ط Seller's Responsibility absolution from Guaranteeing the Hidden Defect in the Sale's Contract Student name : Waleed Muhammad Al-Wazzan Doctor: Muhnnad Abu Mugly Abstract This study aimed to show the mechanism through which the seller's responsibility absolution is a accomplished from guaranteeing the hidden defect in the sale's contract, by addressing the articles texts from the Jordanian civil law and the comparative laws. The study's problematic represented in this study is that the influencing defect was not dealt with by the legislator and others legislations by more care and comprehension such ad the old and hidden defect. The study consisted of five chapters. The first consisted of introduction and study's problem, study's questions, goals and importance, then the study's limits and determinants, study's terms, theoretical frames, previous studies and methodology. While the second chapter has dealt with the seller's commitment to guarantee the hidden defects through two section, the first section included the nature of the hidden defect that demands guarantee and its provisions, while the second section included the seller's guarantee of the hidden defect. The third chapter dealt with guarantee of the defect absolution in the selling contract through tow sections, the first section through the buyer's default before demanding the guarantee, while the second section through the buyer's abdicating guarantee. The fourth chapter dealt with the types of no demand for guarantee through two sections, the agreement for not demanding the guarantee, and the second section dealt with eliminating the buyer's right to file a case for a guarantee because of the end of the legal period. Then presenting the conclusion, the results and the recommendations.
