This letter advises NHS Boards of increases in the NHS optical voucher values and allowances for repairs and replacements with effect from 1 April 2012. The new voucher values are shown in Annex A and B to the Memorandum to this letter. Practitioner Services will pay the revised values for vouchers presented to suppliers by patients on or after 1 April 2012. 3. Copies of the NHS (Optical Charges and Payments) (Scotland) Amendment Regulations 2012, which bring the revised voucher values into effect, will be available at NHS Board offices for inspection in due course. Directions under the National Health Service (Scotland) Act 1978, Section 2(5) and Schedule 11, paragraph 2(1) and regulation 2(1) of the National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998. The Scottish Ministers in exercise of the powers conferred upon them by section 2(5) of and paragraph 2(1) of Schedule 11 to the National Health Service (Scotland) Act 1978 1 and regulation 2( 1) of the National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 2 and of all other powers enabling them in that behalf, hereby give to NHS Boards the following Directions: 1. These Directions shall come into force on 1 April 2012 and shall have effect in respect of glasses or contact lenses supplied where the testing of sight leading to the supply of the glasses or lenses, or the first such testing, takes place on or after 1 April 2012. 2. In these Directions - "the Act" means the National Health Service (Scotland) Act 1978; "charges for glasses" and "charges for contact lenses" means a charge authorised by section 70( 1) of the Act in respect of the supply of glasses or, as the case may be, contact lenses under the Act. 3. Subject to paragraphs 4 and 5 below, the charge for glasses shall be the aggregate of the following: (a) an amount which represents the cost to the NHS Board or other person on its behalf, of the purchase of the glasses or their components; and (b) an amount which represents the cost to the NHS Board or other person on its behalf, of the dispensing of the lenses. 4. Where the aggregate of: (a) the element of the amount mentioned in paragraph 3(a) above which represents the cost of the lenses; and (b) the amount mentioned in paragraph 3(b) above, exceeds, in the case of glasses each lens which is a single vision lens, 66.60 and, in any other case, 108.30, the charge for glasses shall be the aggregate of that 66.60 or, as the case may be, 108.30 and, except in a case to which paragraph 5 I 1978 (c.29). Section 2(5) was amended by the National Health Service and Community Care Act 1999 (c.l9),. Schedule 9, paragraph 19(1); paragraph 2(1) was substituted by the Health and Medicines Act 1988 (c.49), Schedule 2, paragraph 15(1). Where any patient requires, on clinical grounds, a frame the cost of which is more than that of the cheapest frame in the range supplied by the NHS Board or other person on its behalf, the element of the amount mentioned in paragraph 3(a) above which represents the cost of the frames shall not exceed the cost of the cheapest frame. 6. The charge authorised by section 70(1) of the Act in respect of the supply of contact lenses under the Act shall be 54.20 for each contact lens so supplied. 7. Except in so far as it applies to glasses and contact lenses supplied where the testing of sight leading to the supply of the glasses or contact lenses, or the first such testing, has taken place prior to 1 April 2012 the Direction made under paragraph 2(1) of Schedule 11 to the Act and regulation 2(1) of the National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998, which came into operation on 1 April 2009 is revoked. Directions under the National Health Seuvice (Scotland) Act 1978, Schedule 7A, paragraph 6(1) The Scottish Ministers, in exercise of the powers conferred upon them by paragraph 6(1) of Schedule 7A to the National Health Service (Scotland) Act 1978 3 and all other powers enabling them in that behalf, hereby direct the NHS Board to comply with the Directions given by them under section 2( 5) of and paragraph 2( 1) of Schedule 11 to the National Health Service (Scotland) Act 1978 and regulation 2(1) of the National Health Service (Optical Charges and Payments) (Scotland) Regulations 1998 4, dated 28 March 2012 and coming into force on 1 April 2012.
