1 The Corporation of the Municipality of West Grey By-law Number Being, A by-law to establish a Level of Service for Winter Maintenance Policy on West Grey roads, parking lots and sidewalks; Whereas, O.Reg. 239/02 under the Municipal Act, 2001, S.O. 2001, c. 25 as amended, provides for minimum maintenance standards for municipal highways; And whereas, the Council of the Corporation of the Municipality of West Grey deems it expedient and in the public interest to establish a Level of Service for Winter Maintenance Policy for West Grey roads, parking lots and sidewalks; NOW THEREFORE THE COUNCIL OF THE CORPORATION OF THE MUNICIPALITY OF WEST GREY ENACTS AS FOLLOW: 1. That the Level of Service for Winter Maintenance Policy, attached hereto as Schedule A is hereby approved. 2. That the Mayor and Clerk are hereby authorized to sign and seal the said Agreement. 3. That the Level of Service for Winter Maintenance Policy, attached as Schedule A, hereto forms part of this by-law. 4. That this By-law shall come into full force and effect on the date of passing thereof. 3 Page 1 of 23 Preamble: The objective of this Policy is to establish a desirable Level of Service for Winter Maintenance on West Grey Roads, Parking Lots and Sidewalks. The Municipality of West Grey recognizes Ontario Regulation 239/02 (and the recent amendments) made under the Municipal Act entitled "Minimum Maintenance Standards for Municipal Highways". This Standard focuses on the activity threshold and on the response time for winter maintenance activities. Winter maintenance activities may be conducted on a twelve (12) hour basis, seven (7) days a week. The Rural Road Supervisor, Utilities Supervisor and Patrolman will coordinate the overall snow clearing, ice control and snow removal activities, and determine the most effective operation to be undertaken from the procedures developed by the Department. The Department is prepared to shift from normal work procedures within a reasonable period of time when it becomes necessary to initiate winter maintenance activities. West Grey will not be able to maintain the roads, parking lots and sidewalks in the same condition as they are in the summer and traffic will be expected to reduce speed to suit the weather and road conditions and pedestrians to use caution when using any public sidewalk. The Level of Service for Winter Maintenance on West Grey roads has a major impact on the economy and quality of life for West Grey residents. The objective of the Department will be to provide the best winter maintenance service given the resources available for winter control purposes and given the weather conditions. It is understood, that budgets for winter maintenance activities are based on average weather conditions and that the actual expenditures may be higher or lower than budgeted. It is also understood that the quality of winter maintenance on any road, parking lot and sidewalk is dependent on the following factors: air and ground temperature; sunlight; wind speed; wind direction; snow fall; freezing rain; topography; road surface; traffic volumes; manpower, materials and equipment available to provide winter control services. There may be times when winter maintenance activities may be hindered due to these factors and there may be some reasonable deviations from this policy.

4 Page 2 of 23 This policy sets out the level of service Council has adopted for winter maintenance of roadways, sidewalks and parking lots which it has determined to be an adequate level of service. The policy recognizes that operational decisions will need to be made based on local conditions and the quality of winter maintenance on any road, sidewalk or parking lot is dependent on the following factors: air and ground temperature, sunlight, wind speed, wind direction, snow fall, freezing rain, topography, road surface type, traffic volumes, man power, materials and equipment available to provide winter maintenance services. Hence, there may need to be some reasonable deviations from this policy. At a minimum, West Grey will adhere to Ontario Regulation 239/02 Minimum Maintenance Standards for Municipal Highways, as amended from time to time. All other regulatory requirements will also be met, including but not necessarily limited to those set out in the Occupational Health and Safety Act and the Highway Traffic Act. The amount of West Grey owned equipment and contracted services and personnel to provide this level of service is funded through West Grey s tax base and may be reviewed annually through the budget process and/or may be amended by Council from time to time. West Grey will endeavor to use all available resources to meet the level of service defined within this policy subject to functioning equipment and staff availability due to illness or hours of work. Responsibility: The responsibility for ensuring snow clearing, ice control and snow removal from West Grey s infrastructure of roadways, select sidewalks, and parking lots rests entirely with the Department.

5 Page 3 of 23 Definition: Winter Event means a weather condition affecting roads such as snowfall, wind-blown snow, sleet, freezing rain, frost, black ice, etc to which a winter event response is required. Winter Event Response means a series of winter control activities performed in response to a winter event. Policy: In this Policy, West Grey s Winter Maintenance Season means the continuous period of time beginning the second Monday of November through to and ending on the second Friday of April in the year next following. West Grey shall also attend to winter events that occur prior to and after the dates mentioned above, if there is an occurrence of an early winter event and until winter events have subsided at the end of each season. West Grey Council acknowledges that the level of service provided outside the Winter Maintenance Season will be at a lower level than during the Winter Maintenance Season, but that it shall meet the Common Law test of reasonableness. The Winter Maintenance Level of Service Policy is based on the assumption that not all infrastructure needs to be maintained at the same level of service, but depends on its role in the total transportation network and on other various services West Grey provides, be they emergency or non-emergency. To simplify the determination of levels of service, the various infrastructure components have been designated to specific classes and priorities. These are fully explained within this Policy. WINTER PARKING PROHIBITION: On Street Parking Parking is prohibited on all streets during the months of November 1 to April 15 specified in the Traffic By-Law , section 6(d).

