Husqvarna Group's Restricted Material List (RML) includes a number of prohibited (Banned) or restricted (Thresholds) chemical substances in products and processes. Husqvarna intends to minimize the amount of hazardous chemical substances in products and processes. The RML is a tool for all parties involved in the product development and manufacturing process to work in this direction and still maintain the desired properties and a high quality level. 3 Applicability The RML is an integral part in all supply agreements, even if it is not enclosed with every purchase order. The purchasing organization ensures relevant information to suppliers. By signing a purchase agreement with Husqvarna, the signatory is obliged to follow the requirements and restrictions accordingly. Policy for Restricted Material List ( RML ) The RML specifies the requirements of chemical substances in components built into the products (including semi-finished products, parts, materials and packaging, in unreacted form) and is valid for all supplies of materials, preparations, additives, color-batches and others, which are used by Husqvarna Group. Chemical substances on the Restricted Material List can be present in the maximum noted threshold level in articles or homogenous material. The most restrictive of local law and the RML shall take precedence. Products containing a chemical substance listed on the RML as banned or above stated threshold shall not be supplied to and can be rejected by Husqvarna Group. Chemical substances occurring solely in the form of impurities in a specific product can be tolerated by Husqvarna, provided that (i) the content is very low and (ii) Husqvarna Group has approved it. Threshold levels must be withheld independently of legal requirements. In case an exemption is listed, this is only valid for the specified application. Requirement on material declarations Background Suppliers are expected to declare the material and substance content of products delivered to Husqvarna Group. The reason for this is the rapid increase in restrictions and information requirements on materials and chemical substances in products. Material declaration form To increase the efficiency of the material declaration process, Husqvarna Group has chosen to base the material declarations on the IPC 1 standard form, IPC 1752A or IEC These are currently the most commonly used material declaration formats for detailed reporting. Full material declaration according to IPC 1752A (A+D) or IEC is Husqvarna Groups business requirement for all parts and materials. If this can t be achieved, article declarations can be used for all applicable regulations including RML. This is preferably done in the IPC 1752A (A+C) or IEC Absence Declaration data format. Declarations must be updated after a regulation or RML is changed. 4 Requirements on material declaration classes Husqvarna Group generally requires a full material declaration, class A+D. Class A+C can be used as an exception for complex products if the supplier does not have the capability to give a full material declaration. For Class A+C the xml file submitted by Husqvarna Group (via Total Parts Plus) is mandatory to use as it contains Husqvarna Group specific lists of substances to declare. Requirements on IPC 1752 class A+D and IEC Declaration of 100 percent of product composition Husqvarna Group has the following demands on the content of a IPC 1752 class A+D or IEC62474 Declaration of 100 percent of product composition declaration: The materials declared as homogenous materials shall be truly homogeneous, e.g. a part with plating must not be declared as one material, as it is actually two materials. When declaring a chemical compound the unique CAS-number for the chemical compound shall be used, not the CAS-numbers for the contained chemical elements. Note however the cases below: - When declaring alloys, the CAS-numbers of the different elemental metals shall be used. - When declaring polymers, the CAS-numbers for the substances used to produce the material shall be used. Note: It is the substances used in the process, not the individual chemical elements that shall be declared. - Additives as fillers, pigments, flame retardants, plasticizers must always be declared. If there is a need to not disclose the exact content of a certain material, a maximum of 5% of the product weight can be declared as trade secret. 