It is being administered in conformance with U.. rmy orps of ngineers (U) regulation, "Practice and Procedure: Final Rule for Operation and aintenance of rmy orps of ngineers ivil orks Projects involving the Discharge of Dredged aterials into aters of the United tates or Ocean aters," 33 ode of Federal Regulations (FR) 337.. he purpose of this Public Notice is to specify what dredged/fill materials would be discharged into waters of the United tates by implementation of the proposed action, and advise all interested parties of the proposed project and to provide an opportunity to submit comments, or request a public hearing. he U anticipates the need to dredge and place sediment excavated from the authorized federal navigation channels of onneaut Harbor, which is located on the southern shore of ake rie at the mouth of the onneaut reek, in order to maintain sufficient water depths for deepdraft commercial and recreational navigation. Federal navigation channels within the Harbor include the Outer Harbor hannel, Inner Harbor hannel, and unicipal ccess hannel. he attached map (Figure ) shows the authorized limits and depths of the federal navigation channels. o ensure that the minimum authorized depth in onneaut Harbor is maintained and to account for dredging tolerance, up to an additional one foot of sediment may be dredged. n estimated total of approximately 200,000 cubic yards of sediment will be dredged from onneaut Harbor federal navigation channels during the 209 dredging operation. he dredging operation at onneaut Harbor is tentatively scheduled to be performed during the period between July 209 and 5 eptember 209. contractor of the federal government will accomplish the project. ediments will be removed from the channel bottom by a mechanical or hydraulic dredge and placed into hoppers aboard ship or scow for transport to the placement areas. he method of excavation will be determined by the contractor performing the maintenance dredging. In previous years, clamshell and hopper

2 dredges have been used to complete the required work. he sediment to be dredged from the onneaut Harbor federal navigation channels consists primarily of silts and clays, with some sands. he quality of sediments in the federal navigation channels were evaluated using primarily 206 sediment data in accordance with formal lean ater ct ection 404(b)() Guidelines testing and evaluation guidance contained in the U.. nvironmental Protection gency (UP)/U Great akes Dredged aterial esting and valuation anual (998) and valuation of Dredged aterial Proposed for Discharge in aters of the U.. esting anual (998). Based on this evaluation, the sediments proposed to be dredged in 209 have been determined to meet contaminant determination lean ater ct ection 404(b)() Guidelines for openwater placement. Historically, sediment from the unicipal ccess hannel of onneaut Harbor has been primarily coarsegrain in nature and thus has been determined to be suitable for use as littoral nourishment. In 2004, 25,000 cubic yards were removed from the unicipal ccess hannel and placed in the existing authorized nearshore placement area which is located approximately,500 feet east of the onneaut Harbor ast Breakwater xtension (Figure 2). he most recent grainsize characterization of the unicipal ccess hannel was conducted in 206. he results of this sampling indicated that at that time material present within this reach was primarily finegrain in nature. hoaling has occurred within this reach since the last dredging. Given that past shoaling within this reach has consisted of coarsegrain sediment, it is a possibility that this most recently deposited material within unicipal ccess hannel could consist of predominantly coarsegrain sediment, and would therefore be suitable for placement in the authorized nearshore placement area. herefore, in order to ensure that the dredging and dredged sediment placement at onneaut Harbor is consistent with Ohio Department of Natural Resources (ODNR) and Pennsylvania Department of nvironmental Protection (PDP) oastal anagement Program policies, the U Buffalo District will conduct additional sampling and analysis within this reach prior to the FY9 dredging of onneaut Harbor. ubsequent evaluation of this material will determine if the material that has shoaled within the unicipal ccess hannel since the last maintenance dredging is suitable for nearshore placement. hese results will be submitted to OP, ODNR, and PDP with an estimate of the amount of dredged sediment proposed for nearshore placement. Placement of the coarsegrain unicipal ccess hannel dredged sediment in the nearshore zone may cost significantly more when compared to deep water openwater placement due to shallow water depths. hallow water depths for the purposes of nearshore placement in this Public Notice are specified as: () between feet ow ater Datum () and the ordinary high water mark; and between 8 feet and the ordinary high water mark. ediment will be placed at the shallowest depth possible (8 feet ) if there are no increased costs to the ow ater Datum () for ake rie is 569.2 feet above mean sea level at Rimouski, Quebec, anada (International Great akes Datum 985).