6 Page 4 of 23 Parking Lots Overnight parking is also prohibited in all Municipal owned public parking lots during the months of November 1 to April 15 as specified in the Traffic By- Law. Property Damage During the course of operations throughout any given winter season, a certain amount of damage to municipal and private property may be incurred by snow clearing forces. In the event that significant sod damage is sustained it will be restored by the Department using topsoil and seed at the earliest convenience (usually May), conditional upon the severity and extent of sod damage and the prevailing weather conditions. Any sod damage sustained due to salt inadvertently splashed onto a boulevard or lawn during the course of the winter will not be treated or repaired by West Grey. Mail Boxes The Municipality of West Grey will only repair or replace mailboxes and mountings, if in the opinion of the Department, damage resulted from an act of carelessness on the part of the Municipality. The mail box or post will not be replaced if the resulting damage is caused from displacement of snow from a plow. The replacement cost will be limited to the cost of a standard box and/or post. Mailbox Policy IPW Driveway Entrance Clearing It can be expected that under snow clearing operations, snow will be deposited into private driveways and sidewalks as a normal part of roadway and sidewalk snow clearing operations. Owners of properties which the driveways service will be responsible for removal of the snow deposited in those entrances. Under no circumstance are owners or their contractors allowed to deposit snow from driveways onto the travelling portion of West Grey roadways as per Section 181 of the Highway Traffic Act.

7 Page 5 of 23 Assistance to Private Property Under no circumstances will a municipal employee be allowed to use a municipally owned vehicle to push, pull or tow a stranded private vehicle from a roadway or parking lot. The employee may, if a hazard exists, use the two-way radio to notify the Supervisor or Operator of the hazardous condition. Under no circumstances will a municipal employee be allowed to use a municipally owned vehicle/equipment for snow removal or ice control on private or commercial property. By-Laws Applicable By-laws passed for the purposes of supporting snow and ice control efforts and other related By-laws which could be enforced during all out emergencies are listed below: By-law No. 1. ROADWAYS: CLASS DESIGNATION As per Ontario Regulation 239/02, Roadways have been divided into six Classes which determine the priority for Patrolling, Snow Clearing and Ice Control. The Municipality of West Grey has Class 3, Class 4, Class 5 and Class 6 roads based on 2016 traffic count data. West Grey is able to meet or in most circumstances, exceed the required standards set out in O. Reg 239/02. (see Appendix A - Road Class Designation Map ). Class 3 roads will receive winter maintenance control activity first and more frequently followed by Class 4, Class 5 and Class 6 roads.

8 Page 6 of 23 : Weather Monitoring During the Winter Maintenance Season, the weather, both current and forecasted to occur in the next 24 hours, will be monitored in the morning, noon and afternoon of each day as a minimum and as weather conditions change. Outside of the Winter Maintenance Season the weather, both current and forecasted to occur in the next 24 hours, will be monitored once per weekday. Weather monitoring will be accessed through a weather network (i.e., Weather Network) and copies saved to a file. Patrolling During the Winter Maintenance Season, the Patrolman will perform Winter Patrolling, in addition to normal Road Patrol, on representative roadways at the beginning of each day shift seven (7) days per week. Patrolling commences each day at midnight until 7:00 a.m. by the patrolman. The Rural Road Supervisor is responsible for patrolling the rural roads of West Grey from 7:00 a.m. to late afternoon and the Urban Utilities Supervisor is responsible for the Town of Durham from 7:00 a.m. to late afternoon each day during the week and on call on the weekends and holidays. West Grey uses a Patrolling Software called Mr. Compliance for the collection of road patrolling data. Snow Accumulation 1) (a) will deploy available West Grey resources to address the snow accumulation, as soon as practicable after becoming aware of the fact that the snow accumulation on a roadway is greater than the depth set out in the Table 1; and (b) After the snow accumulation has ended, to address the snow accumulation so as to reduce the snow to a depth less than or equal to the depth set out in Table 1, will deploy available West Grey resources to clear the snow accumulation, as soon as practicable in accordance with subsections (2); or (c) As the case may be, within the time set out in the Table 1.