5 Requirements on class IPC 1752 A+C or IEC Absence Declaration Class C in the IPC 1752A and IEC Absence declaration is based on lists of substances to declare. The form submitted by Husqvarna Group contains the Husqvarna Restricted Material List (RML) and substances under the RoHS directive and the REACH candidate list 3. As the EU REACH candidate list is revised twice a year using class C means that suppliers can be requested to declare a new class C declaration up to twice a year. 3 See the European Chemicals Agency, ECHA, Registration (EU-REACH) Manufactures and importers of chemicals and articles have a duty to register, for each legal entity, substances (either separate or in preparations) in quantities over 1 tonne per year (per manufacturer/importer), unless the substances are exempt from registration. Exemptions Exceptions to fulfill the RML will not be made, unless otherwise approved by Husqvarna s product department. Exceptions will not be made for regulatory restrictions in force. Exceptions to fulfill the RML may be made if 1) it is not technically possible to substitute and/or 2) Husqvarna Group and/or its supplier have documented its decision to phase out, including a time plan. Supplier process requirements Husqvarna suppliers are expected to have and follow processes securing that Husqvarna restricted material list is followed and to mitigate any risks for non-compliance. Such processes can consist of but are not limited to Roles & responsibilities with authority to manage Husqvarna restricted materials requirements Risk assessments Supply chain management Internal training Non-compliance reporting In-process control Chemical analysis Husqvarna expects suppliers to provide evidence of their processes upon request. Evidence can consist of applicable procedures or a description of suppliers processes including a description how Husqvarna Restricted materials is managed. The responses will be used to determine supplier risk level. Further audits can be performed to verify this. Sanctions of Violations In case a restricted or banned chemical substance is found in delivery from a supplier or included in a Husqvarna Group product, the supplier agrees to indemnify and hold Husqvarna Group harmless from, against and in respect of all damage or loss incurred by Husqvarna Group resulting from or arising out of such breach. 6 Testing The chemical restrictions in this document will apply to all orders, although test reports not have to be produced in all instances. Occasionally Husqvarna Group may request testing to be performed, at the expense of the supplier, to ensure that the required outlined in this document are complied with. Unannounced test can also be performed by Husqvarna Group for the same reasons. Accredited Laboratories according to ISO17025 and Official standard testing methods shall be used.. 7 Definitions Article - Products, spare parts, components, materials CAS nr -Chemical Abstracts Services registration number. A unique number assigned to each substance submitted to CAS. Used worldwide to identify chemicals. Chemical - A chemical is another word for substance or compound. Identified by a unique CAS or EC number. Homogenous material -Homogeneous material in means a component or material that cannot be mechanically disjointed into different materials by unscrewing, cutting, crushing, grinding, abrasive processes and similar procedures. Intentionally added Deliberate use of a substance to achieve certain functions. If intentionally added anywhere in the supply chain, the substance shall be treated as intentionally added. Not detected: Substance is not detected with official standard testing methods Mixture: A mixture or solution of two or more substances. Reference Legal or other reference to requirements that was considered when the chemical substance was included in the RML. The requirements (threshold level and banned) apply to all articles delivered to Husqvarna Group, besides the listed exemptions. Packaging - means all products made of any materials of any nature to be used for the containment, protection, handling, delivery and presentation of goods, from raw materials to processed goods, from the producer to the user or the consumer. Nonreturnable items used for the same purposes shall also be considered to constitute packaging. PBT -Substances that are Persistent, Bio accumulative and Toxic are substances that do not easily break down, instead they build up in nature PBT: Persistent Bio accumulative Toxic. PPM - Parts per million = 1 mg/kg = 0,0001 percent by weight Skin contact - Nickel: Prolonged Materials/parts expected to be in contact with the end-user s skin for 10 minutes on three or more occasions within two weeks, or 30 minutes on one or more occasions within two weeks. Skin contact PAH Prolonged contact with human skin or the oral cavity: Examples of articles that come into prolonged contact with human skin or the oral cavity include carrying handles of mobile devices, hand tools (such as the holding area of hammers or screwdrivers), gloves, cases for portable and mobile units (e.g. camera, notebooks), ear plugs or headphones. Short-term repetitive contact with the human skin or the oral cavity: Examples of articles that could come into short-term repetitive contact with human skin or the oral cavity include, key caps, holding devices on domestic appliances (such as blenders or coffee machines), measuring tapes, the buttons on certain kinds of devices (such as handheld game consoles), and thermos bottles.
