1 Center Harbor Board of Selectmen Board of Selectmen s Meeting Wednesday, April 29, 2015 CALL TO ORDER: At 7:00 p.m. Chairman Harry Viens called the Board of Selectmen s meeting to order. Selectmen Richard Hanson (via speakerphone) and Richard Drenkhahn were present. Police Chief Mark Chase, David Hughes, Bill Ricciardi and Selectmen s Administrative Assistant Robin Woodaman were also in attendance. PUBLIC HEARING: At 7:00 Mr. Viens opened the public hearing to receive input on proposed changes to the town s parking ordinance and the addition of a traffic control ordinance. Discussion: Fines: Police Chief Mark Chase reported the proposed ordinance changes will standardize the Town s fines to $35. Handicap parking: Chief Chase reported the State of New Hampshire laws refer to a fine of $250 for illegally parking in a handicap parking spot. Mr. Hanson asked what the surround town s fine is for this matter. The Selectmen agreed that the Town should be consistent with State laws. Ordinance definitions: There was discussion regarding methods to include definitions and terms proposed in the ordinance; some of which are already included in various areas of the Town s ordinances. At 7:32 p.m. Mr. Viens closed the Public Hearing. RECONVENE: At 7:32 Mr. Viens reconvened the Board of Selectmen s meeting. TOWN ORDINANCE REVISIONS: Mr. Drenkhahn motioned to approve the following Town Ordinance revisions: Section 1 Emergencies: Change to 911 or (603) Use of Town Beach: 2.4:1 No person shall use the Town Beach for any purpose between the hours of ten (10) pm and six (6) am of each day during the period May 1 to October 15 of each year. Nor shall any person swim off the dock on said Town Beach at any time, nor shall any person deposit cans, bottles, or other rubbish in the water or on the premises except into receptacles provided for that purpose. In addition, there shall be a three (3) hour limit on the docking, mooring or tying up of boats at any Town wharf or dock facility from 8:00 a.m. to 10:00 p.m. (revised from 12:00 midnight). There shall be no docking, mooring or tying up of boats at any Town wharf or dock facility from 10:00 p.m. (revised from 12:00 midnight) to 6:00 a.m. In addition, there shall be no boat trailer parking at the Center Harbor Town Beach parking lot. There shall be a thirty (30) minute parking limit at the Town Beach for motor vehicles. 1
2 Any person who shall violate any part of the foregoing shall be fined not more than thirty five ($35) (revised from $30) in addition to having their vehicle, trailer or boat, or all of the above towed at the owner s expense. Fines: Parking fines will be $35, parking in a handicap spot will be $250, applied to the following ordinances: o 2:10 Use of Public Highways o 2:11 Parking Regulation o 2:18 Prohibited Acts o 2:22 Penalties o 2:25 Handicapped Parking Mr. Hanson seconded the motion and the vote was unanimous. APPROVAL OF MINUTES: April 22, 2015 Board of Selectmen s meeting: Mr. Hanson motioned to accept the minutes of the April 22, 2015 Board of Selectmen s meeting. Mr. Drenkhahn seconded the motion. Mr. Viens, who was not present at the meeting abstained from voting. The motion passed. APPOINTMENTS: None NEW BUSINESS: NOISE COMPLAINT: Police Chief Mark Chase submitted a noise complaint regarding work, including the running of a crusher, beginning at the Ambrose Gravel pit at 6:15 a.m.; the person who complained reported they are not permitted to being prior to 7:00 a.m. Chief Chase reported he forwarded this complaint to Code Enforcement Officer Ken Ballance because the Police Department can only enforce the Town s noise ordinance, which allows work to begin at 6:00 a.m PROPERTY LIENS: Tax Collector Mary Richardson submitted a report of 2014 property liens; the liens totaled $38, THE MUG RESTAURANT MOTORCYCLE WEEK PERMIT: Amy Elfline, Vice- President of The Mug Restaurant, submitted The Mug s request for a temporary Garden Dining Area located in front of the building during Motorcycle Week, June 12, 2015 through June 21, Ms. Elfline s request is the same as requested in previous years and includes outside music beginning on Thursday, June 18 th. Mr. Viens motioned to approve The Mug Restaurant s Motorcycle Week permit. Mr. Hanson seconded the motion and the vote was unanimous. TAX YEAR 2015 TIMBER CUTS: The Selectmen signed letters to the following property owners who were issued Notices of Intents to Cut Wood or Timber reminding them that the Reports of Timber Cut are due by May 15, 2015: 2
