REPORT SUMMARY The owner of. a single-family property addressed (View Owner) has submitted a request for a Trousdale Estates View Restoration Permit pursuant to Beverly Hills Municipal Code (BHMC) 10-8-106. The view restoration request includes requests for removal of foliage located on two properties, specifically: The complete removal of six trees located on the property at 1100 Maytor Place (Foliage Owner 1). The complete removal of three trees on the property at 1119 North Hillcrest Road (Foliage Owner 2). Figure 1 on the following page identifies the location of the View Owner s property and the two Foliage Owners properties, as well as the locations of the nine trees that are the subject of this request. The nine trees that are requested to be removed are not located in a front yard or street-facing yard, therefore none of the trees requested for removal are considered protected. Additional time is still required for both parties to finalize this agreement. It is anticipated that the private agreement will result in the complete removal of the three trees that are the subject of the applicant s view restoration request. An open City code enforcement case regarding the non-conforming hedge located on 1100 Maytor Place (Foliage Owner 1) has not been resolved. Resolution of the code enforcement case regarding the hedge would enable both staff and the Commission to more accurately evaluate protectable views from. The City s 1 PROTECTABLE VIEW: A protectable view may include any view of the Los Angeles area basin from a viewing area as defined in BHMC 10-8-102. The view of the Los Angeles area basin may include, but is not limited to, city lights (Beverly Hills and other cities), ocean, and horizon. The term protectable view does not mean an unobstructed panorama of all or any of the above. For purposes of this section, a protectable view shall be determined from a point thirty six inches (36 ) above the finished grade of the viewing area. 12
Page 3 of 3 Community Preservation Division issued the 1100 Maytor Place property owner an order requiring compliance with the City s hedge height regulations by November 16, 2017. The Foliage Owner s attorney subsequently requested an extension to the compliance order and the City granted an extension through January 16, 2018. Community Preservation Division staff completed a field visit on December 13, 2017 after the Foliage Owner s attorney communicated to the City that trimming of the hedge to remedy the code violation had occurred. During the field inspection, the Code Enforcement Officer found the hedge still in violation, and consequently, issued an administrative citation. Therefore, additional time is needed to resolve the code enforcement case. On December 15, 2017, the City received an email from the View Owner s representative requesting continuance of the hearing to February 22, 2018 (Attachment A). The February 22, 2018 Planning Commission date is the earliest regularly scheduled Planning Commission meeting where representatives of both the View Owner and Foliage Owner 1 are available.
