SIXTY-FIFTH WORLD HEALTH ASSEMBLY A65/30 Provisional agenda item 16.3 5 April 2012 Status of collection of assessed contributions, including Member States in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution Report by the Secretariat STATUS OF COLLECTION 1. In order that WHO may deliver the approved Programme budget in full, contributions from Member States must be received in full and on time. All Member States are required under Financial Regulation 6.4 to pay their contribution as of 1 January of the year in which it is due. 2. The rate of collection for 2010 2011 was 93%, up from 86% for 2008 2009. Contributions for the were received, either in full or in part, from 177 of the 195 and Associate (compared with 175 and Associate in 2008 2009). Full details of amounts assessed and collected are shown in Annex 1. 3. Unpaid contributions as at 31 December 2011 amounted to US$ 69.3 million, with a further US$ 40.4 million due under special arrangements authorized by the Health Assembly, payable in the future, under instalment schemes (compared with US$ 144.4 million and US$ 46.8 million as at 31 December 2009). Details of payments made to date in respect of special arrangements are shown in Annex 2. MEMBERS CONTRIBUTIONS RECEIVED IN ADVANCE 4. As at 31 December 2011, some had, either in full or in part, made advance payments against their regular budget contributions for 2012 and future years. In total, contributions received in advance as at 31 December 2011 amounted to US$ 70.3 million (US$ 54.8 million at 31 December 2009). Advance payments are detailed by Member State in Annex 3. MEMBERS IN ARREARS AND SPECIAL ARRANGEMENTS 5. Article 7 of the Constitution states that If a Member fails to meet its financial obligations to the Organization the Health Assembly may suspend the voting privileges... to which a Member is entitled. If at the time of the opening of the Health Assembly, a Member is in arrears in an amount that equals or exceeds the amount of contributions due from it for the preceding two full years, the Health Assembly takes a decision on suspension of the Member s voting privileges in accordance with resolution WHA41.7.

In accordance with previous Health Assembly resolutions, the voting privileges of the following six Member States continue to be suspended: Central African Republic, Comoros, Dominica, Guinea- Bissau, Somalia and Tajikistan. Details of the amounts are provided in Annex 4. The suspension is to continue at the Sixty-fifth and subsequent World Health Assemblies until the arrears have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution. 7. In accordance with resolution WHA64.19 if, by the time of the opening of the Sixty-fifth World Health Assembly, Grenada and Guinea are still in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, their voting privileges shall also be suspended as from the opening. Details of the amounts are provided in Annex 4. The suspension will then continue at the Sixty-sixth and subsequent World Health Assemblies until the arrears have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution. 8. As at 31 January 2012, nine Member States, namely Bangladesh, Belarus, Gambia, Kiribati, Micronesia (Federated States of), Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia are in arrears in the payment of their contributions in amounts that equal or exceed the amounts due from them for the preceding two full years, as listed in Annex 4. Annex 4 also lists two Associate, namely Puerto Rico and Tokelau, who are behind with their assessed contributions. 9. Pursuant to resolution WHA41.7, unless there are exceptional circumstances justifying a different measure, the Sixty-fifth World Health Assembly may wish to adopt a resolution deciding that the voting privileges of Bangladesh, Belarus, Gambia, Kiribati, Micronesia (Federated States of), Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia will be suspended as from the opening day of the Sixty-sixth World Health Assembly in May 2013, if at that time the Member States concerned are still in arrears to the extent that would justify invoking Article 7 of the Constitution. 10. Member States in arrears of payment to an extent that they are concerned by Article 7 of the Constitution are encouraged to submit proposals to the Health Assembly for repaying such arrears over an extended period. Such proposals for special arrangements are considered by the Programme, Budget and Administration Committee of the Executive Board, which subsequently makes its recommendations to the Health Assembly. No new proposals have been submitted this year. 11. Annex 2 lists the Member States that currently have special arrangements for repayment of arrears. Payments totalling US$ 6.3 million were received in the 2010 2011 in accordance with these special arrangements. All the Member States concerned are respecting their commitments under these arrangements, with the exception of Afghanistan, Central African Republic, Kyrgyzstan and Tajikistan. Of these four Member States, Central African Republic and Tajikistan have already had their voting privileges suspended. In the case of Afghanistan, and Kyrgyzstan, unless further payments are made by the opening of the Sixty-fifth World Health Assembly, the two Member States will lose their voting privileges. Ukraine submitted a proposal to the Sixty-fourth World Health Assembly to extend the repayment of its arrears over the period 2013 2022. In resolution WHA64.20 the Health Assembly decided to allow Ukraine to reschedule repayments accordingly. This will start as of January 2013. 12. In line with the adoption by the United Nations General Assembly of resolution 63/249 regarding the write-off of arrears of the former Yugoslavia, the Secretariat proposes to write off the arrears from the former Yugoslavia for the period 1991 2000, which amount to 2

