1 DATE: September 4, 2008 TO: THRU: FROM: RE: Recreation and Park Commission Yomi Agunbiade, General Manager Dawn Kamalanathan, Planning Director Daniel LaForte, Park Planner Commission Agenda Item Agenda Item Wording: Discussion and possible action to recommend to the Planning Commission that the shading or shadowing from the proposed 110 Embarcadero Street Project located at the northeast corner California and Davis Street will not be significant or adverse on Justin Herman Plaza - as required by Planning Code Section 295 (The Sunlight Ordinance). Background: The Planning Department is currently reviewing plans for 110 Embarcadero Street (the project), a demolition of an existing two-story office building and construction of a new 10-story building containing approximately 50,000 gross square feet of office space and about 700 square feet of retail use on the ground floor (see Figure 1, Project Location). The proposed structure would be 123 feet high and would have a 13-foot-high mechanical penthouse, and 4-foot elevator penthouse, bringing the highest point of the structure to an elevation of 140 feet. A shadow analysis performed by the Planning Department indicates that the proposed project would cast net new shadow on Justin Herman Plaza. The 110 Embarcadero Technical Memorandum prepared by Environmental Science Associates (ESA) is attached to this report. Section 295 of the Planning Code, adopted in 1985 as a response to voter mandate of Proposition K, establishes limitations on shadows cast on parks under the jurisdiction of the Recreation and Park Commission for proposed buildings over 40 feet in height. In 1989, the Recreation and Park Commission and Planning Commission adopted criteria (both quantitative and qualitative) to determine significance for shadows cast on 14 downtown parks under the jurisdiction of the Recreation and Park Commission. The absolute cumulative limit for new shadow established for Justin Herman Plaza is 0.1 percent. Shadow effects on Justin Herman Plaza: Justin Herman Plaza is bounded by Market Street, Drumm Street, and The Embarcadero. The park is approximately 157,644 square feet (sf) and is surrounded by commercial and retail uses. The majority of the park includes an open plaza area and a fountain. The project shadow would affect the center of the plaza and the area within the fountain.
2 The shadow analysis found that there is a theoretical potential of approximately 557,086,137 million squarefoot-hours of sunlight available year round on Justin Herman Plaza. The project shadow coverage would be about 38,022 shadow square-foot-hours, representing about percent of the total potential sunlight. As previously mentioned, the absolute cumulative limit established for Justin Herman Plaza under is 0.1 percent. The other projects to shadow Justin Herman Plaza since the adopted criteria is the Hotel Vitale project, which according to the EIR for the project, added 510,549 square-foot hours of shadow to Justin Herman Plaza, or, 92 percent of the allowable new shadow (0.092 percent of the potential sunlight). The other project is the 100 California Street, approved by the Commission on November 1, 2007, which added an additional 6,209 square foot hours of shadow, bring the total for the two projects and proposed project to 554,780 square foot hours of shadow (510,549+38,022+6,209), or 99.6 percent of the absolute cumulative limit of 0.1 percent. The Proposition K qualitative criteria established for Justin Herman Plaza states: avoid mid-day and winter shadows. The new shadow would occur in the morning, at 8:15-8:45 AM. The proposed project would shade the center of the plaza at the corner of Steuart and Market Street, and about 75 feet south of Vaillancourt Fountain during the first and fourth week of October (and again one week in mid-february, and one week in early March) for a total of 6,209 square-foot-hours of shadow for 15 minutes during the first one-hour before the one hour before sunset specified in the Planning Code Section 295. Improvement Measures: Staff identified Justin Herman Plaza and contiguous open spaces in need of planting and irrigation improvements. A draft Memorandum of Agreement has been started to reflect these measures (see attached Draft MOA). Staff will also coordinate with City Planning to incorporate the improvement measures into the final conditions of approval for the project. Summary: The additional shadow for Justin Herman Plaza is percent of the total sunlight, including shadow from Hotel Vitale and 110 California Street, would not exceed the standard of 0.1 percent of new shade cumulative limit criteria established in The new shadow would avoid mid-day shadow, and occur only before 9 AM for 30 minutes a day for the first one hour before the one hour before sunset specified in Section 295 of the Planning Code. Heisler subject K 110 Embarcadero: Section 295 Shadow Study for Justin Herman Plaza (ESA ) Introduction The proposed project would entail demolition of