursuant to Iowa Code Chapter 28E by and between the eligible political subdivisions that adopt these Articles of Agreement (hereinafter Agreement ), including the cities of Coralville, Iowa City, North Liberty, Oxford and Tiffin; the counties of Iowa and Johnson; the Iowa County Soil & Water Conservation District; and the Johnson County Soil & Water Conservation District (hereinafter Members ). WHEREAS, Chapters 28E and 466B of the Code of Iowa (2015), as amended, authorize the Members to establish a Watershed Management Authority to enable cooperation in watershed planning and improvements for the mutual advantage of the Members; and WHEREAS, pursuant to Section 466B.23 of the Code of Iowa (2015), said Watershed Management Authority may perform any or all of the following activities: 1. Assess flood risks in the watershed; 2. Assess the water quality in the watershed; 3. Assess options for reducing flood risks and improving water quality in the watershed; 4. Monitor federal flood risk planning and activities; 5. Educate citizens regarding water quality and flood risks; 6. Allocate monies made available to the authority for the purposes of water quality and flood mitigation; and 7. Make and enter into contracts and agreements and execute all instruments necessary or incidental to the performance of the duties of the authority; and WHEREAS, the Members have determined it is in their mutual best interest to enter into an agreement pursuant to Chapter 28E of the Code of Iowa (2015) to establish a Watershed Management Authority and to outline the responsibilities of the parties. NOW, THEREFORE, IN CONSIDERATION OF THE MUTUAL COVENANTS AND CONDITIONS CONTAINED HEREIN, THE MEMBERS AGREE AS FOLLOWS: SECTION 1 IDENTITY OF THE MEMBERS AND WATERSHED 1.1 The counties of Iowa and Johnson are each a political subdivision of the State of Iowa. SECTION 3 LEGAL STATUS 3.1 The CCWC shall be a voluntary joint undertaking of the political subdivisions within the Watershed pursuant to the provisions of Chapter 466B and 28E of the Code of Iowa. 3.2 It is the intention of this Agreement that there be no new or additional legal or administrative entity created by this Agreement, nor that the inherent governmental powers of any Member be affected in any way beyond the terms of this Agreement. SECTION 4 GOVERNING BODY 4.1 A joint board of the Members known as the Clear Creek Watershed Coalition Board of Directors (hereinafter Board ) shall be responsible for fulfilling the purpose of the CCWC. 4.2 Each Member shall be entitled to appoint one representative to serve on the Board and an alternate to serve in the place of the appointed representative in their absence. 4.3 The specific powers and duties of the Board shall be defined in the CCWC s by laws to address Board officers, terms, meetings, and administrative functions. 2

55 SECTION 5 DURATION 5.1 This Agreement shall be in effect in perpetuity until or unless terminated pursuant to Section 11. SECTION 6 PURPOSE OF THE CCWC 6.1 The Members generally will cooperate with one another with respect to the Watershed and engage in the activities authorized by Section 466B.23. CCWC s activities will include, but not be limited to, the following: a. Utilizing watershed level assessments and planning; b. Increasing communication and coordination among the Members in addressing flooding and water quality in the Watershed; c. Supporting the Members efforts to manage storm water runoff to prevent erosion, increase infiltration, promote groundwater recharge and mitigate flooding; d. Promoting efforts to protect and enhance beneficial uses of waterways within the Watershed such as fish and wildlife habitat and water recreation; e. Promoting uniform policies for surface and groundwater management; f. Increasing public education regarding flooding and water quality; g. Seeking funding opportunities to support the mission of the CCWC; and h. Providing a forum for the exchange of ideas among the Members. SECTION 7 POWERS AND DUTIES OF MEMBERS 7.1 The Members of this Agreement shall retain all powers and duties conferred by law and shall assist each other in the exercise of such powers and the performance of this Agreement. Any Member may accept a specific responsibility to assist with achieving the goals of the CCWC. Said responsibilities include, but are not limited to: a. Identifying opportunities for funding or in kind support for the undertaking of watershed planning, assessments, and improvements within the Watershed; b. Serving as the fiscal agent for the CCWC when it receives funding; c. Identifying opportunities for infrastructure development and planning capable of assessing and mitigating flood risks and improving water quality in the watershed; d. Identifying best management practices for water quality improvements and to prevent erosion, increase infiltration, promote groundwater recharge and mitigate flooding; e. Participating in educational and outreach programs regarding water quality and flood risks; f. Providing support for the administration of projects, as agreed to by the Members; 3

56 g. Securing financing, including grants, loans and issuance of bonds or loan agreements as deemed necessary to achieve the objectives of the CCWC; h. Coordinating with local utilities; and i. Designing and bidding of projects and administration of contracts. SECTION 8 MANNER OF FINANCING 8.1 With a Member(s) acting as the fiscal agent, the Board may solicit, accept and receive donations, endowments, gifts, grants, reimbursements and other such funds or in kind contributions, as necessary to support work pursuant to this Agreement. It is agreed and understood by the Members hereto that no financial obligations upon any Member are intended to be created hereby. 8.2 No action to contribute funds by a Board member of the CCWC is binding on the Member that he or she represents without official approval by the governing body of that Member. No Member may be required to contribute funds to the CCWC. 8.3 The Board will review each opportunity for funding or in kind support. After review of the opportunity, a fiscal agent will be nominated. The fiscal agent shall be a Member or other organization meeting the fiscal agent standards outlined by the funding source. SECTION 9 EMINENT DOMAIN & OWNERSHIP OF PROPERTY 9.1 The CCWC shall not have the power of eminent domain and shall not own any interest in real or personal property. All interests in property shall be held in the name of a Member. SECTION 10 AMENDMENTS 10.1 This Agreement may be amended at any time by the Members. All amendments shall be in writing, adopted by resolution and signed by all Members, and filed in an electronic format with the Iowa Secretary of State as required by Iowa Code Section 28E Eligible political subdivisions may request to join the CCWC by filing written notice with the CCWC and adopting this Agreement by resolution. The request to become a new Member will be considered approved when the additional signature page has been filed in an electronic format with the Iowa Secretary of State as required by Iowa Code Section 28E Withdrawal of any Member may be accomplished by filing written notice with the CCWC and the other Members 60 days before the effective date of withdrawal. No Member may withdraw from this Agreement until the withdrawing Member has met its full obligations as of the effective date of withdrawal. SECTION 11 TERMINATION 11.1 This Agreement may be terminated upon a majority vote of the Members. If the Agreement is to be terminated, a notice of the intent to terminate the CCWC shall be sent to all Members at least 90 days before the date of termination. 4

