4 1.0 General Information 1.1 Project Title and Location Title: SUPPLEMENTAL SIDEWALK CLEANING SERVICES Location: Designated clearing routes will be supplied by the City of Syracuse. Designated clearing routes will total ~20 centerline miles in different areas of the City.This 20 centerline total may include areas that have sidewalks on both or only one side of the street. These routes will form a connected network of cleared pedestrians facilities during winter months. 1.2 RFP Schedule and Delivery Information Submit one (1) original, eight (8) bound copies and two (2) copies on a USB Drive to: Mary E. 5 2.0 Background Notice is hereby given that the City of Syracuse is seeking to designate a preferred vendor(s) to offer supplemental sidewalk snow clearing to a predetermined network of City streets. The City of Syracuse receives and average of 124 inches of snow a year. Based upon Article 2, Section 24.3 keeping sidewalks clear of snow is the responsibility of property owners. It states that anyone with a sidewalk parallel to any public street, shall clear and keep cleared any snow or ice which has accumulated on the surface. This clearing of the snow and ice shall be completed by 6 p.m. of the day following the accumulation. No person shall shovel, sweep, throw, plow, or otherwise deposit snow or ice into the street, sidewalk, or park located within the city. The City of Syracuse is interested in piloting a program that will supplement this ordinance. More specifically the City is looking to contract with firms to clear the sidewalks along ~20 miles of specific roads that see high pedestrian activity. These roads were identified through a collaborative process with multiple stakeholders, and may be seen in Appendix B. The City will identify a clearing threshold, which means that when snowfall is expected to surpass that threshold, the City will require the contractor to clear the snow from the identified sidewalks by 7:00 am. Weather information will be gathered by the National Weather Service - Syracuse station, located at Syracuse Hancock International Airport. The table below shows historic information about the number of times Syracuse has received various snowfall amounts over the past three years. Contractors should refer to this chart as they complete the cost worksheet supplied in Appendix A. 6 3.0 Project Description / Purpose & Objectives: The City seeks to designate a preferred vendor(s) to offer supplemental sidewalk snow clearing to a predetermined network of City streets during the Winter of All labor, materials and equipment is to be the responsibility of the Vendor. The City sets forth the following guidelines for a successful Vendor(s) proposal: Term: Contract commitment to provide snow clearing services from December 1st, 2018 to March 31st, Evaluation: Approved Vendor(s) will require an initial performance review after the first 3 deployments for snow removal services. Reviews will be conducted by the the Program Manager and may also include other applicable persons or groups. Location: Predetermined routes can be found in the attached map: APPENDIX B: CLEARANCE MAP Exclusivity. The City of Syracuse will not grant exclusive operating rights as part of any agreement. Liability and Insurance: No contractor shall commence work under this contract until he has obtained all the insurance required hereinafter issued by a company duly authorized to do business in the State of New York and which has a Best s rating and financial size of at least B+, X and such insurance has been approved by the Owner. The contractor shall not allow any subcontractor to commence work on his subcontract until all similar insurance required of the subcontractor has been obtained and approved. Approval of the insurance by the Owner shall not relieve or decrease the liability of each contractor. CLAIMS MADE INSURANCE SHALL NOT BE ACCEPTABLE. Workers Compensation and Other Mandated Insurance. Each contractor shall take out and maintain during the life of this contract the statutory Workers Compensation and Employer s Liability Insurance, and all other insurance required by law, for all of his employees engaged in work under this contract, and in case any such work is sublet, the contractor shall require the subcontractor to provide all similar insurance. 7 Bodily Injury and Property Damage Liability Insurance. Each contractor shall take out and maintain during the life of this contract a Comprehensive General Liability Insurance with Contractual Liability Coverage policy for Bodily Injury, including Accidental Death, and Property Damage, as shall protect him and any subcontractor performing work covered by this contract from claims for damages which may arise from operations under this contract, whether such operations be by himself, or by any subcontractor or by anyone directly or indirectly employed by either of them The policy limits shall be in an amount not less than One Million dollars single-limit bodily injury, including wrongful death, and property damage. The City of Syracuse and the Syracuse City School District shall be named as additional insured on the certificates of insurance. Also required, the declarations page from your General Liability Insurance policy showing the endorsement that the City of Syracuse and the Syracuse City School