Tramways Acts a special construction scheme for NOS. 2995,802s, the construction of the tramway hereinalter referred to has been prepared: And whereas it is expedient to authorize the Melbourne and Metropolitan Tramways Board to construct the said tramway in the line and upon the lands described in the First Schedule to this Act: And First.schedule. whereas the land described in the Second Schedule to this ^ " d,,, Schedule. V.] Melbourne to West Brunswick [No ' Schedule to this Act forms part of the land described in the Second Schedule to this Act: And whereas it is expedient to provide that so far only as relates to so much of the land described in the Second Schedule to this Act as is described in the Third Schedule to this Act and is defined as hereinafter provided, the construction on such land and the maintenance and operation of the tramway by this Act authorized to be constructed and of all proper works and conveniences in connexion therewith may be carried out and effected notwithstanding anything in the hereinbefore recited Crown erant: Be it therefore enacted by the King's Most Excellent Majesty by and with the advice and consent of the Legislative Council and the Legislative Assembly of Victoria in this present Parliament assembled and by the authority of the same as follows (that is to say) : short title 1. This Act may be cited as the Melbourne to West and citation. Brunswick Tramway Construction Act 1922 and shall be read and construed as one with the Melbourne and Metropolitan NOS. 2995,3023, Tramways Act 1918 (hereinafter called the Principal Act) 3074, and any Act amending the same all of which Acts and this Act may be cited together as the Melbourne and Metropolitan Tramways Acts. Authority to 2. The Board is hereby authorized under and subject SortSot 40 to the Melbourne and Metropolitan Tramways Acts to construct the following electric tramway in the line and rirst schedule, upon the lands described in the First Schedule to this Act, and all proper works and conveniences in connexion therewith, that is to sav: A double track electric tranway commencing in William-street in the city of Melbourne on the north side of Collins-street and terminating at Moreland-road the boundary between the city of Brunswick and the citv of Coburff. provisions as to 3. (1) The following provisions shall apply to the construction. construction of the permanent way of the said tramway: (a) In Peel-street and Flemington-road in the city of Melbourne the tracks may be laid in any portion of such street or road set aside bv the council of

V.] Melbourne to West Brunswick [No. 3243; of the city of Melbourne to be used exclusively for tramway purposes which portion the said council is hereby authorized to set apart ; and (b) Through the Royal Park the tracks may be constructed of open ballast railway design and shall be fenced and provision shall be made for all openings required for access to the tramway or for cross thoroughfares together with the necessary protection therefor and all necessary culverts subways and other works ; and all crossings under over or on any line of railway shall be made by arrangement with the Victorian Railways Commissioners. (2) Except as provided in this Act and in paragraph (c) of sub-section (2) of section fifty-two of the Principal Act the tramway shall be constructed laid and maintained in such a manner that the uppermost surface of the rails shall be on a level with the surface of the road. 4. Commencing in William-street in the city of Melbourne on the north side of Collins-street; thence northerly along William-street to Peel-street; thence north along that street to Flemington-road; thence north-westerly along Fleminaton-road to Abbotsford-strcet; thence turning north-westerly and entering Royal Park at a pointon its south-west boundary one thousand five hundred and twenty-nine feet two inches from the intersection of the said boundary with the north-west side of Gatehouse-street; thence bearing N ' E. one hundred and seventy feet two inches ; thence two hundred and nineteen feet in an arc of a circle the chord of which bears N ' E. two hundred and eighteen feet six inches and whose centre lies westerly one thousand feet; thence N ' E. one hundred and fourteen feet nine inches ; thence one hundred and nine feet ten inches in an arc of a circle the chord of wjiich bears N. 23 5' 30" E. one hundred and nine feet nine inches and the centre of which lies westerly two thousand feet; thence bearing N ' E. two hundred and forty-two feet four inches; thence ninety-nine feet in an arc of a circle the chord of which bears N ' E. ninety-eight feet eleven inches and the centre of which lies westerly one thousand feet; thence bearing N ' E. two hundred and four feet six inches; thence two hundred and eleven feet ten inches in an arc of a circle the chord of which bears N. 1 29' 30" W. two hundred and eight feet eight inches and the centre of which lies westerly three hundred and fifty feet; thence bearing N ' W thirty-seven feet" two inches ; thence two hundred and forty-four feet in an arc of a circle the chord of which bears N. 8 51' W\ two hundred and forty-two feet ten inches and the centre of which lies easterly seven hundred feet, thence bearing N. 1 9' E. sixty-one feet eight inches; thence two hundred and fiftv-three feet eight inches in an arc of a circle the chord of which bears N. 9 14' 30" W. two hundred and fifty-two feet four inches and the centre of which lies westerly seven hundred feet; thence bearing N ' 30" W. one thousand five hundred and sixty-three feet five inches; thence six hundred and six feet six inches in an arc of a circle the chord of which bears N. 2 47' 30" E. five hundred and ninety-one feet two inches and the centre of which lies easterly seven hundred and seventy-five feet; thence bearing N ' E. one hundred and sixty-four feet seven inches ; thence forty feet in an arc of a transition curve the chord of which bears N ' E. forty feet; thence eighty-one feet in an arc of a circle the chord of which bears N. 7 48' 30" E. eighty feet six inches and the centre of which lies westerly two hundred feet; thence forty feet in an arc of a transition curve the chord of which bears N. 7 40' W. forty feet; thence bearing N. 9 36' W. thirty-four feet two inches to the south boundary fence of the Royal Park Railway ; thence one hundred and sixty-five feet eight inches on the same bearing and passing under the said railway ; thence to the northern boundary of the said railway a distance of seventeen feet FIRST

Estate as shown on plan of subd vision No. 7^13 lodged at the Offce of Ti les and being part of Crown Section 98 parish of Jika Jika, city of Brunswick, and part of land in Certif.cate of Title, Volume 2115, Folium , and Crown Allotments 1, 4, 5, 6, 7, 8, 9 and 10, Secfon C parish of Jika Jika (Phoenix Estate); thence northerly along Melvilleroad to a point approximately seven chains north of Albion-street; thence northerly through the land described in Certificate of Title registered in the Office of Titles, Volume 3351, Folium and Certificate of Title so registered, Volume 3682, Folium to Howiestreet and along Howie-street to Moreland-road.