57 SECTION 12 GENERAL PROVISIONS 12.1 Entire Agreement: This Agreement contains the entire agreement and integrates all of the terms and conditions contained in and incidental to such Agreement. No modifications or waiver of any provision in this Agreement shall be valid unless in writing and signed by all of the Members. If, for any reason, any provisions of this Agreement shall be inoperative, the validity and effect of the other provisions shall not be affected thereby Severability: If any provision of this Agreement is found to be invalid by any court, administrative agency or tribunal of competent jurisdiction, the invalidity of any such provision shall not affect the validity of the remaining provisions hereof Assignment: This Agreement shall be binding upon and inure to the benefit of the Members and their respective successors and assigns. Members are limited by law to counties, cities, and soil and water conservation districts. SECTION 13 GOVERNING LAW 13.1 This Agreement shall be governed by and interpreted under the laws of the State of Iowa. SECTION 14 EFFECTIVE DATE, EXECUTION OF DOCUMENTS AND RECORDATION 14.1 This Agreement shall take effect upon execution by the Members as required by law and filing in an electronic format with the Iowa Secretary of State as required by Iowa Code Section 28E.8. The Members agree to timely execute any documents necessary to carry out the terms of this Agreement. The Members further agree that this document may be executed outside the presence of the other Members and in separate counterparts. 5

61 DEVELOPMENT AGREEMENT THIS DEVELOPMENT AGREEMENT (the Agreement ) entered into by and between the City of Coralville, th Street, Coralville, Iowa 52241, hereafter referred to as the City ; and James Glasgow, hereafter referred to as the Developer. WHEREAS, Developer has an option to purchase the property generally referred to as th Avenue, Coralville, Iowa (the Property ), which is currently owned by DVG Investments, LLC; and WHEREAS, the Developer intends to construct a hotel at the Property (the Hotel Project ); and WHEREAS, the Developer has approached the City about tax increment financing assistance to assist the Developer in demolishing the existing building; reconstructing certain streets and/or sidewalks and redeveloping the storm water systems located on and adjacent to the Property (the Project ); and WHEREAS, Chapters 15A and 403 of the Code of Iowa allow cities to make tax increment financing assistance available; and WHEREAS, the parties desire to enter into this Agreement to assist the Developer in performing said Project. NOW, THEREFORE, the parties agree as follows: A. City Obligations. 1. The City shall conduct a Phase I environmental study on the Property, and if required, a follow-up Phase II environmental study. The City shall submit a copy of said studies to the Developer for his use. 2. The City shall cause an asbestos and hazardous materials survey to be completed on the existing building on the Property and give a copy of said survey to the Developer for his use. 3. The City shall complete engineering plans for the reconstruction of the intersection of 25 th Avenue with the Coral Ridge Mall Ring Road for use by the Developer in performing the street reconstruction portion of the Project.

62 4. The City shall obtain a temporary construction easement from the owners of the Coral Ridge Mall for construction of the street and sidewalk improvements. 5. After finishing the entire Project, the City shall pay to the Developer, the sum of not-to-exceed $, upon review and approval of the City Council. B. Developer s Obligations. 1. The Developer shall cause the mitigation of any asbestos and hazardous materials as identified in the asbestos and hazardous materials survey given to the Developer by the City. All mitigation shall be in strict compliance with federal, state and local law regarding the mitigation of asbestos and hazardous materials. 2. After completion of the mitigation of the asbestos and hazardous materials described in subparagraph (1) above, the Developer shall cause the existing building on the site to be demolished and the debris hauled away in strict compliance with federal, state and local law regarding demolition of buildings. 3. Prior to the demolition described in subparagraph (2) above, the Developer shall cause the existing water and sanitary sewer services to be plugged in accordance with the standards of the City s Water and Wastewater Departments. 4. The Developer shall remove and haul away all junk, debris or any other materials necessary to make the Property ready for redevelopment. All hauling and disposal shall be in strict compliance with all federal, state and local law. 5. The Developer shall cause the storm water improvements, as designed and shown on Exhibit A attached hereto, to be constructed within 90 days after the execution of this Agreement. 6. The Developer shall construct the street and sidewalk improvements, as designed by the City, to be constructed after the demolition, debris cleanup and storm water improvements have been completed by the Developer. C. Administrative Provisions. 1. This Agreement may not be amended or assigned by either party without the express permission of the other party. However, the City hereby gives its permission that the Developer s rights to receive the economic development tax payment hereunder may be assigned by the Developer to a private lender, as security, without further action on the part of the City.

63 2. This Agreement shall inure to the benefit of and be binding upon the successors and assigns of the parties. 3. This Agreement shall be deemed to be a contract made under the laws of the State of Iowa and for all purposes shall be governed by and construed in accordance with laws of the State of Iowa.