an existing two-story office building and construction of a new 10-story building containing approximately 50,000 gross square feet of office space and about 700 square feet of retail use on the ground floor. Parking for 14 cars would be provided primarily by means of a mechanical stacker system, accessible from Steuart Street. The proposed project structure would be 123 feet tall, measured according to the Planning Code (123-foot roof height). The building would have a 13-foot-tall mechanical penthouse, with an elevator override rising an additional 4 feet, to a total of 17 feet above the roof (a height of 140 feet), near the center of the south wall of the building. The roof would be surrounded on three sides and a portion of the fourth side by a clear glass parapet wall that would be three-and-one-half feet (42 inches) tall. 1 (The remainder of the fourth (south) side of the roof would be occupied by the mechanical penthouse.) The project site is shown on Figure 1. Figure 2 depicts the proposed roof plan, Figure 3 depicts a three-dimensional massing model of the proposed project, and Figure 4 presents the building s proposed east elevation. The project is located in a C-3-O (Downtown Office Commercial) Use District and an 84-X Height and Bulk Districts (84 foot maximum height; no bulk limits). The proposed project would comply with the Planning Code use controls but would not comply with the height limit, and would therefore require a height map amendment (rezoning) to increase the permitted height limit. The project sponsor proposes that the site be assigned a height and bulk designation of 130-X (130-foot height limit, with no bulk limit). Setting The topography of the project site and vicinity is generally flat. Justin Herman Plaza/Embarcadero Plaza, also known as Embarcadero Plaza II, extends both north and south of the foot of Market Street. (This open space is referred to as Justin Herman Plaza or the Plaza hereinafter.) North of Market Street, and along the now-closed right-of-way of Market Street itself, the Plaza consists of a hardscaped area that includes a large sunken bricksurfaced area partially occupied by the Vaillancourt Fountain. South of Market Street, the Plaza includes a grassy area about 50 feet wide by 150 feet long surrounded by a raised concrete border and additional hardscape. A double line of palm trees separates the plaza from the Embarcadero roadway to the east. At nearly 3.5 acres, Justin Herman Plaza is the second largest park in downtown San Francisco (behind Union Square). 1 Consistent with past practice the clear glass parapet is not treated as an element that would cast new shadow.

Because of the density of the surrounding area, the hardscaped portions of the Plaza see a large amount of foot traffic at all hours of the work day: during the morning and evening peak periods, the majority of pedestrian traffic is heading through the Plaza, along the Market Street right-of-way. Justin Herman Plaza also has a fairly high level of activity on weekends, and is a favored gathering place for special events, ranging from the monthly Critical Mass bicycle rides to political rallies, civic marches that begin in the Plaza and extend up Market Street, and concerts and festivals. Shadow Impacts Section 295 of the Planning Code, the Sunlight Ordinance, was adopted through voter approval of Proposition K in 1984 to protect certain public open spaces from shadowing by new structures. Section 295 prohibits the issuance of building permits for structures or additions to structures greater than 40 feet in height that would shade property under the jurisdiction of or designated to be acquired by the Recreation and Park Commission, during the period from one hour after sunrise to one hour before sunset, unless the Planning Commission, following review and comment by the general manager of the Recreation and Park Department in consultation with the Recreation and Park Commission, determines that the impact of such shade would not be adverse or would be insignificant. In 1989, the two Commissions adopted shadow criteria for 14 downtown parks, including an Absolute Cumulative Limit for new shadow for each open space and set forth qualitative criteria for assessing new shadow. (The Absolute Cumulative Limit is the maximum amount of new shadow that could be permitted on a given park.) For projects that would affect parks for which a quantitative limit was established, shadow impacts have typically been judged not to be adverse if the project would not exceed the Absolute Cumulative Limit. In establishing the Absolute Cumulative Limits for the downtown parks, the commissions generally relied upon the following guidelines: for smaller parks (of less than two acres) on which more than 20 percent of the potential Prop. K sunlight was in shadow under then-existing conditions, no additional shadow was to be permitted. (This standard was applied to nine downtown parks.) For larger parks (of two acres or more) with between 20 percent and 40 percent existing shadow, the Absolute Cumulative Limit was to be set at 0.1 percent; that is, an additional