District are named additional insured. Insurance Certificates and Policies. The certificate of contractor s General Liability Insurance is to be filed with the Owner through this office. This certificate of insurance shall contain the following endorsement: IT IS UNDERSTOOD THAT THE INSURANCE COMPANY WILL NOTIFY THE DIRECTOR OF MANAGEMENT AND BUDGET OF THE CITY OF SYRACUSE, NEW YORK, 221 CITY HALL, SYRACUSE, NEW YORK AND THE ENGINEER BY REGISTERED MAIL TWENTY (20) DAYS PRIOR TO ANY CANCELLATION OF THE POLICY MWBE Opportunities: Contractor(s) submitting proposals are encouraged to complete the enclosed Form H- EEO-Employment Information Report HRC-1 to note the composition of your firm s workforce. If subcontractors are being utilized a separate form should be submitted showing their individual workforce composition. Although firms do not have to be certified as a MWBE (Minority and Women owned Enterprise) to propose on this Request for Proposal, MWBE certification can be a consideration the RFP committee can use in its contract award. 8 4.0 Scope of Services The program shall utilize proper snow clearing equipment that is operated by trained personnel (i.e. Shovels, Rotary Brooms, Snow throwers, etc.) to remove snow, ice or hardpack from sidewalks, corners and crosswalks, located within the municipal Right-of-Way. V-Plows are not permitted and shall not be used for clearing. 4.1 Clearing Requirements Location of Sidewalks: A complete list of addresses has been provided on the proposal sheet at the end of this RFP. Contractors are required to inspect each route and associated properties before bidding to familiarize themselves with existing conditions. Clearing Specifics: Contractors will remove all snowfall accumulation from assigned sidewalks. Contractors will use whatever method it determines, in its sole and absolute discretion, to be the most appropriate method to clear snow accumulation. Contractors will be required to clear the sidewalk of snow and ice to the full width of the sidewalk and clear all crosswalks, street corners, and approaches onto city streets so as to maintain a passable sidewalk and crosswalk. Contractors will be responsible to remove snow from crosswalks, street corners, and approaches after city plows have made snow removal passes during and/or after snow events. Ice: Contractors shall treat icy conditions using pet safe ice melt compounds. Ice melt is to be appropriately applied/spread over the sidewalk any time that snow is removed and ice or hardpack remains. Time frame: Contractors will be required to complete snow removal of assigned sidewalks as to comply with Article 2, Section 24.3 and Section 24.4 of the City Ordinance* stipulating snow clearing and disposal requirements related to the public Right of Way. During a large or prolonged snowfall events, in which accumulation is predicted and/or reported to be greater than the amount triggering clearing services, the City will require the contractor to clear the snow from the identified sidewalks by 7:00am. 9 * See Appendix E for City Snow Clearing Ordinance. Safety: All snow and ice management services will be conducted in a safe manner, with care given to the safety of the general public. This includes having all equipment outfitted with the proper lighting devices so as to be visible while operating. B. Property Damage Contractors will be notified in writing by the Program Manager of any property damage that occurs as a result of the snow and ice removal process. Notification will be within 48 hours of Director of Public Works becoming aware of such property damage. Property damage includes damage to homeowner or City of Syracuse turf lawn, sidewalks, corners, or other item as a result of snow and ice management services. The contractor will be solely and wholly financially liable for any damages to the Right-of-Way, associated encroachments, and private property as a result of negligence on the part of the Contractor. The contractor will repair, to the satisfaction of the Public Works Department, any damaged property in a timely manner in the spring season after the terms of this contract. Repairs may include the following street features, but are not limited to; sidewalks, lead walks, curbing, turf/lawn, trees/planting areas, survey monuments, signage, and utility structures. 4.2 Equipment Applicant must provide a detailed listed of equipment to be used in snow removal operations. Contractor(s) shall note that V-Plows are not permitted for use. All equipment is to meet applicable EPA emissions guidelines for small-displacement engines/small-spark engines. Proper documentation showing compliance is to be provided to the City for each piece of equipment. EPA guidelines are found here: ulations-emissions-small-equipment-tools 4.3 Clearing Frequency and Cost Estimation Contractor(s) must complete at least one of the attached FEE PROPOSAL - Appendix A forms, outlining estimated costs for snow removal services. 10 city-wide services, or any number/combination of individual quadrants. 4.4 Anticipated City Roles and Responsibilities The Contractor will be wholly responsible for executing snow removal operations without continued direction or notice given by the City. The City will work with the Contractor(s) to address issues or minor changes as necessary to routes, or clearing practices. 