3 U (when compared to the costs for placement at the foot depth). If placement in the nearshore zone at depths of 8 feet cost significantly more than openwater placement, a partner will need to pay the increased cost of nearshore placement. Predominantly finegrain sediment dredged from the Inner and Outer Harbor hannels will be discharged at an existing openlake placement area in ake rie, located four miles from the est Breakwater light, at an azimuth of 34 00 (Figure 2). Pursuant to ection 40 of the, ater Quality ertification (Q) from the Ohio nvironmental Protection gency (OP) is required for the discharge of dredged sediment. herefore, a copy of this Public Notice has been provided to OP requesting Q, or waiver thereof, for the associated placement of dredged sediment. he environmental effects of the dredging operation are documented in the Final nvironmental Impact tatement (FI), Operation and aintenance, onneaut Harbor, Ohio (975); upplemental Information Report and ection 404(b)() valuation, Operation and aintenance, onneaut Harbor, Ohio (982 and 2004); and nvironmental ssessment ()/Finding of No ignificant Impact tatement (FONI) and ection 404(b)() valuation for onneaut Harbor, Ohio (999). hese documents, and supplemental documentation, have been submitted to UP. opies are available for examination at the Buffalo District office. here are no listed historic properties or properties determined as being eligible for listing in the National Register of Historic Places that will be affected by this project. By this notice, the National Park ervice is advised that currently unknown archaeological, scientific, prehistorical or historical data may be lost or destroyed by the work to be accomplished. his office has determined that the proposed project will have No ffect upon any species proposed or designated by the U.. Department of the Interior as threatened or endangered, nor will the proposed work result in an dverse odification of designated critical habitat for any such species. herefore, unless new information indicates otherwise, no further consultation pursuant to ection 7 of the ndangered pecies ct mendments of 978 will be undertaken with the U.. Fish and ildlife ervice. his work will be undertaken in a manner consistent, to the maximum extent practicable, with the tate of Ohio oastal Resources anagement Program. oastal anagement Program Federal onsistency Determination has been submitted to the ODNR documenting this determination. Due to the projects proximity to the Pennsylvania tate border, this activity has also been evaluated with respect to the Pennsylvania oastal Resources anagement Program. his evaluation has determined that the work will be undertaken in a manner consistent, to the maximum extent practicable, with the Pennsylvania oastal Resources anagement Program. oastal anagement Program Federal onsistency Determination has been submitted to the PDP documenting this determination. he decision whether to perform dredging has been based on an evaluation of the probable

4 impact, including cumulative impacts of the proposed activity on the public interest. hat decision reflects the national concern for both protection and utilization of important resources. he benefit which reasonably may be expected to accrue from the proposal has been balanced against its reasonably foreseeable detriments. ll factors which may be relevant to the proposal have been considered including the cumulative factors thereof; among those are conservation, economics, aesthetics, general environmental concerns, wetlands, historic properties, fish and wildlife values, flood hazards, floodplain values, land use, navigation, shoreline erosion and accretion, recreation, water supply and conservation, water quality, energy needs, safety, food and fiber production, mineral needs, considerations of property ownership and, in general, the needs and welfare of the people. his activity is being coordinated with the following agencies, as well as other appropriate federal, state and local agencies and organizations: National Park ervice Ohio Department of Natural Resources Ohio nvironmental Protection gency Ohio Historic Preservation Office Pennsylvania Department of nvironmental Protection U.. oast Guard U..