(This criterion applied to Justin Herman Plaza, then called Embarcadero Plaza II South, along with Union Square. Two other parks, Washington Square and North Beach Playground, were not permitted new shadow because height limits precluded the possibility of new shadow on those parks.) For larger parks shadowed less than 20 percent of the time (Civic Center Plaza was the only park in this category), an additional 1.0 percent new shadow was to be permitted. 2 No guideline was provided for parks of less than two acres that have less than 20 percent existing shadow. 3 As a large park in excess of two acres with between 20 percent and 40 percent annual shadow coverage, Justin Herman Plaza was assigned an Absolute Cumulative Limit of 0.1 percent; that is, an additional 0.1 percent more shadow coverage would be permitted beyond existing conditions. At the time that the Absolute Cumulative Limits were established, the analysis in support of the commissions actions, and presented in an October 1987 Planning Department staff memorandum, 4 showed that Justin Herman Plaza was shaded 37.6 percent of the time. That is, of the potential sunlight on the Plaza during the hours covered by Section 295 (hours of sunlight times the square footage of the Plaza, quantified in square-foothours of sunlight), 37.6 percent of the square-foot-hours were in Figure 3 Isometric View (from the north) SOURCE: Pelli Clarke Pelli Architects shadow. This analysis was based on total potential sunlight of nearly million square-foot-hours. 5 2 The guidelines for new shadow were presented in a memorandum to the Planning and Recreation and Parks Commissions, from their staffs, dated February 3, 1989, and referred to in Joint Resolution of the two commissions, adopted February 7, This is because none of the 14 downtown parks for which Absolute Cumulative Limits were established met these criteria. 4 Percentage coverage is the annual total of square-foot-hours (sq. ft.-hr.) of shadow, divided by the available sunlight in sq. ft.-hr., expressed as a percentage and presented in San Francisco Planning Department, Proposition K The Sunlight Ordinance Memorandum, Oct. 22, A square-foot-hour of sunlight is one hour of sunlight on one square foot of ground. Total potential sunlight (the amount of sunlight that would be available on the park if there were no structures shading the park) is calculated by multiplying the size of the park by 3,721.4 (the number of Prop. K hours in the year). For Justin Herman Plaza, with an area (as determined by Planning & Rec/Park in 1987) of 149,698 square feet, the total annual sunlight is 557,086,137 square-foot-hours.

10 110 Embarcadero ( K) Section 295 Analysis July 9, 2008 Page 6 With an Absolute Cumulative Limit of 0.1 percent, an additional 557,086 shadow-foot-hours could be covered. 6 Qualitative criteria for Justin Herman Plaza were given as: Avoid mid-day and Winter shadows. Most of the approved 0.1 percent increment of new shadow on Justin Herman Plaza was consumed by the Hotel Vitale, which was approved and constructed at Mission Street and the Embarcadero subsequent to adoption of the shadow criteria in According to the Final EIR for the Hotel Vitale, that project added approximately 510,544.8 square-foot-hours of shadow to Justin Herman Plaza, representing approximately 92 percent of the allowable new shadow (0.092 percent of potential sunlight), as established in 1989.The proposed 110 Embarcadero project would cast new shadow on Justin Herman Plaza from approximately mid-november through late January. The project would add shadow to the Plaza both north and south of Market Street. The maximum amount of new shadow that would be added is approximately 5,700 square feet, which would fall along the north side of Market Street adjacent to the Hyatt Regency Hotel at 8:19 a.m. (the first minute subject to Section 295) on the winter solstice (see Figure 5). By 8:30 a.m., project shadow would have receded to an approximately 1,950-square-foot area primarily in the Market Street right-of-way (see Figure 5), and by 8:45, new shadow would cover about 2,400 square feet, mostly in the grassy area south of Market Street. No new shadow would fall on the plaza from 9:00 a.m. onwards. A similar pattern would prevail, albeit with lesser areas of shadow coverage, both before and after the winter solstice: during approximately the latter half of November and the latter half of January, new shadow would leave the plaza by about 8:45 a.m. and the area of shadow coverage would diminish at each time shadow were cast. At these early times of the morning, shadows on the ground appear to be fast-moving because the sun s angle relative to the height of the structures casting the shadow changes rapidly. Thus, project shadow would not remain in any single location for more than a few minutes. Moreover, the net new project shadow