25 III. The Institional and legislative background of spatial planning
26 Spatial Planning in Poland 1928 r. - An Order of President PR on building law and housing estates 1938 r. - An Order of Council of Ministers about preparation of defence against aircraft and gas in the housing estates regulatio (its covering the planning of green areas too!) The reform of 1949 divided spatial planning : Country planning and regional planning were transferred to State Economy Planning Commission of Council of Ministers, (former: Central Planning Offiice) Local planning was transferred to Ministry of Territorial Economy (later: Ministry of Construction).
27 Spatial planning system in Poland 1961 introduced centralized spatial planning as a part of economy planning;- effective but political voivodships were created in the place of 17 before. If was a reason of some delays, and a reason of lack of planning cohesion kept hierarchic planning system and domination of economy planning over spatial planning-all territory of the country were covered by general local plans (too general) 1994 the hierarchy of spatial planning were turned over at all only the local spatial arrangement plans has been established the local law from that date. TheGovernment and by Parliament too it is just National Spatial Planning Policy, published in An Act on planning and spatial arrangement on 2003 r. repeated parallel spatial planning as it was before. Since 2004 still are going works on the new act
28 Physical Planning and Arrangement Act Spatial planning system According the Act 2003 with amendments in 2006 and 2007 the system of spatial planning is managed at 3 levels adequately to the territorial division of the country: National level (doc.) national spatial management concept/long term strategy Regional level (doc.)voivodships spatial management plans Local/communal level (doc.)studies and local spatial management plans (spatial planning policy). The national spatial arrangement concept provides general guidelines and the voivodshiops spatial management plans are not binding for communies. It leads to numerous conflicts and make strategic investing in Poland difficult. There are only the local spatial management plans that have a binding force between the state and its citizens.
29 Physical Planning and Arrangement Act about the NSAC problematic areas of national importance including hazard areas, which require special studies and plans The Act (2003) states the content of the NSAC. According to the Act NSAC defines: factors, objectives and direction of the countries sustainable development and actions indispensable for its achieving, particularly: main elements of the national settlement system, with definition of the metropolitan areas environmental and heritage protection requirements which includes the areas which must be protected location of the social infrastructure of international and national importance location of the technical and transport infrastructure, strategic water resources and main water reservoirs of international and national importance
30 NSAC Institutional framework According to the Act on Spatial Planning responsibility for the elaborating the national spatial arrangement conception and for national spatial development policy and other planning form at this level lies with the Ministry of Regional Development, The Department of Structural Policy Coordination. One of the main aim of the new document to achieve integration of strategic spatial and regional development planning.
31 Territorial dimension of cohesion policy in MRD Spatial and Regional Development Policy- The Minister of Regional Development (signed the Territorial Agenda for UE, May 2007) Urban Policy - The Minister of Building, now Infrastructure (signed the Leipzig Charter on Sustainable European Cities) We cooperate in the wide fields of territorial cohesion. The Ministry of Regional Development/Department of Structure Policy Coordination/Territorial Development Unit s actual main tasks: The First Action Programme of the TA Task Group of Action 2.2. (territorial impact assesment), Coordination of: Network Programmes (URBACT, ESPON), spatial development initiatives (VASAB, CEMAT, Common Spatial Document of the V4 Countries) Green Book TC

33 National Development Strategy MAIN OBJECTIVE: To improve the standards and the quality of life of Poland s residents: individual citizens and their families PRIORITIES 1. 35 Program Operacyjny Rozwój Polski Wschodniej Working on NSAC Cele of October 2006r. The Council of Ministers undertook a decision about starting to work on The National Spatial Arrangement Conception by the Ministry of Regional Development 2. At the same time The Council of Ministers accepted Course and timetable for works on The National Spatial Arrangement Conception far-seeing realization of this document at the end of second quarter of the year of June 2007 The Council of Ministers accepted Thesis and principles for NSAC This document was approved before by The State Council for Spatial Planning The Convent of Marshals of Voivodships of Poland Common Commission of Covernment and Territorial Self-government 4. An extension conspectus of The National Spatial Arrangement Conception has been prepared at December 2007
36 The first draft of the document 1. At the end of July 2008 the first version of The National Spatial Arrangement Conception was elaborated 2. The Ministry of Regional Development are working on Implementation Document of NASC , it will identify possibilities of implementation of decisions and recommendation of NSAC At the end of November we are expected the second draft of NASC
37 NSAC the organisation structure 1. Team of Science Consultants, leading by prof. Piotr Korcelli, Director of Institute of Geography and Spatial Organization, the Polish Academy of Science 2. Realization Team, completed of representatives of ministers being responsible for sectors generated the biggest needs for space and of person delegated by Union of Polish Voivodships (regions) 3. The State Council for Spatial Planning - the advising body of Prime Minisiter
38 The thesis and guiding principles for NSAC NATIONAL SPATIAL ARRANGEMENTS CONCEPTION AND PROGNOSIS OF ENVIRONMENTAL IMPACT ASSESMENT The primary conditions and guidelines for strategic objectives and national arrangement trends for assuring and increase in the level of social, economic and territorial cohesion ROLE of NSAC Functions It provides prerequisites for preparing government task programmes It contains the diagnosis of external and internal conditions, and on the basis it formulates basic objectives of the national spatial arrangement policy It defines the general directions of its implementation and sets concrete tasks to be implemented by primary and central administration units in the nearest future The scope of issues presented in and the degree to which conditions, objectives and national land management policies are developed meet the requirements of the Spatial Planning Act It constitutes basis for the preparation of regional (voivodship) land use plans and sectorial development policies for individual sectors (ministries) Growth of competitiveness of Polish regions and prevention of their social, economic and spatial marginalization STATE LEVEL > REGIONAL LEVEL > LOCAL LEVEL Relations Rotterdam Proces Cross-border, transnational and interregional cooperation (+INTERREG) Government tasks programmes, sartorial strategies, national public investments Strategies of voivodeship development Voivodship /and sea areas / plans of spatial arrangement & Environmental Impact Assessment Local plans of spatial arrangement & EIA

Integration of the sea & land planning. Space order. Compulsive spread of urban areas- the urban sprawl. Protection of natural resources, values of culture and landscape. Hazard areas.
40 NSAC the fields of cooperation The document will be consulted with neighbouring countries, and we intend to present second version of NSAC on the special seminar in the begening of You are invited just now! There are a lot of common areas of cooperation, like transport corridors or environmental protection. NSAC 2008 needs elaboration of: Environment Impact Asessment and Territorial Impact Assesment. We need cross-border cooperation in that fields.
