Implementation Status and Key Decisions After 30 months of implementation (effectiveness = January 2015) the project has met only one of the three disbursement conditions: the signature of the cooperation agreement between SOCOF and the Government. Although the most important disbursement condition (for the construction of the infrastructure) is not yet met, the Project team finalized all the necessary actions for the recruitment of the vendor which will build the fiber optic infrastructure between Moanda and Kinshasa. On Sept. 7, 2017 the bank gave its no-objection on the completion of the bidding process and selection of consortium THAIHAN FIBER OPTICS-SeAH Networks Co Ltd for an amount equivalent to 14,875,675 USD. Regarding the Disbursement Conditions, a "revised" version of the ICT Legal Framework was submitted to the Parliament on April 2017. Although not officially informed, the Bank team noticed that this version contained provisions (articles 5-82, 15, 17, 81, 82, 100 et 102) not aligned with best international practices (granting exclusivity ownership, management and commercialization of telecom infrastructure to the public operator). The Bank team was also informed that the Infrastructure Commission at the Parliament was in charge of revising the legal framework before submission for adoption to the plenary session of the Parliament. The fulfillment of all disbursement conditions remains the project's top priority, and the Bank team wishes to stress that the adoption of an acceptable legal and regulatory framework would trigger the construction phase of the network and immediately boost the disbursement rate above 30%.
