1 REPORT TO: Council FOR: Regular PRESENTED: October 3, 2006 FILE: FROM: Department of Recreation, Parks and Tourism SUBJECT: Amendment to Cemetery Bylaw No. 1532, 1998 Recommendation: That Council give first three readings to District of Squamish Cemetery Bylaw No , Amendment Bylaw No. 1931, Purpose: To amend the existing cemetery by-law to permit the use and sale of cement liners, create better control of material placed on graves by relatives and friends and to increase rates in accordance with present costs and values. 2. Time Critical: The Bylaw needs to be adopted prior to the sale of graves on the southeast portion of the cemetery as work has now been completed on this section, which included the pre-laying of cement liners within the plots. 3. Background: Recently it has become necessary to open and begin using gravesites in the southeast section of the Cemetery. During the initial burials in this section it was discovered that it is populated by large rocks and boulders that have made digging of the graves very difficult and time consuming. To permit an easier and less time consuming and costly process, Council authorized the pre-digging of these gravesites, removal of the large rocks, placement of cement liners, and filling with good soil. The present Cemetery Bylaw states that fiberglass liners are permitted but does not mention cement liners nor is there a tariff in Schedule C for this use. Therefore, staff is presenting revisions to the affected sections to permit the use of cement liners. In addition, staff has been having difficulty in controlling the type and number of plants, monuments and other paraphernalia that relatives and friends place on and around graves. In some cases the objects placed around the graves cause a safety hazard for staff who are undertaking grass maintenance as well as it is difficult to do this maintenance without damaging these objects. 2 communities were gathered and it was found the most have a Ornamentation and Planting Policy as part of their bylaw. Staff is proposing that such a document be utilized at Mount Garibaldi Cemetery and are incorporating it within the amendment bylaw as a new Schedule D and is attached as part of this report. If approved, an effort would be made to send a copy of the new policy to a surviving relative of those presently buried at Mount Garibaldi Cemetery. And, finally, the tariffs established within the existing Cemetery Bylaw Schedule C for cost for sale of plots and services has not been revised since Costs for work performed at the cemetery are not being recovered and adjustments are necessary. As well, the cost of land has increased within the District and the prices for sale of plots needs to be increased as well. The new proposed Schedule C attached to the amendment bylaw shows the present rates and the new proposed rates for Council s review. A comparative analysis of the rates in Vancouver as opposed to those in Squamish is attached for Council s information. In addition to increases recommended for November 1, 2006, staff have estimated that an additional escalation of costs will take place over the next year and are recommending that Schedule C also contain increases effective January 1, 2008 to accommodate these increases. 3 BYLAW No A bylaw to amend District of Squamish Cemetery Bylaw No. 1532, 1998 The District of Squamish in open meeting assembled, enacts as follows: 1. This bylaw may be cited as District of Squamish Cemetery Bylaw No. 1532, 1998 Amendment Bylaw No. 1931, The District of Squamish Cemetery bylaw No. 1532, 1998 is herby amended as follows: i. The following Definition is added to section 1: South East Section means that portion of Mount Garibaldi Cemetery which is south of the main entry roadway and east of the path down the middle of the southern portion of the cemetery ii. iii. iv. Section 22 (4) to be deleted and replaced with: On and after the date of adoption of this By-law a fiberglass grave liner or cement liner (for the South East Section) shall be used for each interment, except where a concrete or steel vault is used or cremated remains are interred according to the requirements of Section 4 or 7 of this By-law. Section 22(5) to be deleted and replaced with: Each grave liner used in the cemetery shall be made of fiberglass or, in the case of the South East Section, cement, and shall consist of two side walls, two end walls and a cover or lid sufficient to cover the entire length and sides of the coffin or casket. Section 36 (1) and 36 (2) to be deleted and replaced with: A policy concerning grave ornamentation is provided in Schedule D entitled District of Squamish Mount Garibaldi Cemetery Ornamentation Policy Such Schedule D is attached to forming part of this bylaw. v. Schedule C TARIFF is deleted and replaced with Schedule C TARIFF attached to and forming part of this bylaw. 4 Schedule D, Bylaw No A. Ornamentation: MOUNT GARIBALDI CEMETERY ORNAMENTATION AND PLANTINGS POLICY 1. Definition Grave ornamentation Grave ornamentations is any object that is placed on a grave for decorative or memorialization purposes. Ornamentation on graves is permitted only under the following circumstances: When objects do not present a hazard to cemetery workers or the public and/or are not damaged or deteriorated. See conforming and non-conforming ornamentation in Parts 2 and 3 below. When objects are only placed on the surface of grave markers and bases and not on the surface of the grave outside of the marker and base other than approved vases purchased from the District of Squamish. 2. Conforming Ornamentation Conforming Ornamentation is any object that does not pose a hazard to cemetery workers or the public and consists of material that does not include glass, metal, ceramic or rock. Conforming ornamentation may be allowed on the surface of the marker. Examples of conforming ornamentation that may be left on the marker include: cut flowers or potted plants and small mementoes that are not made of glass, ceramics, rock or metal. Artificial plants or flowers may only be placed on the grave marker between November 1 st and March 31 st annually. Temporary ornamentation accompanying funeral services may be left on the surface of the grave outside of the marker for a period of up to 2 weeks after the funeral or until the ornaments have significantly deteriorated (at the discretion of the Cemetery Caretaker). Examples of temporary funeral ornamentation include: wreaths and flower arrangements. 3. Non-conforming Ornamentation Non-conforming ornamentation is any loose object that presents a hazard for cemetery workers or the public due to the potential for becoming entangled in maintenance equipment and/or being projected by this equipment. It also refers to any objects that have deteriorated or become damaged through neglect. Examples of non-conforming ornamentation include: Any loose object placed on the grave site including the marker that is made from glass, ceramics, rock or metal. Any object that is placed anywhere on the grave other than the surface of the marker or concrete pad. Any object that, due to its size or material, may be unstable on the marker. Any object that has deteriorated significantly. Further examples of non-conforming objects include: glass vases, picture frames with glass, china, ceramics, metal objects, food items and lanterns. 4. Management of Ornamentation Any ornamentation that is located on the grave anywhere on the grave lot other than on the marker or raised concrete base will be removed and stored immediately. Any object that falls off of the surface of the marker and/or concrete pad will be removed and stored immediately. Any object that is non-conforming will be removed from the gravesite and stored by cemetery staff at the cemetery for 2 months. The Cemetery Caretaker will be permitted to use their discretion when determining which objects of ornamentation must be removed in keeping with the policy framework in Schedule D. Any concerns about the content of this ornamentation policy should be presented in writing to the District of Squamish Director of Recreation, Parks and Tourism.