The Federal Republic of Yugoslavia (now Serbia) was admitted into membership in WHO on 1 November 2000, following which the membership in the Organization of the former Yugoslavia was automatically terminated. The entire amount has already been fully provided for and therefore there is no financial exposure to the Organization as a result of this write-off. ACTION BY THE HEALTH ASSEMBLY 13. No action is required by the Health Assembly in respect of those whose voting privileges have already been suspended under previous Health Assembly resolutions. 14. The Health Assembly may wish to consider the following draft resolution in respect of Bangladesh, Belarus, Gambia, Kiribati, Micronesia (Federated States of), Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia, in accordance with the principles stated in resolution WHA41.7: The Sixty-fifth World Health Assembly, Having considered the report on status of collection of assessed contributions, including in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, and special arrangements for settlement of arrears; 1 Noting that, at the time of opening of the Sixty-fifth World Health Assembly, the voting rights of Central African Republic, Comoros, Dominica, Guinea-Bissau, Somalia and Tajikistan were suspended, such suspension to continue until the arrears of the concerned have been reduced, at the present or future Health Assemblies, to a level below the amount that would justify invoking Article 7 of the Constitution; Noting that, the voting rights of Grenada and Guinea were suspended the Sixtyfourth World Health Assembly, effective from the Sixty-fifth World Health Assembly and to continue until the arrears of the concerned have been reduced, at the present or future Health Assemblies, to a level below the amount that would justify invoking Article 7 of the Constitution; Noting that Afghanistan and Kyrgyzstan; and Bangladesh, Belarus, Gambia, Kiribati, Micronesia (Federated States of), Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia were in arrears at the time of the opening of the Sixty-fifth World Health Assembly to such an extent that it was necessary for the Health Assembly to consider, in accordance with Article 7 of the Constitution, whether or not the voting privileges of those countries should be suspended for Afghanistan and Kyrgyzstan at the opening of the Sixtyfifth World Health Assembly, and for the remaining nine Member States at the opening of the Sixty-sixth World Health Assembly, DECIDES: (1) that in accordance with the statement of principles set out in resolution WHA41.7 if, by the time of the opening of the Sixty-sixth World Health Assembly, Bangladesh, 1 Document A65/30. 3

A65/30 Belarus, Gambia, Kiribati, Micronesia (Federated States of), Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia are still in arrears in the payment of their contributions to an extent that would justify invoking Article 7 of the Constitution, their voting privileges shall be suspended as from the said opening; and in accordance with resolution WHA59.6 and resolution WHA61.8 if by the time of the opening of the Sixty-fifth World Health Assembly, Afghanistan and Kyrgyzstan, respectively, are still in arrears in the payment of the their rescheduled assessments, their voting privileges shall be suspended automatically; (2) that any suspension that takes effect as set out in paragraph (1) above shall continue at the Sixty-sixth World Health Assembly and subsequent Health Assemblies, until the arrears of Afghanistan, Bangladesh, Belarus, Gambia, Kiribati, Micronesia (Federated States of), Kyrgyzstan, Palau, Saint Lucia, Sudan and the former Yugoslav Republic of Macedonia have been reduced to a level below the amount that would justify invoking Article 7 of the Constitution; (3) that this decision shall be without prejudice to the right of any Member to request restoration of its voting privileges in accordance with Article 7 of the Constitution. 15. The Health Assembly may also wish to consider the following draft resolution in respect of the arrears of the former Yugoslavia: Noting United Nations General Assembly resolution 63/249 concerning unpaid assessed contributions of the former Yugoslavia; Noting that the amount of US$ 5 532 592 has already been fully provided for, DECIDES, in accordance with Financial Regulation 13.6, to approve the writing-off of the unpaid arrears from the former Yugoslavia from 1991 to 2000 of US$ 5 532 592.. 4