9 Page 7 of 23 2) The snow accumulation must be cleared from the roadway to provide a minimum lane width of the lesser of 3 m for each lane or the actual lane width, or on a Class 4 or Class 5 highway with two lanes, to provide a total width of at least 5 m. 3) This section does not apply to that portion of the roadway designated for parking. 4) In this Policy, Addressing snow accumulation on a roadway includes, but is not limited to plowing a roadway, salting a roadway, applying abrasive materials to a roadway or any combination of the above methods. Snow accumulation means the natural accumulation of new fallen snow or wind-blown snow or slush that, alone or together, covers more than half a lane width of a roadway. 10 Page 8 of 23 Ice Formation on Roadways and Ice Roadways 1) If the Rural Roads Supervisor, Utilities Supervisor, Patrolman or Designate as a result of weather monitoring or winter patrolling determine there is a substantial probability of ice forming on a roadway will deploy available West Grey resources to treat the roadway to prevent ice formation on a roadway within the time set out in Table 2 starting from the time that the Rural Roads Supervisor, Utilities Supervisor, Patrolman or Designate determines as the appropriate time to deploy available resources. 2) If West Grey meets the minimum standard set out in subsection (1) and, despite such compliance, ice forms on a roadway, the roadway is deemed to be in a state of repair until the earlier, of (a) The time that the West Grey becomes aware of the fact that the roadway is icy; or (b) the applicable time set out in the Table to this section for treating the roadway to prevent ice formation expires. 3) The minimum standard for treating icy roadways after West Grey becomes aware of the fact that a roadway is icy is to treat the icy roadway within the time set out in the Table to this section and an icy roadway is deemed to be in a state of repair until the applicable time set out in the Table for treating the icy roadway expires. 4) In this Policy, Treating a roadway means the application of material to the roadway, including but not limited to, salt, sand or any combination of salt and sand. ice means all kinds of ice, however formed. 11 Page 9 of 23 End of Storm Pavement Surface Condition will attempt to restore the pavement surface to the condition set out in Table 3 following the end of the storm. Table 3 Surface Condition Objective Roadway Class Condition 3 Centre Bare 4 Snow pack 5 Snow pack 6 Snow pack Despite the pavement conditions noted above, roads maintained in a snow packed condition have a tendency to become icy at stop signs, sharp curves and steep hills. West Grey will monitor representative locations during a patrol and provide service to treat the ice formation after becoming aware of the formation of ice. Priority for Servicing West Grey provides winter maintenance services by dividing the road network into several plow routes. A plow route may contain more than one class of highway in varying degrees i.e., the kilometers of any one class of road will vary from route to route and/or there may or may not be all classes of road within a route. West Grey will provide service that meets Ontario Regulation 239/02 and this policy for each class of road within a route. During times when there is a severe winter condition e.g., heavy snowfall, strong winds or when equipment breakdowns occur, lower priority roadway Classes may be delayed in an attempt to maintain the upper roadway classes at the required service levels for both snow accumulation and ice control. Therefore, Class 6 roadways would be delayed first, followed by Class 5, then Class 4, then Class 3. If this process requires implementation, then a single break through pass will be made through the delayed roadway classes once their maximum allowable roadway snow depth has been reached.

12 Page 10 of SIDEWALKS: CLASS DESIGNATION There is no winter maintenance standard for sidewalks in the Minimum Maintenance Standards O. Reg. 239/02. Under Section 44(9) of the Municipal Act a municipality is not liable for personal injury caused by snow or ice on a sidewalk except in the case of gross negligence. The intention of this section of the policy is to fulfill West Grey s legal duty to provide a reasonable standard of care to prevent foreseeable harm to others. For clarity, a Class 3 sidewalk is adjacent to a Class 3 road and the same applies the other classes of sidewalk. West Grey provides winter maintenance services by dividing the sidewalk network into several plow routes. A plow route may contain more than one class of sidewalk in varying degrees i.e., the total metres of any one class of sidewalk will vary from route to route and/or there may or may not be all classes of sidewalk within a route. West Grey will provide service that meets standard level of care. Class 3 Sidewalks servicing down town business communities in Durham and Neustadt and steep hills of any Class 3, 4 and 5 sidewalks. Class 3 sidewalks are serviced first (identified in yellow on map). Reference Appendix B, C, D and E Class 4 Sidewalks servicing libraries, recreational facilities, hospitals, school routes and places of Worship. Class 4 sidewalks are serviced second (identified in blue on map). Reference Appendix B, C, D and E Class 5 Sidewalks that service all other businesses, residential neighbourhoods. Class 5 sidewalks are serviced third (identified in green on map). Reference Appendix B, C, D and E Note: Streets having sidewalks on both sides will have only one side maintained. Class 6 Sidewalks servicing cul-de-sacs or sidewalks that end mid-block or have low pedestrian use and Class 4 and 5 streets having sidewalks on both sides, only one side will be treated (identified in red on map). 13 Page 11 of 23 SUBJECT: Roads, Parking Lots and Sidewalks - SNOW No clearing will take place on any class sidewalk if the individual snowfall is less than 5 cm unless authorized by the Rural Road Supervisor, Utility Supervisor or Patrolman. All sidewalks will be maintained in a smooth snow packed condition due to the limitations of the sidewalk clearing equipment to get down to the bare surface, unless specified otherwise. Class 3 Following a winter event and upon the accumulation of 5 cm of new snow sidewalks identified as Class 3 will receive winter maintenance to remove snow down to a smooth snow packed surface within twelve (12) hours after the storm has ended. Class 4 Following a winter event and upon the accumulation of 5 cm of new snow sidewalks identified as Class 4 will receive winter maintenance to remove snow down to a smooth snow packed surface within twenty-four (24) hours after the storm has ended. Class 5 Following a winter event and upon the accumulation of 8 cm of new snow sidewalks identified as Class 4 and 5 will receive winter maintenance to remove snow down to a smooth snow packed surface within forty-eight (48) hours after the storm has ended. Class 6 No winter maintenance will be provided on all identified Class 6 sidewalks.

