ك Abstract The Concept of Military Necessity in International Humanitarian Law Prepared by: Anas Jamel Al Lozi To Supervision: Dr. Abdul Salam Hammash The principle of military necessity and an important corner of rules of international of humanitarian law, and this principle is animated inherently non-adjustable or specify clearly, and this is what we have found through our study of this principle, as every armed conflict the special nature which is different from the other. On this day, we find that a lot of countries and major especially the ones used this principle as an excuse to violate rules of international of humanitarian law, which in turn seeks to protect non-combatant during the armed conflict, whether people fighters came out of the cycle of conflict, for one reason or another, as well as civilian objects with no income in armed conflict. I have made an effort in this study, study and analysis of the legal provisions contained in international treaties relating to armed conflict (the four 949 Geneva Conventions and their Additional Protocols, 977) in order to clarify the role of these texts in tuning this concept and establish the conditions and limitations that restrict the right of parties to the conflict in the use of the principle of military necessity, for example, the condition for the use of this principle is the need to take into account humanitarian considerations and not to cause or causing unnecessary pain.
ل I also highlighted the role of the International Criminal Courts in reducing the use of this principle and the development is necessary to punish the legal rules and accountability for those who violate this principle, is the creation of the International Criminal Court is an important milestone for the international community a legal tool to alleviate the asylum disputing parties to use the principle of military necessity and the resulting this violation of the principle of heinous crimes shock the conscience of humanity.
