Policy Resolution 20141029 Snow Removal Policy THIS POLICY RESOLUTION 20141029, Snow Removal Policy is made, effective as of October 29, 2014 by THE PARKE AT OCEAN PINES HOME OWNERS ASSOCIATION, INC. ("Association"). RECITALS A. Whereas, The Parke at Ocean Pines Home Owners Association, Inc. is a Maryland non-stock corporation located in Worcester County, Maryland; and B. Whereas, the Bylaws of The Parke at Ocean Pines Home Owners Association, Inc. were adopted pursuant to a Home Owners Constitution recorded among the Land Records for Worcester County, Maryland, on April 10, 2000 at Liber 2837, Folio 295, et seq.; and C. Whereas, the Board of Directors has according to the Maryland Home Owners Act, approved the Policy Resolution No. 20141029, Snow Removal, during an open Board of Directors Meeting held on October 29, 2014. NOW, THEREFORE, the policy is hereby adopted as follows: See adopted Policy Resolution No. 20141029, Snow Removal Policy attached hereto as Exhibit A. The above-referenced Policy Resolution was adopted by the Board of Directors as of the date set forth in accordance with the Maryland Home Owners Act.
THE PARKE AT OCEAN PINES Policy Resolution # 20141029 Snow Removal Policy Objective It shall be the objective of The Parke HOA, in the interest of providing for the safety of the residents, to provide reasonable and necessary snow removal services from sidewalks, lead walkways, driveways, private lanes, and Clubhouse and Mail Pavilion parking lots consistent with its constitution and codes to assist its residents in the event of any substantial winter snow storms. Snow removal from streets and public thoroughfares is the responsibility of Ocean Pines and/or Worcester County. Policies Preface Recognizing The Parke is an age-restricted community, we have an ever increasing population of elderly residents, handicapped residents and residents with health issues; therefore, there will be NO priority plowing list. If any resident is faced with an emergency situation during a snow storm, they should call 911 or contact the Ocean Pines Police Department at 410-641-7758. 1. Ocean Pines (or in the case of Manklin Creek Road, Worcester County) will provide snow removal on streets and public thoroughfares within the Parke under their guidelines. 2. Every effort will be made to coordinate snow removal operations provided by The Parke HOA with snow removal provided by Ocean Pines and/or Worcester County. 3. When snow stops and roads have been cleared, The Parke sidewalks, walkways and driveways will be plowed or shoveled at the discretion of The Parke's General Manager or a designated party as directed by The Parke HOA Board of Directors. Factors to be considered are extended weather forecasts and the amount of current and forecasted snow fall. It is the GOAL of The Parke HOA to have community streets, parking lots, walkways, resident driveways, private lanes and sidewalks plowed AS SOON AS PRACTICIBLE. 4. The Parke HOA snow removal contractor has the equipment and manpower to remove snow from driveways with parked vehicles. To assist the snow 1
removal contractor in plowing driveways it is recommended to park vehicles in the garage during snow storms. 5. Residents who do not want their driveways cleared should advise the General Manager and they will be provided with a marker to display on their light poles indicating they wish to OPT OUT of having the snow removal contractor plow their driveway and sidewalk. If possible residents who usually park their vehicles or have guest vehicles in their driveways will be encouraged to move their vehicles to the Clubhouse parking lot after it is cleared to enable clearing of their driveways. NO Parke HOA reimbursement for individual resident snow removal. NO Parke HOA assessment reduction for individual resident snow removal. 6. Ice melting chemicals or sand may be used by The Parke HOA/contractor on the common areas (parking lots, walks around the clubhouse & mail pavilion, etc.). The Parke HOA will not treat any private residential property with any ice melting chemicals or sand. 7. Homeowners may, at their own risk, spread snow and ice melters such as sodium chloride, calcium chloride, sand or other similar products on their property to prevent slips or falls or aid in snow removal. Any damage resulting from the use of such materials or unsafe conditions if products are not used will be the responsibility of the homeowner. It is important that all residents remember that we live in a Critical Bay Wetland Area; therefore any product used should be environmental friendly. 8. Snow removal services when provided by The Parke HOA will not relieve the homeowner from their legal responsibility for safety of walkways and driveways on their property. 9. The General Manager as designated by The Parke HOA Board of Directors will continue to communicate with residents regarding snow removal operations via posted signs in clubhouse and Mail Pavilion, e-mail, and The Parke website. Every effort will be made to advise and inform residents of progress during storm conditions. The street plowing schedule that The Park HOA snow removal contractor will be following for plowing will be posted on the Parke website. Every effort will be made to rotate the plowing schedule for each snow storm. 2
10. The Parke HOA will have the snow removal contractor clear the area around all community FIRE HYDRANTS and STORM DRAINS.
