2 To our suppliers: Guideline for Control of Chemical Substances(Second Edition) -To assist in procurement of environmentally-friendly materials/parts- Recently, environmental concerns have been increasingly focused on in business activities. Companies are supposed to seek for construction of a "recycling-oriented" society based on the harmonization of human beings and the environment. Not only supplying high quality products at low cost and ensuring delivery dates, companies are expected to develop and offer environmentally-friendly products. To help construct a recycling-oriented society to protect the global environment and achieve sustained growth of the economy, we are trying to promote environmental management including acquisition of ISO14001 and develop and offer environmentally-friendly products/designs. As a part of this program, we will promote "green procurement" to purchase environmentally-friendly materials/parts, etc. from our suppliers, who have been considering environmental concerns. Please give us your cooperation in order to make the program a success. 1. Scope This guideline applies to parts/materials/half-finished products used in our products. 2. Criteria for Green Procurement and Request to Suppliers The suppliers are required to deliver products satisfying the following guideline to us (SANYO DENKI Co., Ltd.). Each supplier shall submit a Form 2 Environmentally Harmful Chemical Substances (parts and materials) Survey Sheet and a Form 3 A Guarantee for Nonuse of RoHS Restricted Harmful Substances with the analytical data when it delivers its product to us. 3. Basic Polices and Criteria None of the substances prohibited in this guideline shall be contained in products that you deliver to us. Chemical substances that may affect the environment shall be controlled by classifying them into the following three categories. (1) RoHS restricted substances There are six substances whose use is prohibited by the RoHS Directive. Exemptions from the prohibition are specified in the RoHS Directive. The substance in a product and rate of the substance in the homogeneous materials including intentional inclusions or impurities shall be presented by means of Form 2 Survey Sheet. Form 3 A Guarantee Letter shall be also submitted at the same time. The analytical data based on the actual measurement of the homogeneous materials shall be attached to the guarantee letter for verification. The material safety data sheet (MSDS) shall not be used. (2) Prohibited substances Substances that cannot be used due to international/national regulations or customer requirements. If any of them are contained or included as impurities, present their amounts. (3) Controlled substances Substances that are subject to control/reduction when used in our products. If any of them are contained, present their amounts. 4. Definition of terms Note 1) Intentional inclusion It refers to addition/filling/adhesion by a manufacturer to continuously maintain the functionality/quality of their product. The use of impurities in the manufacturing processes for a semiconductor or the like in order to change its characteristics (doping) shall be deemed to be intentional inclusions. 2) Inclusion When a chemical substance is included in a product as a component, a residue or an adhered substance, it shall be deemed to be an inclusion whether it is an intentional inclusion or not. 3 3) Impurity It refers to an unintentionally added/included/adhered substance, a substance that cannot be completely removed with the current technology during the industrial material refining process, or a substance generated during synthetic reaction that cannot be completely removed with the current technology. If an impurity is used to alter the characteristics of a material, it will be regarded as "inclusion." 4) Homogeneous material A material that cannot be mechanically decomposed into other materials. - Basically, "mechanically decompose" means removal of a material through a mechanical operation such as unscrewing, cutting, crushing, grinding, or polishing. Environmentally Harmful Chemical Substances: Applicability and Source 1) RoHS restricted substances Six RoHS restricted substances: [DIRECTIVE 2002/95/EC OF THE EUROPEAN PARLIAMENT AND OF THE COUNCIL of 27 January 2003 on the restriction of the use of certain hazardous substances in electrical and electronic equipment] Following six substances shall not be intentionally included in any product to be delivered to us. Also, the concentrations of those substances in any product that can not be removed due to some technical reasons shall not exceed the allowable limits. 