3 Fitzgerald TML Brady TML 226, Lots 3 & 4 : TAX CARD ACCESS: Mr. Viens suggested the Selectmen research the cost associated with allowing on-line access to the full tax cards, not the limited access we currently have available to the public. He also suggested the Selectmen research specifications and costs associated with installing a stand-alone computer in the lobby for individuals to access tax cards without assistance from office staff. Mr. Viens suggestions will be researched. OLD BUSINESS: STREET LIGHTS: Street light safety: There was discussion regarding street lights and safety. Chief Chase reported there is a lot of pedestrian traffic on Route 25 at night, such as employees and patrons of The Canoe Restaurant walking to their vehicles parked at the Church s parking lot, and street lights help to ensure their safety. He reported light deters crime and also helps illuminate the travel way during bad weather conditions. The Selectmen would like Chief Chase and Mr. Haines to review areas of Town with regard to street lights and report to the Selectmen. Resident input: Kelley Court resident Ginny Fisher reported, via , that she endorses turning off the street light at the end of Kelley Court; she reported several of her neighbors are in favor of dispensing with that light as well. Ms. Fisher reported a compromise of not turning that street light off would be to outfit it with a motion detector. Public hearing: o Notification: Mr. Viens suggested the residents who would be affected by any decisions on the street lights should be notified by mail of the public hearing; Mr. Hanson and Mr. Drenkhahn agreed. o Map of street lights: Mr. Viens reported a large map of the street light locations will be available for the public hearing. ROUTE 25B PAVING: The Selectmen previously received notification from Continental Paving, Inc. that they will be working with the State of New Hampshire Department of Transportation (NH DOT) on NH DOT Project #29237, Resurfacing District III, on two (2) roadway segments on Route 25B. Section 1 begins at the intersection of Route 3 and Route 25B going easterly on Route 25B for approximately 4,225 feet. Section 2 begins 650 feet west of the Center Harbor Neck Road intersection then going easterly approximately 1,700 feet; the work will begin on or about May 4 th and will take four to six weeks to complete. Mr. Viens reported he, Police Chief Mark Chase and Road Agent Jeff Haines met with NH DOT and Continental Paving, Inc. representatives to review the project. He reported Chief Chase expressed the Town s concerns and recommendations for safety, which the NH DOT did not act on. There was discussion regarding the need for traffic to be detoured onto College Road at times, which will require the temporary suspension of weight limits and No Through Traffic on that road. Mr. Drenkhahn motioned to temporarily suspend the 3
4 weight limits and No Through Traffic on College Road during the NH DOT s resurfacing of Route 25B. Mr. Viens seconded the motion and the vote was unanimous. COLLEGE ROAD AND ROUTE 3 INTERSECTION: Road Agent Jeff Haines submitted a memo to the Selectmen reporting the College Road and Route 3 intersection project has been rescheduled to begin June 1 st ; he reported mud is still pumping through the surface in places and he, the contractor and engineer feel delaying the project will help dry things out. MEREDITH ROTARY CLUB BEAUTIFICATION PROJECT: Mr. Haines reported the Meredith Rotary Club plans to complete the project on the bandstand property the weekend of May 16 th. DOCK AND ICE CLUSTER REAPIRS: Mr. Haines reported the Town has a maintenance permit which will allow the necessary repairs to the docks and ice cluster. He reported plans to complete the repairs as soon as possible. ROUTE 25B CROSSWALKS: Mr. Haines submitted paperwork from the State of New Hampshire Department of Transportation (NH DOT) regarding the Town taking over the maintenance of the crosswalk in front of the Library once the NH DOT s work on Route 25B is complete. He included an from the NH DOT allowing the Town to paint the crosswalk centers a solid color as the Selectmen have previously discussed. Mr. Drenkhahn motioned to accept the crosswalk maintenance for the crosswalk in front of the Library. Mr. Hanson seconded the motion and the vote was unanimous. RENOVATIONS AND ADDITIONS TO THE MUNICIPAL BUILDING: Punch list: Mr. Viens submitted a copy of an April 7, to Bonnette, Page & Stone (BPS) Representative Barry Salta itemizing items that need to be repaired. Sprinkler system tank: Mr. Viens motioned to proceed with the installation of the water tank and pump for the sprinkler system. Mr. Drenkhahn seconded the motion and the vote was unanimous. PROPERTY ASSESSMENT: The Selectmen previously received unsigned correspondence reporting an individual is living in a cabin on property that is assessed for land only. The individual asked if a building permit has been issued for the cabin and requested the Selectmen research this matter. Ms. Woodaman reported a construction permit had been issued for a garage in 2010; when the Town s assessor contacted the property owner as part of that year s assessment work, it had not been constructed. She reported the assessor has visited the property and adjusted the assessment; as the property is in current use, a new current use map will be required. VOLUNTEER RECRUITMENT: Mr. Viens will draft a press release requesting volunteers for Town boards/committees/commissions. LAKES REGION PLANNING COMMISSION (LRPC) REPRESENTATIVE: Mr. Hughes offered to represent the Town on the LRPC. Mr. Drenkhahn motioned to appoint David Hughes as the Town s Commissioner to the LRPC. Mr. Viens seconded the motion 4
