1 2018 Marfa Lights Festival Vendor Booth Application Application Deadline: July 31, Marfa Lights Festival Dates and Hours FRIDAY, August 31st - 5 pm to 12 am SATURDAY, September 1st - 10 am to 1:00 am SUNDAY, September 2nd 12 pm to 7pm Vendors may keep their booths open for business later than the official closing time each day. Name Booth Name Address City State, Zip Cell Phone BOOTH SPACE: Booths are 12 ft. x 12 ft. If your booth is any larger than a 12 x 12 space you must purchase an additional space. Booth spaces will be assigned in the order that applications are received. LOCATION PREFERENCE: All booths will be set up along street curbside surrounding courthouse lawn. We cannot offer location preference. Stage is subject to relocation yearly. TRASH DEPOSITS: There will be a trash deposit due at check-in for all Vendors. You will be required to leave a check, prior to setting up, $200 per vendor (Food & Drinks) $50 (All other vendors or booths), which will be returned to you on the final day of event only when and if your space passes clean inspection by a Festival Official. Trash barrels located around the Courthouse are NOT for vendor use. Use of the trash barrels by any vendor will result in a forfeit of the trash deposit. Dumpsters will be located around the courthouse grounds for vendor use. Vendors are responsible for the cleanliness of their area and the conduct of their personnel during and after the event. Vendors must bring a container for all the gray water they will use. Trash deposits will only be returned after vendor s space is inspected by a Festival Official. Deposits will not be returned to any vendor whose space is left in disarray with loose trash or garbage. ORDINANCES: All vendors must comply with state and local ordinances including state sales tax and health codes.

2 FOOD PERMITS: All food vendors must include a copy of a valid and current STATE FOOD PERMIT with their application. The permit must be valid 8/31/2018 through 9/2/2018. Permits must be obtained in advance and presented to Festival Officials prior to setting up shop. This is a state government regulation. Permits will not available in Marfa. If you do not have proper documentation you will NOT be allowed to set up booth and all fees collected will be forfeited. EVENT ITEMS: The Marfa Chamber of Commerce has exclusive rights to all items labeled MARFA LIGHTS FESTIVAL OR MARFA LIGHTS. The Marfa Chamber of Commerce has EXCLUSIVE rights to sell alcohol. ITEMS TO BE SOLD: To help vendors make the most of the weekend. Vendors cannot sell alcohol. We do not give exclusivity to any vendor. LIST ALL ITEMS THAT WILL BE SOLD: ELECTRICITY: Electricity is provided, one plug per booth. No 220 is available. You must bring your own 8, 10, or 12-gauge extension cords. No 14-gauge is allowed. List everything that draws electricity. 4 Marfa Lights Festival 2018 Vendor Rules/Regulations August 31-September 2, 2018 Fees / Refunds Fees must be submitted with a vendor booth application by July 31, Any application postmarked after August 7 must include a $50 late fee. Applications postmarked after August 10, 2018 must include a $100 late fee. NO EXCEPTIONS. No refunds will be given after August 10. No refunds will be given for inclement weather. There will be a trash deposit at check in for all vendors. You will be required to leave a check prior to setting up, $ for food vendors and $50.00 for all other vendors. It will be returned to you on the final day of the event only if and when your space/s pass an inspection by a Festival Official. Booths Space is reserved after your application and payment have been received. Vendor booth is a 12 x 12 space. You must provide your own table, chairs, tent, and overhead covering. All of your tables, chairs and merchandise must be contained within your space. No extended seating areas are permitted. All business must be conducted from within your rented space. Walking and selling is not permitted. The Marfa Chamber of Commerce, the City of Marfa and/or County of Presidio WILL NOT be liable for any theft, damage or vandalism to vendor property. You are responsible for security for your own booth. Booth Setup & Parking NO parking will be allowed around the courthouse. After you have unloaded your booth and supplies, you MUST remove your vehicle. All vehicles left at the courthouse will be subject to ticketing an/or towing. Overnight camping is not allowed on the courthouse grounds. NO support vehicles may be parked near the booths. Please make arrangements to prevent your vehicles from being towed. Electricity Each booth is allotted ONE PLUG. You will need at least 100 feet of 12, 10, or 8-gauge extension cord. No 14-gauge cords. No 220-volt hook ups are permitted. Remember to list everything in your booth that draws electricity.

5 Food Vendor s Note: We must know in advance what type of equipment you will bring, as there is a limit to what is allowed for available amperage at the courthouse. This information must be provided on your application. Remember a copy of your valid and current State Food Permit must be included with your application. The permit must be valid 8/31/18 through 9/02/18. Permits must be obtained in advance and presented to Festival Official before setting up. Clean Up Clean up is a MUST! Due to the amount of trash generated during the festival, every vendor is responsible for all trash within 5 feet of their booth. Each food vendor must pay a refundable $200 deposit and all other vendors a $50.00 deposit upon check in. The deposit will be returned at the end of the festival after your space has been inspected by a Festival Official. Vendors must provide their own trash disposal. Trash barrels located around the courthouse are NOT for vendor use. Use of the trash barrels by any vendor will result in a forfeit of the trash deposit. Please pay attention to the list below of items that are strictly prohibited. If you sell any prohibited items you will be immediately closed down and escorted off the grounds with NO REFUND. The Chamber has the right to confiscate prohibited items: Loud stereo equipment Cigarette related items Anything that stinks (bombs, sprays, etc) Fireworks (snap pops, smoke balls, etc) Weapons (including but not limited to guns, throwing stars, blow darts, knives) Aerosol cans (including but not limited to silly string, hair color, etc) Profane or obscene items of any kind Drug or gang related items Confetti eggs Live animals (including aquarium turtles) Any toy that projects anything including but not limited to guns, slingshots, soft air guns, paint ball guns, etc. The Marfa Chamber of Commerce reserves the right to restrict the sale of any item that we deem harmful or inappropriate to the welfare of this event even if it is not specifically listed. All items you intend to sell must be listed on your application or on a separate sheet of paper. The Chamber of Commerce reserves the right to inspect any vendor s merchandise at any time. Be aware that vendor rules and regulations, city codes and state laws will be strictly enforced. The Marfa Chamber of Commerce reserves the right to refuse any application.

6 THE MARFA CHAMBER OF COMMERCE HAS EXCLUSIVE RIGHTS TO SELL ALL ITEMS LABELED MARFA LIGHTS FESTIVAL OR MARFA LIGHTS. The Chamber will have ice on hand. THE MARFA CHAMBER OF COMMERCE HAS EXCLUSIVE RIGHTS TO SELL ALCOHOLIC BEVERAGES AT THE MARFA LIGHTS FESTIVAL. FAILURE TO COMPLY WITH THESE RULES WILL RESULT IN CLOSURE OF BOOTH SPACE WITH NO REFUND OF VENDOR FEES. Please sign and return this page with your application.