1. Cadmium (Cd) 2. Lead (Pb) 3. Hexavalent chromium (Cr+) 4. Mercury (Hg) 5. PBB (Polybrominated Biphenils) 6. PBDE (Polybrominated Diphenil Ethers) Allowable limits of concentration of impurities contained 1. Cadmium (Cd) : 75 ppm 2. Lead (Pb): 1000 ppm, however, 300 ppm for a PVC cable (US regulation of the Proposition 65) 3. Hexavalent chromium (Cr+): 1000 ppm 4. Mercury (Hg): 1000 ppm 5. PBB (Polybrominated Biphenils): 1000 ppm 6. PBDE (Polybrominated Diphenil Ethers): 1000 ppm * Concentrations of the impurities shall be measured for each of homogeneous materials at the appropriate part of the material and be expressed in ratio of mass. Substance name: Cadmium and its compounds Applicability: All cadmium containing substances such as metals, alloys, inorganic compounds, organic compounds, inorganic salt, and organic salt. Measurement standard: (1) Pretreatment There are the following four pretreatment methods: 1. Incineration in the presence of sulfuric acid GDY Attachment 4H -3/6

4 2. Pressure acid decomposition in an airtight container (including microwave acid decomposition; ex. EN 13346:2000 or EPA 3052: 1996) 3. Acid decomposition with nitric acid, hydrogen peroxide solution, and hydrochloric acid (ex. EPA 3050B Rev. 2: 1996) 4. Wet type decomposition with sulfuric acid, nitric acid, and hydrogen peroxide solution (ex. BS EN 1122:2001) *If a sediment (insoluble matter) occurs during pretreatment, you will need to completely solve it with a specific method (alkaline fusion, etc.). (2) Measuring method There are the following four measuring methods: 1. Inductive coupling - Plasma emission spectrometer [ICP-AES, (ICP-OES)]; ex. EN ISO 11885: Atomic absorption spectroscope (AAS); ex. EN ISO 5961: Inductive coupling - Plasma mass spectroscope (ICP-MS) Substance name: Lead and lead compounds Applicability: All lead containing substances such as metals, alloys, inorganic compounds, organic compounds, inorganic salt, and organic salt. 5 RoHS Exempted Item The following items are exempted from the restrictions. (1) Mercury in compact fluorescent lamps not exceeding 5mg per lamp. (2) Mercury in straight fluorescent lamps for general purposes not exceeding: - halophosphate 10mg - triphosphate with normal lifetime 5mg - triphosphate with long lifetime 8mg (3) Mercury in straight fluorescent lamps for special purposes. (4) Mercury in other lamps not specifically mentioned in this document. (5) Lead in glass of cathode ray tubes, electronic components and fluorescent tubes. (6) Lead as an alloying element in steel containing up to 0.35% lead by weight, aluminium containing up to 0.4% lead by weight and as a copper alloy containing up to 4% lead by weight. (7) - Lead included in a high-melting point solder (that is lead-based alloy and the solder in which the content of lead is 85% or more in weight). - Lead included in solder that is used for a server, a storage and a storage array system, equipment used in a network infrastructure for switching, signal sending and transmission and control devices for a network. - Lead used in a ceramic part for electronic use (e.g. a piezo electronic device) (8) - Cadmium and its compounds included in an electric contact point and cadmium plating applied on such a part. However, the use shall not be applied to those substances of which sale and use are prohibited by the Directive 91/338/EECC that is a revision of the Directive 79/769/EEC restricting sale and use of specific hazardous materials and their compounds. (9) - Hexavalent chromium used for rust prevention of the carbon steel cooling system in an absorption type refrigerator. 9a: Decabromodiphenilether (DecaBDE) in a polymer product 9b: Lead included in a bearing housing and a bushing made of lead-bronze (11) Lead included in a connecting system for a compliant pin (12) Lead used as a coating material for the C ring of a heat transfer module (13) Lead and cadmium included in an optical glass or filter glass. (14) Lead included in solder composed of three or more substances used at pins of a microprocessor or used to connect a package and in which lead content is 80% or more and less than 85%. (15) Lead included in solder making an electrically feasible circuit between a semiconductor die and a carrier in an integrated circuit flip chip package. (16) A linear incandescent lamp with a silicate coated tube (17) Lead halide used as an optically radiant