This letter advises NHS Boards of increases in the NHS optical voucher values and allowances for repairs and replacements with effect from 1 April Action 2. The new voucher values are shown in Annexes A and B to this letter. 3 Directions under the National Health Service (Scotland) Act 1978, Section 2(5) and Schedule 11, paragraph 2(1) and regulation 2(1) of the National Health Service (Optical Charges and Payments) (Scotland) Regulations The Scottish ministers in exercise of the powers conferred upon them by section 2(5) of and paragraph 2(1) of Schedule 11 to the National Health Service (Scotland) Act and regulation 2(1) of the National health Service (Optical Charges and Payments) (Scotland) Regulations and of all other powers enabling them in that behalf, hereby give to NHS Boards the following Directions: 1. These Directions shall come into force on 1 April 2015 and shall have effect in respect of glasses or contact lenses supplied where the testing of sight leading to the supply of the glasses or lenses, or the first such testing, takes place on or after 1 April In these Directions the Act means the National Health Service (Scotland) Act 1978 charges for glasses and charges for contact lenses means a charge authorised by section 70(1) of the Act in respect of the supply of glasses or, as the case may be, contact lenses under the Act. 3. Subject to paragraphs 4 and 5 below, the charge for glasses shall be the aggregate of the following: (a) An amount which represents the cost to the NHS board or other person on its behalf, of the purchase of thee glasses or their components; and (b) An amount which represents the cost to the NHS Board or other person on its behalf, of the dispensing of the lenses. 4. Where the aggregate of: (a) The element of the amount mentioned in paragraph 3(a) above which represents the cost of the lenses; and (b) The amount mentioned in paragraph 3(b) above, Exceeds, in the case of glasses each lens which is a single vision lens, and, in any other case, , the charge for glasses shall be the aggregate of that or, as the case may be and, except in a case to which paragraph 5 below applies, the element of the amount mentioned in paragraph 3(a) above which represents the cost of the frames (c.29). Section 2(5) was amended by the National Health Service and Community Care Act 1999 (c.19), Schedule 9, paragraph 19(1); paragraph 2(1) was substituted by the Health and Medicines Act 1988 (c. 49), Schedule 2, paragraph 15(1). Where any patients requires, on clinical grounds, a frame the cost of which is more than that of the cheapest frame in the range supplied by the NHS Board or other person on its behalf, the element of the amount mentioned in paragraph 3(a) above which represents the cost of the frames shall not exceed the cost of the cheapest frame. 6. The charge authorised by section 70(1) of the Act in respect of the supply of contact lenses under the Act shall be for each contact lens supplied. 7. Except in so far as it applies to glasses and contact lenses supplied where the testing of sight leading to the supply of the glasses or contact lenses, or the first such testing, has taken place prior to 1 April 2015 the Direction made under paragraph 2(1) of Schedule 11 to the Act and regulation 2(1) of the National health Service (Optical Charges and Payments) (Scotland) Regulations 1998, which came into operation on 1 April 2014 is revoked.