14 Page 12 of 23 ICE When icy conditions exist sanding/salting will be undertaken, as soon as practicable after becoming aware that the sidewalks are icy, within the same priority sequence and timeframes set out below. Class 3 Following an icy winter event, sidewalks identified as Class 3 will receive winter maintenance to apply abrasives, as soon as practicable after becoming aware that the sidewalks are icy within twelve (12) hours after the storm has ended. West Grey will also be proactive in trying to minimize ice formation if weather forecasts anticipate an icy event for Class 3 sidewalks. Class 4 Following an icy winter event, sidewalks identified as Class 4 will receive winter maintenance to apply abrasives, as soon as practicable after becoming aware that the sidewalks are icy within eighteen (18) hours after the storm has ended. Class 5 Following an icy winter event, sidewalks identified as Class 5 will receive winter maintenance to apply abrasives, as soon as practicable after becoming aware that the sidewalks are icy within twenty-four (24) hours after the storm has ended. Class 6 No winter maintenance will be provided on all identified Class 6 sidewalks. During times when there is a severe winter condition e.g., heavy snowfall, strong winds or when equipment breakdowns occur, lower priority sidewalks may be delayed in an attempt to maintain the upper sidewalk classes at the service levels described above for both snow accumulation and ice control. Therefore, Class 4 and 5 sidewalks would be delayed first. This will ensure that Class 3 sidewalks will normally be completed within the allotted timeframe.

15 Page 13 of PARKING LOTS Level of Service Snow clearing and ice control of parking lots servicing public West Grey buildings and municipal public parking lots will be prioritized for service as per the following: Town of Durham Parking Lots that service West Grey facilities in Durham include the Public Administration Building, Police Station, Fire Station, Old Town Hall Parking Lot, Durham Arena, Library, the Old Library the Durham Waste Water Treatment Plant and the Well Stations on South and Lambton Street. Village of Neustadt Parking Lots that service West Grey facilities in Neustadt include the Arena and Community Hall, Fire Station the Waste Water Lift Station, Water Tower and the Well Stations off Concession 12. Village of Ayton Parking Lots that service West Grey facilities in Ayton include the Fire Station, Library, Arena and Community Hall.

16 Page 14 of 23 1) Snow clearing and ice control of parking lots servicing West Grey facilities in Durham are carried out by West Grey forces and municipal public parking lots in Neustadt and Ayton are carried out under contract in accordance with the following guidelines: (a) (b) (c) (d) (e) During a storm, snow clearing will commence following 8.0 cm of snow accumulation and within twelve 12 hours, but shall be serviced prior to 7:00 a.m. Follow-up snow clearing will only resume following the accumulation of an additional 10 cm of new snow on the previously plowed areas. Sanding/salting operation for ice control, if required, will be restricted to the driving lanes between parking rows. Major snow clearing and ice control operations will be completed between 12:00 a.m. and 7:00 a.m. Completion of final snow clearing and ice control operations will be attempted within forty-eight (48) hours after the storm has ended. 4. SNOW REMOVAL: Snow removal on roadways, parking lots, dead end/cul-du-sacs, and the Downtown Core area will be carried out when required by the Department. Depending on the area and number of locations to be undertaken, a decision will be made by the Rural Roads Supervisor and/or the Utilities Supervisor to implement the removal process. Snow removal operations are typically completed between the hours of 12:00 a.m. to 7:00 a.m. West Grey will give priority to Down Town Core and intersections having impeded sight lines.

17 Page 15 of 23 DEPARTURE FROM West Grey recognizes that conditions may be so unusual or unexpected that a temporary departure from this policy may be authorized. Therefore, when conditions warrant the Rural Roads Supervisor and/or the Utilities Supervisor in consultation with the Director of Infrastructure and may order a temporary departure from these general guidelines.