would fall on the Plaza during a time when most users this space are walking to work across the Market street right-of-way and the hardscape plaza to the north. To evaluate the year-round Proposition K impact on Justin Herman Plaza, a quantitative analysis of sunlight and shade was conducted. The analysis consisted of calculating the amount of shadow coverage resulting from the proposed project at 15-minute intervals on one day per week, for six months of the year. The shadow coverage at the 15-minute intervals was averaged to calculate hourly shadow coverage (in shadow-foot-hours), and the hourly figures for each day were summed and resulting numbers extrapolated to weekly figures through averaging with the preceding week s total. Finally, because the sun s path from January through June essentially mirrors its path from July through December, the six months shadow-foot-hour totals were doubled to return a yearly figure. 7 The total net new shadow from the proposed project would be 38,022 shadow-foot-hours, or about percent of the total potential sunlight on Justin Herman Plaza (6.8 percent of the 0.1 percent absolute cumulative limit). Together with existing shadow cast by the Hotel Vitale, the project would consume 98.5 percent of the allowable shadow load on the plaza. With the addition of another project recently approved (vertical addition to an existing building at 100 California Street), the three projects together would consume 99.6 percent of the absolute cumulative limit of 0.1 percent. Table 1 summarizes the week-by- week net new shadow impact, and also 6 Analogous to square-foot-hours of sunlight, a shadow-foot-hour is one hour of shade on one square foot of ground. 7 This is the same methodology used by the Planning Department to calculate shadow and establish the Proposition K baseline shadow coverage for other San Francisco parks. The calculations of net new shadow for each week produces 27 weekly shadow samples for a half-year period, from the summer solstice through the winter solstice, inclusive. Each date represents the midpoint of one week; the totals for weeks two through 26 are multiplied by seven, while the totals the first and last of the 27 weeks are multiplied by 3.5 to obtain the half-yearly total, which is then doubled, resulting in the total for the full year. That is, because shadow is symmetrical about the solstices, the first week represents the week beginning three days prior to the summer solstice and ending three days after the solstice, while the last week represents the week beginning three days prior to the winter solstice and ending three days after the solstice. The shadow calculation for each of these weeks thus already includes both sides of the solstice and is thus multiplied by the 3.5 days before and after the solstice before being doubled to obtain the full-year shadow. Each of the other weeks of the half-yearly period includes only one side of the solstice (i.e., a week in early November also provides the calculation for the mirror-image week in early February, which is not separately calculated). Therefore, the shadow total for the early November week is multiplied by the seven days before being doubled to obtain the full-year shadow. Detailed calculations are included in a spreadsheet attached to this memorandum.

The mirror week is the calendar week during the opposite half of the year when project shadow would affect Justin Herman Plaza. A detailed spreadsheet presenting week-by-week calculations for the six-month period June through December is also attached. In terms of the qualitative criteria for evaluation of shadow impacts on Justin Herman Plaza, the proposed project would avoid casting any new mid-day shadow. The proposed project would cast new shadow during the winter,

This new shadow would occur before 9:00 a.m., when the primary activity in Justin Herman Plaza is people walking to work across the Market street right-of-way and the hardscape plaza to the north. Likewise, the project would result in new shadow in the late fall, from about November 10 through the winter solstice, again before 9:00 a.m. In view of the limited duration and coverage of the new shadow, it is judged that shadow from the proposed project would not substantially affect the use or enjoyment of Justin Herman Plaza during the winter or late fall. Conclusion Because project shadow would occur only in the early morning before 9:00 a.m. for about two and one half months of the year, would affect percent of potential sunlight on Justin Herman Plaza, and would therefore not generally interfere with enjoyment or use of the plaza, and because project shadow, along with shadow from cumulative development (Hotel Vitale and 100 California Street addition) would not exceed the 0.1 percent allowable new shadow under the absolute cumulative limit for Justin Herman Plaza, it would appear that the proposed project would not adversely affect Justin Herman Plaza during the hours subject to Section 295.
