Water rights to be used for augmentation: The Florida Water Project is decreed in Case No. W through W , Water Division 7. The location of which is the Lemon Dam in Sections 17 and 20 Township 36 North, Range 7 West, N.M.P.M. The Applicants intend to construct one single family residence and a second residence on the aforesaid property mentioned above and have outside water uses for irrigation of lawns, pastures, gardening, four head of livestock and 3000 square feet of water surface evaporation. The existing water rights granted under 91CW04 is not adequate for the applicants needs to supply water to a second residence and for the aforementioned outside uses. It is anticipated that the one (1) acre foot of augmented water would be used for those additional uses. The estimated uses are set forth on Exhibit D attached to the Application. The Applicants request the right to change the depletions in each category based upon the depletion rates in Exhibit D with approval of the Division Engineer. The augmentation water used in this Application is storage water from Lemon Reservoir. Therefore, there should not be any injury to water users on the Florida River. The Applicants predecessors in interest have previously entered into a Water Reservation Agreement with Florida Water Conservancy District, Exhibit B-1 attached to the Application, which Reservation Agreement has been extended, per Exhibit B-2 attached to the Application. Also attached to the Application is an Assignment of the Applicants predecessors in interest of the Water Reservation Agreement, Exhibit C. Upon approval of the Decree for the Plan of Augmentation by the Court, the Applicants will enter into a long term Third Party Agreement with the Florida Water Conservancy District and the United Stated Bureau of Reclamation. (100 gpm), conditional. F. Beneficial Use. i. Vickerstaff Pond and Nordstrom Pond. Piscatorial, recreation and maintenance of the water level in Vickerstaff Pond and Nordstrom Pond (collectively the Ponds ) and their related water features for the enjoyment of the lot owners. The Ponds were decreed to allow related water features, which included a modified stream channel with pools and drop structures. When said stream channel is not naturally flowing with water, a pump may be used to circulate water from the Ponds through the channels. ii. SJRR Well #1. Domestic, irrigation and livestock uses (including horses). The SJRR Well #1 may also be used to supplement flows through the Ponds and related water features and replace evaporation, wherein the water will be put to the beneficial uses described above at paragraph 3(F)(i). Irrigation will occur on the lots located within the San Juan River Ranch Property Owners Association. G. Remarks. The approximate location of the Vickerstaff Pond, Nordstrom Pond and SJRR Well #1, and the San Juan River Ranch property where beneficial use has occurred, are depicted on the attached map incorporated herein by reference. The Vickerstaff Pond, Nordstrom Pond and SJRR Well #1 are the subject of an augmentation plan decreed in Case No. 03CW Claim to Make Absolute. A. Applicant claims the Vickerstaff Pond absolute in the full amount of 4 acre-feet, for all decreed uses including piscatorial, recreation and maintenance of the water level in the Ponds and their related water features for the enjoyment of the lot owner. The basis for this claim is that the Vickerstaff Pond was constructed and, at its current size, is believed to hold approximately 4 acre-feet of water that has been applied to the decreed uses. B. Applicant claims the SJRR Well # 1 absolute in the amount of 15 gallons per minute (gpm) for all decreed uses including domestic, irrigation, livestock uses (including horses) and

4 to supplement water stored in the Ponds. The basis for the claim is that SJRR Well # 1 was constructed and connected to a potable water supply delivery system that provides water for the foregoing uses, and the current pump installed in SJRR Well # 1 is limited to 15 gpm. 5. Detailed outline of work done toward completion of the appropriation and application of water to a beneficial use: Since the subject conditional water rights were adjudicated, Applicant and its predecessor have invested roughly $200,000 in various water facilities and operations including, but not limited to, completion of the SJRR Well # 1 potable water supply delivery system, completion of Vickerstaff Pond, construction of ditch improvements, headgates and diversion structures, construction of dam improvements, ditch cleaning, fish stocking, installation of aerators, installation of flumes and pipelines, river riparian work, hiring of a ranch manager to operate the water facilities, engineering associated with the Turkey Creek Ranch Reservoirs, and other matters. Applicant s various water rights and related infrastructure are part of an integrated water supply system for the development of the San Juan River Ranch, and the SJRR Well # 1 and Ponds are an integral part thereof. Accordingly, Applicant seeks to retain the conditional status of Nordstrom Pond and seeks to retain the conditional status of any and all uses and amounts of water conditionally decreed to SJRR Well # 1 and Vickerstaff Pond to the extent not made absolute in these proceedings, including but not limited to 85 gpm associated with SJRR Well #1 for all decreed uses associated therewith. 6. Ownership: The Vickerstaff Pond, Nordstrom Pond and SJRR Well #1 are all located on land owned by Applicant or the individual lot owners represented thereby. WHEREFORE, Applicant requests that the Court enter a decree that includes the following: (1) a finding that the Vickerstaff Pond water right is absolute in the full amount of 4 acre-feet for all decreed uses; (2) a finding that the SJRR Well #1 is absolute in the amount of 15 gpm for all decreed uses; (3) a finding that Applicant was reasonably diligent in perfecting Nordstrom Pond and any and all uses and amounts of water conditionally decreed to the Vickerstaff Pond and the SJRR Well #1 to the extent not made absolute by this application so that Applicant may retain all said conditional water rights; and (4) such other and further relief as this Court deems just and proper. Evidence of reasonable diligence: The subject water rights are components of an integrated water supply system that serves the Cascade Village development and other properties located within the Cascade Village Master Plan ( Master Plan ). Given the interrelated and interdependent nature of the various components of the integrated water system, of which the subject water rights are a part, work completed with respect to any one component of such water system should appropriately be considered in finding that reasonable diligence has been shown in the development of water rights for all features of the integrated water supply system. See C.R.S (4)(b). During the diligence period, Applicant and its predecessor-ininterest have taken steps to diligently develop the subject water rights including, without limitation, the activities described in the list below. (b) Goff Engineering prepared draft development plans for undeveloped property within the Master Plan. (c) Architectural designs were prepared for undeveloped property within the Master Plan. (d) Discussions were held with planners for San Juan County regarding revisions to the Master Plan. v) Additional property within the Master Plan was developed and is provided water service from the water supply system that serves properies within the Master Plan. vi) Maintenance, improvements and repairs were performed on the water supply system that serves properties within the Master Plan, including line repairs, replacement of the Cascade Village Well No. 2 pump and replacement of the Cascade Village Well No. 40 controller. vii) Applicant engaged the services of attorneys to provide legal advice in connection with the above-described planning activities and associated water rights matters. viii) Applicant and its predecessor-in-interest expended substantial funds on the above-described activities during the diligence period.
