ط Abstract The Criminal Responsibility for Possible Crimes Prepared by: Moutaz AboSoulm Supervised By: Dr. Ahammad Alwzi This study aimed to shed light on the nature of criminal liability and possible crimes and related concepts, study adopted in answer to the problem before the descriptive approach, as well as the dependence on the method of content analysis to analyze the criminal responsibility for the crimes possible and everything relating directly or indirectly to this topic, in addition to the use of a qualitative approach in order to reach the desired results of the objective of the study. The findings of this study to a number of important results : that criminal liability is based on freedom of choice restricted down the offender because he willingly went about breaking the law, but if it was not possible to impose the penalty, it was found that freedom of choice is the basis for criminal liability. As it turns out that the elements of criminal responsibility is the two pillars of the crime and the Civil Code, and falls under the corner of the crime elements of the crime of material and moral, as it represents a material element apparent face it, the mental element represents the face of Internal her, as well as the results indicated that malice is assumed expectation actual composition and not mere expectation assumed by the person usual according to the course of the normal course of things, and where the malice kind of intent equals intent direct in terms of the impact they both arrange the direct responsibility, and here is the application of the rules of malice on the responsibility of the actor directly without the need for text explicitly ruled this case the texts of special included in the penal legislation which stipulates explicitly the responsibility of the actor about the potential outcome.

ي The study made a number of recommendations including: work on the attribution of crime to potential error inherent in the will of the criminal incident resulting from the failure of the duty of the offender can be avoided and adequate to avoid occurrence. And emphasize the importance of unifying conflicting interpretations on the basis of criminal responsibility for the crime potential confined corners in the two pillars of the crime and the Civil Code. Jordanian legislator also recommended the introduction of mitigating factors in no conviction that the actor take caution to avoid the prohibited result.