5 and the vote was unanimous. There was discussion regarding the need for an additional LRPC Commissioner to represent the Town. BANDSTAND LIGHTING UPGRADE: The Selectmen previously reviewed, and voted to accept Bob Daniels Electric proposal, in the amount of $2,784, to upgrade the bandstand s lighting to LED lighting. Mr. Viens reported the Energy Committee would like to solicit additional proposals. Mr. Drenkhahn motioned to rescind the Selectmen s previous acceptance of Bob Daniels Electric proposal based on the Energy Committee s desire to solicit additional proposals. Mr. Viens seconded the motion and the vote was unanimous. PAVILION LIGHTING: The Selectmen had previously discussed installing electrical outlets and lighting in the pavilion at the Town Beach. Mr. Viens reported the electrical outlets should be turned on and off from a secure location. The specifications for this proposal will be reviewed at a future meeting. PUBLIC INPUT: DAVID HUGHES: Reader board: Mr. Hughes asked the status of the installation of the reader board; Road Agent Jeff Haines will be asked for an update. Park Committee: o Morrill Park clean-up: Mr. Hughes reported approximately ten (10) Boy Scouts, six (6) adults and a few employees of Stephens Landscaping worked to clean-up Morrill Park on April 18 th. He reported the Boy Scouts were a tremendous help and the clean-up filled a Stephens Landscaping truck; Stephens Landscaping hand tools were also used during the day. The Selectmen will send thank-you s to the Boy Scouts and Stephens Landscaping; thank-you articles will also be sent to local newspapers. Mr. Hughes reported a load of wood chips would help to defoliate the area; Mr. Viens suggested he contact Dan Langan, of the Meredith Rotary Club, to ask if there may be some wood chips available from the Rotary s beautification of the bandstand property. o Picnic table: Mr. Hughes reported a materials list is needed for the planned construction of a picnic table to be placed in Morrill Park. Planters on median: Mr. Hughes reported the State of New Hampshire Department of Transportation (NH DOT) has granted permission for Stephens Landscaping to place planters on the median at the Route 25B and Route 25 intersection. ADDITIONAL BUSINESS: FIRE DEPARTMENT ADVISORY COMMITTEE (FDAC): The Selectmen previously received an from Lee Callahan, Chairman of the FDAC, reporting it has been almost two (2) years since the FDAC was convened, at the request of the Selectmen, to review four (4) issues in the Fire Department: 5
6 o Standards of operations o Current staffing levels o Research training requirements o Current and future equipment needs Mr. Callahan reported the FDAC has met during the past 21 months, researched the issues and met regularly with Fire Chief Leon Manville to discuss the results of their research and ways to make constructive and cost effective adjustments to the Center Harbor Fire Department. Mr. Callahan reported the FDAC believes they have met their charge; suggestions have been brought to the Board of Selectmen for their action and many other issues could be dealt with directly with Chief Manville. The sole remaining issues is that the FDAC advises the Selectmen to consider implementing a per diem system of staffing during the projected high times, such as summer vacation. Mr. Callahan reported many firefighters go away during the summer and are unable to respond, and the call volume is higher due to increased residents and visitors to the area. He reported Chief Manville will be bringing the issue to the Selectmen at a future time. STATE OF NEW HAMPSHIRE: State of New Hampshire Department of Transportation (NH DOT): o NH DOT Red List bridges: The Selectmen received, and reviewed, the NH DOT s Red List bridges report, which lists the NH DOT-maintained bridge on Waukewan Road over the Lake Waukewan inlet as in poor condition. The NH DOT reports plans to replace the bridge in State of New Hampshire Department of Revenue Administration (NH DRA): o NH DRA Certification of Yield Taxes Assessed : The Selectmen reviewed, and signed the following NH DRA Certification of Yield Taxes Assessed : Bigelow TML CURRENT BILLS PAYABLE: The Selectmen reviewed, and approved, the payroll and accounts payable manifests as presented. ADJOURNMENT: At 8:40 p.m. Mr. Drenkhahn motioned to adjourn the Board of Selectmen s meeting. Mr. Hanson seconded the motion and the vote was unanimous.