material in a high luminous discharge lamp to be used exclusively for a copy machine. (18) Lead used as an activating agent included in fluorescent powder (lead content is 1% or less in weight) in a discharge lamp that is used in a diazo copy machine, a risography machine and an insect catching device, and is used as a special lamp for a photochemical hardening process in which a fluorescent material such as SMS ((Sr, Ba)2MgSi207:Pb), and also is used as well as a sunburning lamp in which a fluorescent material such as BSP (BaSi205:Pb) is included. (19) Lead included in PbSiSn-Hg and PbInSn-Hg that are included in a specific constituent as a primary amalgam as well as in PbSn-Hg as a supplementary amalgam in an extra compact energy saving lamp (ESL). (20) Lead oxide in glass that connects front and rear materials in a thin type fluorescent lamp used in a liquid crystal display (LCD). (Additional exemptions shall be also applicable in compliance with the attached documents to the latest edition of 2002/95/EC.) GDY Attachment 4H -5/6

6 Substance name: Heavy metals (mercury, cadmium, hexavalent chromium, lead) Applicability: Packaging materials that are used in our products and to be delivered to our customers. Permissible concentration: The concentration of heavy metals (mercury, cadmium, hexavalent chromium, lead) shall be less than 100 ppm for each of the packing materials including ink and paint. (1) If there is any chromium in a material, analyze and determine its total quantity and make sure that the concentration of the four elements is less than 100 ppm. In this case, chromium may be pretreated together with cadmium and lead. (2) If the concentration of the four elements is 100 ppm or more, subtract the measured amount of chromium from the total quantity and make sure the resultant concentration is less than 100 ppm. (3) In addition, check the chromium for hexavalent chromium; no hexavalent chromium shall be detected. Measurement Criteria: (1) Pretreatment For cadmium and lead, use the same method as for cadmium and lead contained in plastic materials. For the total quantity of chromium, use the same method as for cadmium contained in plastic materials. There are the following three pretreatment methods for mercury: 1. Pressure acid decomposition in an airtight container (including microwave acid decomposition; ex. EN 13346:200 or EPA 3052: 1996) 2. Cold vapor atomic absorption spectrometry 3. Wet type decomposition with sulfuric acid and nitric acid, using a digestion flask with reflux condenser (Kjeldahl method) * With any of the above methods, be careful to prevent mercury from volatizing. If a sediment occurs during pretreatment, you will need to completely solve it with a specific method. (2) Measuring method For cadmium, lead, and the total quantity of chromium, use the same method as for cadmium and lead contained in plastic materials. For mercury, also use the same method as for cadmium and lead contained in plastic materials. However, if a low concentration of mercury is expected, it is recommended to analyze it with reduction vapor atomic absorption spectrometry, ICP-AES (ICP-OES) with hydride generation apparatus, or ICP-MS. 2) Prohibited substances Substances used in packaging materials We specify prohibited substances based on the following regulations: 1. Ozone layer protection related laws such as regulations on specific substances (substances regulated under the Montreal Protocol) 2. Article 55 of the Industrial Safety and Health Law (prohibition of production, import, and use) 3. Class 1 & 2 chemical substances according to the Law Concerning Examination and Regulation of Manufacture and 4. Law Concerning Special Measures against Dioxins 5. Restrictions on the marketing and use of certain dangerous substances and preparations; European Council directive 76/769/EC, etc. 6. Substances designated as cancer-causing substances (group 1) by Japan Society for Occupational Health 7. Class 1 substances (permission for production required) according to the Ordinance on Prevention of Hazards due to Specified Chemical Substances 8. Law on the Regulation of Nuclear Source Material, Nuclear Fuels Material and Reactors 9. Poisonous and Deleterious Substances Control Law (specified poisonous substances) Exemptions Substances to be used for the following purposes shall be exempted from application of the rule to prohibit the substances from being included in a product. A material in which arsenic of 1000 ppm or less content is included as an impurity.
