Note :- Nomination is the process of formally offering oneself as a candidate for any elective office. If a candidate is nominated to contest election in more than one constituency of the same Panchayat all his nominations are liable to be rejected (Ahammedkutty V. Ali 2003 (3) KLT 739). The officers or employees of Corporation controlled by the State or Central Government is disqualified to contest election. The officers and employees of KSRTC constituted under the Kerala Road Transport Corporation Act is disqualified to contest election. An empaneled 23

conductor in KSRTC is therefore disqualified to contest election. An officer or employee of a Government Company and officers or employees of Statutory Boards like Kerala State Electricity Board are disqualified to contest election. Employees of Universities within Kerala are disqualified to contest election. Employees of Co-operative Societies in which the Government is having more than 50% share is deemed to be a Government Company and is disqualified to contest election (Judgment dated 05-09-2005 in W.P. (C) No. 19463/ 2005). Service includes provisional service also. Therefore, a person appointed for 179 days through Employment Exchange under Rule 9 (a) (i) of part II of KS and SSR(Judgment dated 11-07-2000 in W.A. No. 1148/2000) and an SLR (Seasonal Labour Roll) worker are not qualified to contest election to Local Authorities (Rajesh V. KSEC 2010 (4) KHC 140 ). The object of this Provision is that members shall be free to carry his duties fearlessly without being subject to any kind of Governmental pressures. (Section 31 KPR Act & S.87 KM Act) A person convicted for electoral offences under Chapter IX A of IPC or under Section 8 of the Representation of the People Act, 1951 shall be disqualified from being elected in any election to Local Authorities or from holding the office of a member of a Panchayat for a period of 6 years from the date of his conviction. The Offences under Chapter IX A of IPC are offences relating to election like bribery, undue influence, personation etc. Section 8 (1) of the RP Act, 1951 provides for disqualification for a period of six years from the date of conviction for the specified offence therein i.e. offences like rape, offences under FERA, NDPS, Prevention 24

of Corruption Act, Prevention of Terrorism Act etc.) irrespective of the sentence awarded on such conviction. Even if the convicted person is sentenced to fine for the offences specified under Section 8 (1), he would be disqualified for a period of 6 years from the date of such conviction. In case of imprisonment, disqualification shall be from the date of such conviction and shall continue to be disqualified for a further period of six years since his release. Section 8 (2) of the RP Act, 1951 provides that for conviction of offences specified therein (like Dowry Prohibition Act, Food Adulteration Act and for offences of hoarding, profitering etc.) and sentenced to imprisonment for not less than 6 months, such persons shall be disqualified from the date of conviction and shall continue to be disqualified for a further period of 6 years since his release. Section 8 (3) of the RP Act provides that a person convicted of any offence and sentenced to imprisonment for not less than two years (for any offence other than referred to S.8 (1) & 8(2) shall be disqualified from the date of conviction and shall continue to be disqualified for a further period of six years since his release. A subsequent acquittal in Appeal or setting aside conviction and sentence will not wipe out the disqualification which existed on the date of scrutiny (Prabhakaran V. Jayarajan (2005) 1 SCC 754. Note :- Defects of substantial character.. Defects of substantial character are those material defects which cannot be cured at the stage of scrutiny of nominations and may entail rejection of nomination. (i). The failure to declare age in the nomination paper and also in the accompanying affidavit; (ii). Failure to sign the nomination paper by any of his prosposers in the manner prescribed; (iii). Failure to make the prescribed security deposit; (iv). Failure to comply with the requirement to produce the evidence of bieng a registered elector where a candidate is contesting election from a different constituency; and (v). Failure to submit the written authorisation within the prescribed time and in the prescribed forms from the party where a candidate claims to have been set up by a recognised national or state political party etc; Defects which are curable at the stage of scrutiny of nomination and the Returning Officer can allow such defects to be rectified at that stage are not defects of substantial nature. Note :- The law envisages that the scrutiny proceedings shall be completed by the Returning Officer on the date fixed for the purpose itself and he shall not allow any adjourment of proceedings, except when the same are interrupted or obstructed by riot or open violence or by casuses beyond his control. However, if an objection is raised in regard to nomination of any candidates, the Returning Officer can allow time to such candidate to rebut it and can adjourn the proceedings for the purpose, but such adjournment cannot be granted later than the next day but one, following the date fixed for scrutiny. Note : - The Returning Officer shall accept the notice of withdrawal of candidature by a candidate only after he has satisfied himself as to the genuineness of the notice and also with regard to the identity of the person presenting the notice, to avoid fake notice.