4.5 Billing and Bonding The Contractor will be wholly responsible for submitting bills for services delivered on a bi-weekly basis to the Department of Public Works. A certified check or performance bond in the sum of 5% of the total award will be required as part of the awarded the contract. All such deposits/bond will be returned after the contract term has ended and work has been completed to the satisfaction of the City. 12 6.0 Proposal Requirements Proposals must be succinct and all pages must be numbered. Boilerplate and glossy promotional materials are discouraged; any such materials deemed necessary should be included as a separate appendix and may or may not be considered as part of the evaluation. The Technical Proposal shall address the following: 6.1 Transmittal Letter This section should be one single-sided page maximum. 6.2 Vendor Qualifications & Experience This section, 4 single-sided pages maximum, should include: A description of Contractor(s) qualifications for this project, including the firm s background, resources (financial and personnel), and capabilities in areas relevant to this project. History of Contractor(s) experience on similar projects. Number of years in business / operation 6.3 References This section should be 4 single-sided pages maximum. Please provide the name, location, and brief description of up to three similar snow clearing contracts from previous winters. 6.4 Team Organization This section should be 2 single-sided pages maximum. Indicate makeup of the entire project team. Include identification of the key project team members by name, title, and their specific responsibilities on the project. 13 7.0 Proposal Evaluation and Vendor Selection A selection committee will review all proposals using the below listed criteria. The committee will then select the most highly qualified firm or firms, whose proposal(s) in their judgment indicates the best opportunity for a completely successful project. Ultimately, the selected vendor(s) will be provided a copy of a draft agreement. The City may request to meet with the vendors at any time for further clarification. At the conclusion of the proposal evaluation period, the City will enter into a Services Agreement with the selected Contractor(s). 7.1 Demonstrated Understanding of the Requirements Outlined in this RFP Proposal addresses all elements of this RFP. Proposal completes all applicable forms/worksheets. Proposal follows all requirements as outlined in this document. Contractor demonstrates an understanding of the City s goals and objectives. Contractor demonstrates ability to meet City s schedule requirements for services to be provided from December, 1st to March, 31st. 7.2 Vendor Experience and Qualifications Vendor has proven experience with providing winter maintenance services. Vendor shows capability to deliver, with resources and financial backing. 7.3 Qualifications of the Project Team Key project team members have necessary skills and qualifications. Staffing is sufficient to meet the needs of the proposed system. Key members available to attend meetings in person, as needed. 30 APPENDIX D: CITY OF SYRACUSE REVISED GENERAL ORDINANCE Chapter 24 - STREETS AND SIDEWALKS ARTICLE 2. SNOW AND ICE Sections and Sec Removal of snow and ice from sidewalks. 1. The owner, agent or occupant of any structure or vacant lot fronting upon any park, street or alley, shall clear or cause to be cleared, the sidewalk along the said premises from all snow and ice that may fall or accumulate thereon every day by six o'clock in the afternoon of the following day, except as hereinafter provided. 2. The owner, agent, or occupant of any structure or vacant lot fronting upon any park, street or alley within the area of the special assessment district, as described in chapter 38 herein, shall within four (4) hours after snow ceases to fall clear or cause to be cleared the sidewalk along the said premises from all snow and ice; the time between 8:00 p.m. to 8:00 a.m. the following day not being included in the above four-hour period nor shall the foregoing be applicable to Sundays. In the event of the accumulation of snow and snow ceases to fall: A. Between 8:00 p.m. and 8:00 a.m. the following day, such snow shall be removed by 12:00 p.m. of said day, except Sundays; B. On Sundays, such snow shall be removed by 12:00 p.m. the following Monday. 3. In case the snow and ice on the sidewalk shall be frozen so hard that it cannot be removed without injury to the pavement, the owner, agent or occupant of any structure or vacant lot fronting thereon may within the time specified in the preceding paragraphs cause the sidewalk to be strewn with salt, sand or some similar suitable material and shall thereafter as soon as the weather shall permit, thoroughly clean such sidewalk. 31 Sec Improper disposal of cleared snow and ice. No person shall sweep, throw or deposit or cause to be swept, thrown or deposited any snow or ice into any street gutter or public square or park, or on any sidewalk within the city, from lands or premises abutting or adjoining any such street gutter, public square, park or sidewalk. All commercial snow removal services shall comply with chapter 9, article 14 of the Revised General Ordinances entitled "Snow Removal Contractors". (Gen. Ord.
